Dear Freedom of Information Officer:

I am submitting this Freedom of Information Act (FOIA) request on behalf of Coalition For
Change, Inc. (C4C) to the U.S. Equal Employment and Opportunity Commission (EEOC) at the
email address listed on their website.1 This informational request is made for the following:

1. Disciplinary Referrals. The number of referrals the EEOC made to the Office of Special
Counsel for disciplinary action made each Fiscal Year (FY) from FY2013 to FY2023.2

2. On-site Program Compliance Evaluations. The number of federal agency on-site


reviews the EEOC conducted each Fiscal Year (FY) from FY2013 to FY2023; and name
of each agency subject to an EEOC review during a given Fiscal Year.

3. Class Actions.3 The number of pending class actions governmentwide. [Include total
class actions before the EEOC, both certified and non-certified, by agency.]

4. Head of Agency Reporting Requirement.4 A listing of “Cabinet-level” agencies that


have not complied with the Cummings Law at the present.

5. Adjudicatory Role. Any EEOC legal decision authorizing non-federal entities (law firms, or
outside attorneys) to perform the EEOC’s adjudicatory function, as well as any correspondence
discussing the aptness of contracting out an inherently governmental EEOC function.

The C4C is a public interest group established in 2008 to eradicate employment discrimination
in the Federal government. The C4C also serves as an informational support network for present
and former Federal employees harmed due to workplace discrimination. As a non-profit public
interest group, we seek a waiver of fees associated with this request. The C4C believes disclosure
of the requested information is in the public interest and will contribute significantly to the public’s
understanding of the operations and/or activities of the government. Moreover, consistent with the
intent of the Elijah Cummings Federal Employee Antidiscrimination Act the provided information
would further provide transparency and promote accountability in government’s operations. Do
note, if fees cannot be waived, please provide timely information for further appeal. The C4C
recognizes the EEOC’s critical enforcement role and has identified information which should be
