MoneyUp Chat by Capitec Terms of Use

MoneyUp Chat is a Capitec consumer education learning solution delivered via WhatsApp Messenger. These terms will apply to all your activities on and
interactions with the MoneyUp Chat WhatsApp Service.

By making use of MoneyUp Chat through the WhatsApp Messenger application as defined herein below, you are acknowledging that you have read these
Terms of Use, together with the Privacy Policy and the MoneyUp Chat Competition Rules, that you understand them and that you agree to be bound by and
comply with them.

1. Definitions

1.1 “Activities” shall mean all interactions with the MoneyUp Chat channel, Courses and Mini Challenges;
1.2 “Content” shall mean the learning material found on the MoneyUp Chat solution delivered through the WhatsApp Messenger
application describing the Courses and Activities;
1.3 “Course(s)” shall mean the Content on the MoneyUp Chat channel consisting of four chapters each and will be categorised under
different financial topics, from time to time;
1.4 “Capitec” means Capitec Bank Ltd [Registration Number: 1980/003695/06], a public company duly incorporated in terms of the
Companies Laws of South Africa with its registered address at 5 Neutron Road, Techno Park, Stellenbosch and its affiliates, subsidiaries,
holding companies, partners, employees, officers, servants or agents and the terms “we”, “us”, “our” when used herein means the
Company
1.5 ‘Mini challenge’ shall mean a complete piece of content on the MoneyUp Chat channel published under any topic on the Mini challenge
menu section
1.6 “MoneyUp Chat” means Capitec’s consumer education mobile learning solution offered by Capitec and delivered via WhatsApp;
1.7 “Service” shall mean the MoneyUp Chat WhatsApp number on which the Courses, Activities and Content will be made available to the
User, which platform is delivered via WhatsApp;
1.8 “Number” shall mean +27 87 240 5757
1.9 “Username” shall mean the name entered by a user on the Service;
1.10 “User” or ”you” shall mean you, the person reading these Terms and/or making use of the Number/Channel/Course(s)
1.11 “WhatsApp” means WhatsApp LLC;
1.12 “WhatsApp Messenger” means the electronic communication application provided by WhatsApp;
1.13 “WhatsApp Message” means an electronic communication using WhatsApp Messenger;
1.14 “WhatsApp Chat” means a series of WhatsApp Messages as will appear in the user account chat history; and
1.15 “WhatsApp Terms of Service” means the terms of service determined by WhatsApp and that applies between you and WhatsApp when
you use the application

2. User Profile
2.1 If you are an un-emancipated minor, you require the assistance of your legal guardian, when accessing this Service and being bound by
these conditions
2.2 In order to access the MoneyUp Chat Services, you have to add Capitec’s MoneyUp Chat number, +27 87 240 5757, to your contacts.
It is your responsibility to check that there is a green tick next to our profile each time before you send us a WhatsApp Message. The
green tick means that WhatsApp has verified with Capitec that this is the real MoneyUp Chat account
2.3 You will be required to provide a Username in order to create a profile and personalise your communication with us. You may change
your Username at any time by editing it under ‘My profile” on the Service
2.4 You are solely responsible for the Activities linked to your Profile;
2.5 Profiles cannot be transferred from one User to another;
2.6 Profiles will be closed if:
2.6.1 either Party terminates the relationship by giving notice of termination to the other Party;
2.6.2 we believe or suspect you are using the MoneyUp Chat Service wrongly or unlawfully (illegally);
2.6.3 you send inappropriate content to us;
2.6.4 we must do this for legal reasons;
2.6.5 or upon the death of the User
2.7 Capitec reserves the right to discontinue MoneyUp Chat and/or the Service at any time, at its sole discretion with immediate effect,
and to take down the service without notice
2.8 Never respond to any strange number claiming to be MoneyUp Chat. We will not send you a link to disclose your Personal Information

2.9 You are responsible for notifying us on the contact details below if someone gained unlawful access to your Profile

3. Disclaimer
3.1 The MoneyUp Chat number will only be used to access the Courses and Mini Challenges which are solely for educational purposes. No
Capitec banking products or services will be accessible or made available on this Platform
3.2 The MoneyUp Chat service is an automated chatbot designed to deliver generalised financial education. Open text questions or inputs
cannot be responded to
3.3 While every effort has been made to ensure the accuracy of information contained on the Platform, Capitec provides no representation
or warranty, express or implied, regarding the accuracy, completeness or correctness of the information and in no way warrants that the
Content provided or information contained therein will be error-free or that it will meet any particular criteria of accuracy, completeness
or reliability of information, performance or quality
3.4 You acknowledge and understand that any information provided to you by means of the MoneyUp Chat Service should not to be
regarded as either advice or an intermediary service in terms of the Financial Advisory and Intermediary Services Act, 2002 ("FAIS")
Accordingly, Capitec shall not be held liable for any damages suffered by you should you rely upon such information to your detriment
3.5 Capitec will not, under any circumstances, be liable for any costs, claims or damages that you may sustain or suffer as a result of accessing
the Service, or participating in any Course, Mini Challenge or Activity, or any actions that you may take as a result of such access,
registration or participation. Under no circumstances do we guarantee your suitability for a particular Course based on the levels of
difficulty

4. Communication: Tips and Reminders

4.1 By accepting these Terms you agree to receive periodic WhatsApp messaging from MoneyUp Chat regarding, where applicable:

5. Usage

5.1 Capitec reserves the right to change, modify, add or remove portions or the whole of these terms and conditions from time to time;
5.2 The Content contained on the Service does not constitute financial advice and you as the User should consult a financial advisor before
acting on any information on the Platform;
5.3 When you successfully join the chat on the Service you will be given a limited, revocable and non-exclusive right to use the Service, the
Course, the Content and the Activities, solely for your personal, non-commercial and educational purpose; Any other usage is strictly
prohibited;
5.4 You may not reproduce, redistribute, assign, sell, edit, create derivative works of, sublicense, or otherwise transfer any Course material;
5.5 The duration of access to the Service and Content shall be at Capitec’s discretion
5.6 You may not access or use the Activities, Service, Courses or Content for unlawful purposes;
5.7 You acknowledge that the WhatsApp Terms of Service and WhatsApp Privacy Policy applies to you when you use WhatsApp Messenger
and that you must comply with WhatsApp Terms of Service.
5.8 We will not be liable for any technical or other problems (interruption, malfunction, downtime or other failures) which affect WhatsApp
Messenger, our banking system, a third-party system or any part of any database, for any reason.
5.9 You acknowledge that (i) Capitec Bank will not be responsible for any mobile operator or Internet service provider's network and/or Wi-
Fi (wireless internet access) connectivity preventing or negatively impacting your access to the MoneyUp Chat Channel; and (ii) your
mobile network operator (cellphone service provider) or internet service provider may charge you for accessing and using the MoneyUp
Chat Channel via a mobile network or Wi-Fi connection, and that you are solely responsible for such charges

6. Intellectual property and copyrights

6.1 The Service, Content and/or Courses, are the property of or licensed to Capitec and all intellectual property rights vests in Capitec
and/or its licensors
6.2 Unauthorised copying of the Service, Courses, Mini Challenges, Content, information, software and or file(s) or attempt of copying is
expressly prohibited

7. Applicable law

7.1 These Terms of Use have been concluded in the Republic of South Africa (“RSA”) and as a result shall be governed by and construed in
accordance with the laws of the RSA and the jurisdiction of the RSA courts

Privacy Policy
1. We will collect and process your personal information in a responsible and lawful manner
2. Personal information relating to you may be collected and processed as a result of your use of the Service and/or the Courses. Personal information
may be processed by, or on behalf of, Capitec for the following purpose:
2.1 improving the functionality of the Service;
2.2 assessing the effectiveness of the Courses;
2.3 improving on Course content;
2.4 keeping a database of users;
2.5 maintaining a record of your access to the Service; and
2.6 sending you communications relating to the Service and/or Courses
3. You understand and accept that we may process your personal information collected through this Service in combination with personal
information collected from you through any other engagements you may have consented to with Capitec, for the purposes described above or
set out in other agreements between you and Capitec
4. We may contract with third-party service providers to perform certain processing functions on behalf of Capitec and such processing by third
parties shall only be for the purpose described above

5. Methods of collection:
5.1 We may request certain personal information from you, including but not limited to, your name and surname, telephone number, device
details, education, lifestyle, financial health, etc.
5.2 We may use technology to collect information about your use of the Service, and/or Courses. For example, our web server automatically
logs which pages of our website our visitors view, their IP addresses and which web browsers our visitors use. This technology enables
us to compile statistics about our visitors and their use of our website.
5.3 The Service contains hyperlinks to other pages on our website. We may use technology to track how often these links are used and which
pages on our website our visitors choose to view. This technology enables us to compile statistics about the use of these hyperlinks.

MoneyUp Chat Competition Rules

Prizes

Level 1 Prize Draw: A mobile data bundle of up to 350MB


Level 2 Prize Draw: A mobile data bundle of up to 3GB

Competition period

1 September 2023 – 28 February 2024

How to enter

• The criteria for entry into a lucky draw to win a mobile data reward during the competition period (“valid entry”) are as follows:

Level 1 prize draw:


o Complete any Mini Challenge on the MoneyUp Chat solution and obtain full marks for the quiz.

Level 2 prize draw:


o Complete a Chapter in the MoneyUp Chat Savings course and obtain full marks for the quiz; or
o Complete all 5 challenges in the MoneyUp Chat Slam the Scam course and obtain full marks for the quiz; or
o Complete any 5 Mini Challenges on the MoneyUp Chat solution, with full marks for each quiz.

• On the day you complete either a Course, Chapter or Mini Challenge, you will automatically and immediately be entered into an instant lucky draw to
win mobile data at the applicable Level.
• If you win the instant lucky draw, you will be notified by SMS and your mobile data will automatically be loaded to your registered mobile number on
which the WhatsApp learning content was completed.
• If you do not win the instant lucky draw, you will be notified on the MoneyUp Chat WhatsApp service. You will then be entered into a second randomised
daily draw. Five (5) people per prize level are selected every 24 hours in the daily draw. The winners will be notified by SMS within 24 hours.

Competition terms and conditions

1. The name of the competition is “MoneyUp Chat Data Rewards Competition” and Capitec is the promoter
2. The competition will run from 1 September 2023 – 28 February 2024.
3. The competition is open to natural persons –
3.1 Who have an active mobile number supported by one of the 4 major South African mobile network operators: Vodacom, MTN, Cell C or Telkom,
enabled to receive top up data bundles
4. The winners will be randomly selected by a computer-programmed algorithm
5. All valid entries collated will be entered into an automated random draw selection process and data will be awarded within 24 hours
6. Winners will receive their data automatically and will be notified by SMS to the registered mobile number on which the learning content was
completed
7. Non-winners still stand a chance to win as they will automatically be entered into a second randomised daily draw. Five (5) people per prize level
are selected every 24 hours in the daily draw and winners will be notified by SMS on the registered mobile number on which the learning content
was completed.
8. Prizes are not transferable or negotiable
9. Capitec Bank reserves the right to substitute any prize with another prize of similar commercial value
10. Your entry and/or participation in the competition and/or your acceptance of the prize (in the event that you win a prize) constitutes your binding
acceptance of the competition rules
11. Should any dispute arise in relation to the interpretation of these competition rules, Capitec’s decision shall be final, and no correspondence shall
be entered into
12. You may not win a prize if it is unlawful for us to supply such a prize to you. You must be eligible to win the prize

13. Any documents, permissions and/or any legal or regulatory requirements that may be required by these rules or any other applicable law in order
to accept and use a prize, shall remain your responsibility to obtain and/or observe at your own cost, and which documents and permissions must
remain valid in such minimum form required by these rules or any other applicable law
14. Capitec its affiliates, employees, advertising agencies and suppliers will not be responsible, and hereby disclaim all liability, for any loss, injury or
death, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any
other cause, which is suffered by your participation in the competition or the acceptance and/or use by you, of any prize, or by any action taken
by the promoter or any of its affiliates, employees, advertising agencies and suppliers in accordance with the competition rules
15. If you fail to comply with any of the competition rules, then without prejudice to any other remedy which we may have, you will be automatically
disqualified and you will forfeit the prize(s) (in the event that you have already won a prize)
16. If Capitec is required by the Minister of Trade and Industry to alter any aspect of the competition or to terminate the competition as a result of
changes in legislation, the promoter will have the right to terminate the competition with immediate effect and without notice of such termination.
In such event, all participants hereby waive any right which they may have against Capitec Bank, its affiliates, employees, advertising agencies and
suppliers
17. Income taxes relating to the prizes, if any, are the sole responsibility of the prize winners
18. These competition rules will be construed, interpreted, and enforced in accordance with the laws of the Republic of South Africa
