8.0 DEVELOPMENTS
On 27 February 2023, the insurer instructed us to close the case as the condensation
(container sweat) is considered inherent vice or nature of the subject matter insured that is
one of the General Exclusions Clause. As this shipment is FCL cargo, it is considered that the
damage occurred out of this insurance coverage period.
On 3 March 2023, we sent an email correspondence to the consignee advising that the
insurance policy is not covered due to condensation (container sweat) is considered inherent
vice or nature of the subject matter insured which is one of the General Exclusions Clause.
To date of writing this report, we have not received ant feedback from the consignee.
9
OUR REF: JTW 015
Based on our findings and information obtained, we are of the opinion that the wet/dried out
and water stained damage as well as rust stain sustained to the Duplex Board Grey Back is
considered attributable to condensation (container sweat) during temperature variations i.e.
cold to hot climate at some stages whilst in transit prior to delivery to the consignee’s
warehouse premises.
In addition, the crumpled and torn damage sustained to Duplex Board Grey Back is
considered attributable to the same was come into contact with the other hard / heavy objects
and/or rough / improper handling of the cargoes at some stages most probably during
stuffing operation/ unstuffing from laden containers.
