The exceptional jurisdiction of the Administrative Court of

Appeal of Algiers in light of the Algerian legislator embodying the


principle of litigation on two levels in administrative matters
through the administrative courts of appeal

Abstract : Prior to 2022, the administrative judiciary in Algeria defined the adoption
of the principle of litigation on two levels based on the judicial rule that grants the
authority to receive appeals, study and adjudicate them to the State Council. This was
the subject of criticism by specialists for many reasons, which made the Algerian
procedural legislator abandon this methodology, and introduce administrative courts of
appeal to give a true embodiment of this principle.
