Dear Ms. Steinberg

We represent Elmhurst Community Unit School District 205 and are responding to your
letter of November 3, 2023, regarding the above-referenced FOIA Request for Review.

In your letter, you describe Mr. Giuliani’s September 26, 2023 FOIA request as seeking
“copies of a letter or other documents informing a specified teacher about her alleged violation of
policy that led to her public discipline at a board of education meeting in August.”

The District’s response to this request was that the responsive records were exempt from
disclosure under Section 7(1)(n) of the FOIA. Without wavier of that position and without
establishing a precedent with respect to records of the same or similar nature, the District has
decided not to expend further time or resources in a dispute over this particular record and,
therefore, attaches the requested record for release to Mr. Giuliani. The redactions in the record
are the signatures of the Principal and the teacher which are exempt from disclosure as private and
personal information under Sections 7(1)(b) and (c) of the Act.
