LEAVE AND HOLIDAYS

1. National Holidays
• 15 August Independence Day
• 26 January Republic Day
• 2 October Ghandi Jayanti
• 1 May Day
• 1 Nov Kanada Rajya Utsav

2. Weekly Holidays
• Every establishment shall remain closed for one day of the week. The
employer shall fix such date at the beginning of the year
3. Festival Holidays
• At Least 5 holidays in a year

4. Earned Holidays
• Earned Leaves can be accumulated up to a limit of 45 leaves
• Earned Leaves Can be converted in cash could be specified by the
establishment's policies or employment agreements.
• Tax Benefits on Earned Leaves only after retirement
• Maximum 18 in a year. One Leave for every 20 day worked. The usual
allocation based on the establishment's policies or agreements
• Every employee at least need to work for 240 days a year (including
festival holidays ) At least 2/3 of 240 days if employee joined
company in mid-year
• Calculation to be done in accordance to calendar year 1 jan-31dec

5. Casual Holidays
• It is Uncertain Leave
• Every Company offer casual leave of 7 days in year
• Not entitled to take 3 leaves at a time without prior permission
• It cannot be carryforward or uncashed
• It can be converted into Earned Leave/ Privileged Leave
• Not Compulsory to give
6. Sick Leave
• 12 sick Leave Per year. One per month
• Can take 2-3 Sick Leave without furnishig medical certificate

7. Maternity Leave
• This Leave is 26 week long if she has worked at least 80 days
• Light work for 80 days after joining
• ESI department will pay maternity benefit on the behalf of companies
under ESI
• 12 week benefits in case of adoption and adopted baby under 3
months
• In case of miscarriage 6 week
• Biological Mother 12 week
• 2 week extra in case of complication

8. Working Hour
• 9 Hours a day and forty eight hours in a week
• After 5 hour of work rest for one hour
• Maximum overtime 50 hours in quarter
• Spreadover Hours 12 hours in a day
• Over time wage twice the rate of normal wage
