Dear THACHAAYENY A/P NADUNCELEAN,

RE: LETTER OF APPOINTMENT ON A CONTRACT FOR SERVICE AGREEMENT.

We are pleased to offer you an appointment as a REAL ESTATE NEGOTIATOR in our company on the
following terms and conditions:-

1. Remuneration : Your commission rate shall be as follows: -

a) Non Project Scheme – Commission payable is on a flat rate of 40%


on condition of the successful closure and signing of the Sale &
Purchase Agreement or Tenancy Agreement in accordance with the
law without any issues of illegality, fraud, misrepresentation, unlawful
dealings and successful completion and signing of the sale, and will be
calculated subjected to professional fees collected excluding the SST
which will be subjected to changes from time to time.

i) Such commission is subjected to the Real Estate Negotiator’s


responsibility to successfully collect the commission and report
progress to the Agency promptly and report to work on behalf
of the Agency by way of legal means.

ii) In the event any issues arise from complaints against you and
the Agency, Agency shall have the sole discretion to withhold
the commission and/or claim any damages from you.

b) Project Scheme – Commission rate will be fixed subject to Project


Fees and costs incurred by the Agency – agreed upon from time to
time and upon collection from the developer.

2. Your Duties : a) To be responsible for sourcing of listing, marketing and sale, rental
and leasing of properties.

: b) All listing of properties or prospect either secured by you or provided


by the Agency shall be treated with care and utmost confidentiality
and not to be shared, distributed or reach out by any form of
dissemination by verbal or in writing through any source of
communication.

: c) All listing brought by you shall be true and accurate information


without any distortions, misrepresentation or illegality as to the facts
and ownership.

: d) (The Agency shall be the sole proprietor of the listings and


information) provided by you or given by the company and (such
information shall be treated as private and confidential)

: e) To effectively implement and enforce the Agency policies, rules and


regulations or handbook; which will be subjected to changes from time
to time by way of Notice or Memo to all staff to whom it may concern at
the Notice Board. Such Notice posted on the Notice Board shall be
sufficient notice. and is binding on all staff, contract staff (as the case
may be) and Real Estate Negotiator.

: f) All reporting’s must be made to the management of the Agency.

: g) You shall not abuse or misuse the resources of the Agency such as
Cid Search, Cid Harta, CTOS and any other tools provided by the
agency for your own benefit and which has no relation to the business
or to the Agency.

3. Marketing Tools
And Expenses : The Agency shall only bear for expenses that are related to the Agency work.
These expenses shall be arranged and subject to the policy, notice or practices
of the Agency from time to time at the sole discretion of the Agency.

All Marketing Tools and items that belong to the company that is taken or on
loan shall be returned in good order and condition. Otherwise if it is misplaced
or stolen, you shall solely bear for the cost and pay to the Agency for the
replacement with immediate effect. All items that are given by the Agency shall
be returned to the Agency upon your resignation, termination or suspension
from or by the Agency. All Marketing Tools such as banners, signboards and
posters shall be printed through the company or by company panel suppliers
only; the expenses shall be borne by the Real Estate Negotiator.

4. Office Hours : 9.00 A.M. to 6.00 P.M. Monday to Friday

5. Probationary : You shall be under probation for a period of three (3) months.
Period Your confirmation is subject to the achievement of your sales target and at the
absolute discretion of the management. In the event you leave the Agency
within the probation period, you shall give the Agency One (1) Month Notice
and shall hand over all information, listing, name card and items to the
Company. In the event the Agency terminate your services, it shall be with
immediate effect and you shall hand over all information, listing, name card and
items to the Company

6. Rules & Regulations: i) You shall abide by all the Rules and Regulations of the Board of
Valuers, Appraisers and Real Estate Agents Malaysia. Infringement of any
rules may result in immediate termination of your appointment. You shall also
be fully liable to the penalty imposed by the Board of Valuers, Appraisers,
Estate Agents & Property Managers (hereinafter known as BOVAEP) for any
infringement of Rules and Regulations.

7. Sales Target : Your sales target shall be RM9,000 for the first three (3) months. Your annual
sales target shall be RM36,000 (and may change from time to time depend on
the Agency’s policy). Sales are defined as the professional fees received by
the company excluding SST

8. Dress Code : In your course of dealing with clients or customer, you are expected to dress
appropriately. When dealing or communicating with clients, you shall conduct
yourself properly and professionally to the customer and to deal with the
customer with caution and negotiate without any ignorance or
misrepresentation of the facts and terms as instructed by the customer and
owner of the property.

9. Termination of
Appointment : The Agency shall reserve the right to terminate this appointment by giving you
a verbal or written notice to that effect with immediate effect or One (1) Month
Notice subject to the following:-

1) In the event of your failure to observe or perform the lawful and proper
instruction of the company and Agency’s policy; or

2) If you commit any improper conduct which in the opinion of the


company is prejudicial to its interest of the Agency; or

3) During your probationary period, you fail to meet the sales target.

10. REN TAG 1) You shall endeavor to obtain the REN TAG from BOAVEP at
your own costs; and
2) You shall attend the CDP courses conducted by BOVAEP on an
Annual basis for the renewal of your REN TAG. Failure to do so
may result in any constructive action by the Agency including
termination of services.

During or after your course of employment with the Agency, you are prohibited from defaming, disseminating
any bad or unhealthy information that will affect the reputation of the Agency. If you have done so, the Agency
reserves the right to terminate and / or sue you for damages, the cost, legal costs and any incidental costs of
which shall be borne by you.

If you are agreeable to the above terms and conditions, kindly sign and return the duplicate copy of this letter
with a copy of your identity card to the administration department.
