1.0 INTRODUCTION

1.1 Introduction and Background


Energy Department Punjab (EDP), through its Project Management Unit (the Client),
intends to engage competent and qualified EPC Contracting firms, henceforth referred to
as ''the Applicant" for "Design and Construction of Net Zero Energy Building". This
building will be called "Energy Resource Center" CERC).
ERC would be a state-of-the-art Energy Efficient office building which will be "Gold"
LEED Certified. ERC shall perform two main purposes:

1. Serve as an office building for the Energy Department, Government of the Punjab,
and all its affiliate departments that are currently located at more than 6 different
locations across the city.
2. Serve as an educational space for disseminating information on the concept of
Energy Efficiency & Conservation; displaying renewable energy technologies and
possible prototypes in an Exhibition Room; use the auditorium for seminars on
Energy Efficiency & Conservation and all specific topics to be covered under it,
such as energy audits, creation of an Electricity Supply Company (ESCO) market,
standards and labelling of appliances, retrofitting, building codes etc.

The ERC will serve as a model for the first truly Energy Efficient building in
Pakistan that will catalyze the private sector to invest in more Energy Efficiency
& Conservation measures in buildings. The capabilities of the local firms will be
enhanced regarding the approach to design and construction of an Energy
Efficient facility. Cost- efficiency of such building designs will be highlighted to
enable the designing of further sustainable buildings, not only as showcase
projects but also as cost-efficient alternative to standard building designs.

The ERC will include the following features:

The ERC may include other functionalities /features as per modem commercial
buildings and the latest requirements of LEEDs for Gold Certification, 62%
Reduction from Current Average Level (Annual Electricity Consumption per
Square Foot = 18.35 kWhNear/Sqft) for Net Emission (as per ADB's DLI-8).
The Applicant who has been awarded the Contract shall obtain aforementioned
certification and energy reduction from the concerned authority/body for ERC.

2.0 INVITATION FOR PRE-QUALIFICATION

Date: January, 2024

1. The PMU Energy Department, Government of Punjab has been entrusted by the
Government of Punjab and provided funds to finance the cost of Design and Construction
of Net Zero Energy Building to eligible payments under the contract(s) for which this
Invitation for Pre-qualification is issued.

2. The PMU Energy Deparment, Government of Punjab hereinafter the Employer intends to
prequalify Applicant for the following Works under this project: Design and Construction
of Net Zero Energy Building in Lahore, Punjab

3. It is expected that Invitation to Bid will be issued by January, 2024.

4. Pre-qualification is open to Applicants/firms/joint ventures of Applicants/firms (JV), who


shall have the nationality of Islamic Republic of Pakistan, and are registered with Pakistan
Engineering Council (PEC). The sole firm or lead partner of the JV shall be registered in
Category 'C-A' for works, whereas, the other partners to JV shall have valid license in the
appropriate category relevant to their share/nature of works, described in para 2 mentioned
hereinabove. Applications may be submitted for pre-qualification for the above Works.

In addition to above, incase of JV partner solely responsible for Design Services must have
valid licensees) in appropriate category ofPEC or PCATP or any relevant regulatory body.

5. Appropriate category PEC registered Applicants may obtain the prequalification


documents from the office of the Employer, at Project Management Unit (PMU) Office,
Energy Department, Lahore or may request to send the same through mail at the specified
address

6. The request must clearly state "Request for Pre-qualification Documents" for Design and
Construction of Net Zero Energy Building in Lahore, Punjab. The documents are available
for a non refundable fee of PKR 5,000/-. The documents if requested by mail will be
promptly dispatched by registered mail for which cost of mail will be borne by the
Applicant, however, under no circumstances the Employer will be responsible for late
delivery or loss of the documents so mailed.

7. A minimum requirement for pre-qualification will be to have successfully completed i.e.


scoring of minimum 60% marks to get pre-qualified for the Project, whereas 30% marks
are required to be obtained under each sub-heading.

8. Applications for Pre-qualification must be delivered in sealed envelopes by hand or


through registered mail, to:-

9. The Energy Department, Government of Punjab reserves the right to not to accept the late
applications.

10. Applicants will be informed, in due course, of the result of the evaluation of applications.
Only the firms of Applicants and joint ventures prequalified under this process will be
invited to bid.

3.0 INSTRUCTIONS TO APPLICANTS

3.1 Submission of Applications

3.1.1 Applications for pre-qualification (one original and two copies) must be
received in sealed envelopes to be delivered by hand or through registered mail
to:-

not later than 1100 hours January 31, 2024

and be clearly marked "Application for Pre-qualification" for Design and


Construction of Net Zero Energy Building in Lahore, Punjab. The Employer
reserves the right not to accept the late applications.

3.1.2 The name and mailing address of the Applicant shall be clearly marked left
hand on the envelope.

3.1.3 The Application shall be typed or written in indelible ink and shall be signed
by a person duly authorized to sign on behalf of the Applicant.

The requirements regarding the legal instrument evidencing the authorization


to represent and sign on behalf of the Applicant shall be a Power of Attorney,
indicating that the person signing the Application has the authority to sign the
Application for Prequalification. The name and position held by each person
signing the authorization must be typed or printed below the signature. Power
of Attorney must contain the sample signatures of the person authorized to sign
the Application of Pre-Qualification.

3.1.4 The applications shall be prepared in the English language. Information in any
other language shall be accomplished by its translation in English. Employer
reserves the rights to dis-qualify in case of non-compliance of the above
requirement.

3.1.5 The Applicants must respond to all questions and provide complete
information as advised in this document. Any lapses to provide essential
information may result in dis-qualification of the Applicant.

3.1.6 The clarification meeting will be held. The time, date and place of the meeting
is as follows, where all prospective Applicants may request clarification about
the project and the evaluation criteria. However, the Applicant may seek
clarification post/other communication means not later than five days prior to
the date of submission of Application for Pre-Qualification.

3.1.7 At any time prior to the deadline for submission of Applications, the Employer
may amend the Prequalification Document by issuing addendum.

Any addendum issued shall be part of the Prequalification Document and shall
be communicated in writing to all who have obtained the Prequalification
Document from the Employer.

To give prospective Applicants reasonable time in which to take an addendum


into account in preparing their Applications, the Employer may, at its
discretion, extend the deadline for the submission of Applications

3.1.8 To assist in the evaluation of Applications, the Employer may, at its discretion,
ask any Applicant for a clarification of its Application which shall be submitted
within a stated reasonable period of time. Any request for clarification and all
clarifications shall be in writing.

If an Applicant does not provide clarifications of the information requested by


the date and time set in the Employer's request for clarification, the Employer
may proceed with the evaluation based on the information submitted with the
Application.

Any unsolicited information provided by the Applicant, shall not be considered


by the Employer for Pre-Qualification of the Applicant.

3.1.9 The Employer reserves the right to annul the prequalification process and reject
all Applications at any time, without thereby incurring any liability to
Applicants.

3.2 Qualification Criteria

3.2.0 EligibilityCriteria
1) An Applicant may be an entity or any combination of entities with a formal
intent to enter into an agreement or under an existing agreement in the form
of a Joint Venture. In the case of a Joint Venture,

(a) all partners shall be jointly and severally liable; and


(b) a Joint Venture shall nominate a Representative who shall have the
authority to conduct all business for and on behalf of any and all the
partners of the Joint Venture during the prequalification process; in
the event the Joint Venture is prequalified, during the bidding
process; and, in the event the Joint Venture is awarded the Contract,
during contract execution.

2) An Applicant, and all partners constituting the Applicant, shall have the
nationality of Islamic Republic of Pakistan. An Applicant shall be deemed
to have the nationality of Pakistan if the Applicant is constituted,
incorporated, or registered and operates in conformity with the provisions
of the laws of Pakistan. [See definition of Pakistani Constructor at PEC
Constrution and Operation of Engineering Works Byelaws No. 2Ua)]

3) An Applicant (in case of JV, all Partners to JV) shall be duly licenced by
the Pakistan Engineering Council (PEC). The sole firm or lead partner of
the JV shall be registered in Category 'C-A' for works, whereas, the other
partners to JV shall have valid license in the appropriate category relevant
to their share/nature of works. In case validity of licence has expired, the
Applicant must had applied for renewal of licence before submission of its
application and furnish the evidence/receipt of the renewal fee.

In addition to above, incase of JV partner solely responsible for Design


Services must have valid licensees) in appropriate category of PEC or
PCA TP or any relevant regulatory body.

4) An Applicant (in case of JV, all Partners to JV ) shall be registered in a


relevant category with concerned authorities of Income Tax, Sales Tax,
Provincial Sales Tax and must be on Active Taxpayer List of the concerned
authority at the time of submission of its Application.

5) An Applicant shall not be eligible to participate in this prequalification


process while under temporary suspension or debarmentlblacklisting by the
Employer, any Government/Semi GovernmentlPublic Department in
Pakistan (whether notified or not by Punjab Procurement Regulatory
Authority (PPRA) , and Public Procurement Regulatory Authority on its
website). An affidavit shall be provided by the Applicant confirming its
status as on the date of submission of application for pre-qualification.

6) Applicants shall not have a conflict of interest. All Applicants found to


have a conflict of interest shall be disqualified. Applicants may be
considered to be in a conflict of interest with one or more parties in the
prequalification process, if any of the following apply:
a) an Applicant participates in more than one Applications in this
prequalification process, either individually or as a partner in a joint
venture. This will result in the disqualification of all Applications in
which the Applicant has participated;

b) two or more Applicants partially or wholly owned or directed by
common individuals, regardless of extent of their shares or interest
shall not be eligible to participate in the prequalification process. Either
only one such Applicant may participate or such Applicants may form a
joint venture to participate as one venture; and

c) The Applicant (including all members of a N) must not be associated,


nor have been associated in the past, with the design review and
construction supervision consultant of this project or any other entity
that has prepared the design, specifications, for this project, over the
last five years. Any such association may result in disqualification of
the Applicant.
7) All pending litigation and arbitration of the Applicant (in case of N, all
firms/partner to N), if any, shall be treated as resolved against the
Applicant and so shall in total not represent more than fifty percent (50%)
of the Applicant's net worth for the last year calculated as the difference
between total assets and total liabilities.
8) As a minimum, Applicant (in case of JV, the lead partner of N) average
net worth for the last 3 years, calculated as the difference between total
assets and total liabilities, shall be positive.
9) The Applicant shall submit an undertaking confirming that incase of award
of the contract LEED Gold Certification (BD+C) shall be achieved for the
ERC building in the prescribed performa (A12).

Applicants shall provide such evidence of their continued eligibility satisfactory to


the Employer, as the Employer shall reasonably request.

The Applicant who do not meet all of the above Eligibility Criteria shall be
disqualifedfrom the Pre-Qualification process.
3.2.1 General

Pre-qualification will be based on the criteria given in succeeding paras 3.2.2 to


3.2.5 regarding the Applicant's Financial Soundness, Experience Record,
Personnel Capabilities and Equipment Capabilities as demonstrated by the
Applicant's responses in the forms attached to this letter.

The Employer reserves the right to disqualify the Applicant if submitted


Application for Pre-qualifcation contains material deviation. A material
deviation is one in which capability of the Applicant in any criteria is not
substantiated from the provided information with the Application.

Sub-Applicant's experience and resources shall not be taken into account in


determining the Applicant's compliance with the qualifying criteria. However,
Joint Venture experience & resources shall be considered. Consortium or
Association of firms will be considered for similar treatment as in case of Joint
Venture. Prequalification Criteria is as follows:

Note: Prequalification status shall be decided on the basis of Pass/Fail


basis. The applicant must secure at least 30% score in each
category but not less than 60% commulatively.

3.2.5 Financial Position

Credit Marks shall be awarded on the basis of the following criteria:

3.3 Joint Venture (JV)

3.3.1 Joint Venture must comply with the following requirements:-


a) Following are minimum qualification requirements:-

i) The lead partner shall meet not less than 50% percent of all
qualifying criteria given in paras 3.2 and 3.4 heretofore.

ii) Each of the partners shall meet not less than 25% percent of all total
criteria given in paras 3.2 and 3.4 heretofore. Or, if partner to N is
Design Consultant, it shall meet not less than 50% percent of the
criteria given in Sub-Clause 3.2.2 (iii & iv) & 3.2.3 (i).

iii) The joint venture must collectively satisfy the criteria of paras 3.2,
and 3.3, for which purpose the relevant figures for each of the
partners shall be added together to arrive at the N's total capacity.
Individual members must satisfy each of the requirements of paras
3.4 and 3.5 heretofore.

b) Any change in a prequalified JV after prequalification, shall be subject to


the written approval of the Employer prior to the deadline for submission
of bids. Notwithstanding above, the Consultant evaluate the change in
prequalified according to the pre-qualification criteria and submits his
recommendations to the Employer for approval. Such approval shall be
denied if:-

i) Partner(s) withdraw from a N and remaining partners do not meet


the qualifying requirements;

ii) In the opinion of the Employer, a substantial reduction in


competition would result.

c) Bid shall be signed by all members in the N so as to legally bind all


partners, jointly and severally, and any bid shall be submitted with a copy
of the N agreement providing the joint and several liability with respect
to the contract.

3.3.2 The prequalification of a N does not necessarily prequalify any of its partners
individually or as a partner in any other JV or association. In case of dissolution
of a N, each one of the constituent firms may prequalify if they meet all the
prequalification requirements and any partner of J.V has requested/shall request
for the same and then his prequalification shall be subject to the written

3.4 Updating Prequalification Information

3.4.1 Bidders shall be required to update the financial, personnel and equipment
information used for prequalification at the time of submitting their bids, to
confirm their continued compliance with the qualification criteria and
verification of the information provided at the time of prequalification. A bid
shall be rejected if the Applicant's qualification thresholds are no longer met at
the time of bidding.

3.5 Other Factors

3.5.1 Only firms and JVs that have been prequalified under this procedure shall be
invited to bid. A qualified firm or a member of a qualified IV may participate
only in one bid for the contract. If a firm submits more than one bid, singly or

as a JV, all bids including that bidder will be rejected. This rule will not apply
in respect of bids which include specialist sub-contractors who are used by
more than one bidder.

3.5.2 The Employer reserves the right to:-

a) Amend the scope and value of any contract(s) to be bid, in which event
the bidder(s) will only bid among those prequalified bidders who meet the
requirements of the contract(s) as amended. However the Employer has to
review the disqualified bids who originally do not meet the specified
criteria for Pre-qualification.

b) Reject or accept any application; and

c) Cancel the prequalification process and reject all applications.

The Employer shall neither be liable for any such actions nor be under any
obligation to inform the Applicant of the grounds for rejection, however, may
be debriefed if solicited.

3.5.3 Applicants will be informed in writing by fax or mail within 30 days of the date
for submission of applications (para 8 of Chapter 2.0, Invitation for
Prequalification) of the result of their applications and may be debriefed if
solicited.

4.0 EVALUATION CRITERIA

Applicants meeting the rmrumum requirements mentioned in Para 3.2 and 3.3 besides other
factors shall be considered for pre-qualification. No compromise shall be made on minimum
requirements of 30% score in each category by the JV alongwith passing score of cumulative 60%
of the total.

Undertaking for LEED Gold Certification & Reduction in Net Emission
