A PROCLAMATION TO PROVIDE FOR THE

የ‫א‬ድ٪ኒُ ፈንድን እና የ‫א‬ድ٪ኒُ አቅ‫ץ‬ቦُ ESTABLISHMENT OF THE DRUG FUND AND THE
ኤጀን‫ת‬ን ֳ‫ והּהּד‬የወጣ አዋጅ PHARMACEUTICAL SUPPLY AGENCY

WHEREAS, as health is a pillar of securing proper life

ጤና ֳሕዝብ የ‫ـ‬ደֶደֳ ሕይወُና ‫דٍץו‬ነُ and productivity of the people and pharmaceuticals share a
‫ ُנטא‬በ‫ֲא‬ኑንና ‫א‬ድ٪ኒُ‫ ו‬በጤና አገָግֹُ vital role in the health service;
ውስጥ ወሳኝ ድ‫ ָךץ‬ያֳው በ‫ֲא‬ኑ፣

ֳጤና አገָግֹُ ከ‫אג‬ደበው ‫א‬ዋዕֳንዋይ WHEREAS, pharmaceuticals expenditure is much

ֳ‫א‬ድ٪ኒُ የ‫ג‬ውֳው ወጭ ከፍ‫ـ‬ኛ በ‫ֲא‬ኑ፣ significant as compared to other health service budget;

ጥ‫ٍْף‬ው የ‫נـ‬ጋገጠ ‫ٍנטא‬ዊ ‫א‬ድ٪ኔِ٤ን WHEREAS, it is necessary to supply quality assured

በ‫אـ‬ጣጣኝ ዋጋና ‫שׂ‬ጣይነُ ‫ֳוֹ‬ው ‫ָא‬ኩ essential pharmaceuticals at affordable prices in a
ֳ‫ـ‬ጠቃ‫ג‬ው ֱብ‫רـנ‬ብ ‫ד‬ቅ‫נ‬ብ አስፈֶጊ በ‫ֲא‬ኑ፣ sustainable manner to the public;

በ‫א‬ንግ‫ ُם‬የጤና ‫ ُדהּـ‬አስ‫דדـ‬ኝና WHEREAS, it is considered appropriate to design a

ዘֳቄٍ ያֳው የ‫א‬ድ٪ኒُ አቅ‫ץ‬ቦُ እንዲኖ‫ץ‬ system of mobilizing funds from different sources to
ֳ‫ד‬ስ٢ָ የ‫ג‬ያስፈָግ ገንዘብ ከ‫ֳـ‬ያዩ ‫ו‬ንጮ٤ ensure uninterrupted and sustainable supply of
pharmaceuticals to all public health facilities and
በ‫רוֹרד‬ብ ֱብ‫ שּרـנ‬ፍُሃዊ በֲነ ‫א‬ንገድ
thereby serve the public in an equitable manner;
‫ـ‬ጠቃ‫ ג‬የ‫ֲג‬ንበُን አ‫שׂא ץףט‬የስ ‫ـ‬ገ‫תּ‬
በ‫ֲא‬ኑ፣
NOW, THEREFORE, in accordance with Article
በኢُዮጵያ ፌዴ‫ֶף‬ዊ ዲ‫ז‬ክ‫תף‬ያዊ ‫ע‬ፐብֵክ 55 Sub-Articles (1) and (12) of the Constitution, it is

ክፍָ አንድ PART ONE

ጠቅֶֶ GENERAL

1. አጭ‫ץ ץ‬ዕስ 1. Short Title

ይֱ አዋጅ “የ‫א‬ድ٪ኒُ ፈንድን እና የ‫א‬ድ٪ This Proclamation may be cited as the “Drug Fund
and Pharmaceuticals Supply Agency Establishment
ኒُ አቅ‫ץ‬ቦُ ኤጀን‫גהּהּד ת‬ያ አዋጅ ‫שּׁ‬ጥ‫ץ‬
Proclamation No. 553/2007.”
5)$3/09)(9” ‫ـ‬ብֹ ֵጠ‫שׂ‬ስ ይ٤ֶָ፡፡
2. Definitions
2. ُ‫ץ‬ጓ‫ה‬
In this proclamation, unless the context otherwise
የቃִ አገ‫וֹ‬ብ ֶַ ُ‫ץ‬ጉ‫ ו‬የ‫ג‬ያ‫ר‬ጠው ካֲָነ requires:-
በስ‫ ץשׂـ‬በዚֱ አዋጅ ውስጥ፣

1/ “‫א‬ድ٪ኒُ” ‫ ֳُד‬በ‫ֹּٍל‬ን ֳ‫ץאץאא‬፣ 1/ “Pharmaceuticals” means any substance or

ֳ‫א‬ከֶከָ፣ ֳ‫ד‬ስٍገስ ወይ‫דֳ ו‬ከ‫ו‬ mixture of substances used in the diagnosis,
የ‫ג‬ያገֳግָ ‫ד‬ንኛው‫ ו‬ንጥ‫נ‬ነገ‫ ץ‬ወይ‫ו‬ treatment, mitigation or prevention of a disease,
የንጥ‫נ‬ነገ‫צ‬٤ ውֱድ ‫ֲת‬ን የሕክ‫ו‬ና and includes medical instruments and medical
‫א‬ገָገያዎ٤ንና የሕክ‫ו‬ና ‫עכא‬ያዎ٤ supplies;
ይጨ‫ָףו‬፣

2/ “የሕክ‫ו‬ና ‫א‬ገָገያ” ‫ֳُד‬ በ‫ֹּٍל‬ን 2/ “medical supplies” means any Article that may
ֳ‫ ץאץאא‬ወይ‫דֳ ו‬ከ‫ ו‬በውስጥ ወይ‫ו‬ be used on the inner or outer part of the human
body for diagnosis or treatment of disease, and
በውጭ የ‫ר‬ውነُ አካָ ጥቅ‫ֶ ו‬ይ የ‫ג‬ውָ
includes suturing materials, syringes, needles,
‫ד‬ንኛው‫א ו‬ገָገያ ‫ֲת‬ን፣ የ‫שּׁ‬ስָ ‫א‬ስፊያ
bandages, gauze, cotton and similar products,
ክ‫צ‬٤ን፣ ‫עת‬ንጆ٤ን፣ ‫ץא‬ፌዎ٤ን፣ ፋ‫ָך‬፣
chemicals and x-ray films;
ጐዝ፣ ጥጥና ‫ָרא‬ ዝግጅِ٤ን፣
ኬ‫ג‬ካֹ٤ንና ፊָ‫ז‬٤ን ይጨ‫ָףו‬፤
3/ “medical instrument” means any instrument
3/ “የሕክ‫ו‬ና ‫עכא‬ያ” ‫ֳُד‬ በ‫ֹּٍל‬ን that may be used on the inner or other part of
ֳ‫ ץאץאא‬ወይ‫דֳ ו‬ከ‫ ו‬በውስጥ ወይ‫ו‬ the human body for diagnosis or treatment of a
በውጭ የ‫ר‬ውነُ አካָ ጥቅ‫ֶ ו‬ይ የ‫ג‬ውָ disease, and includes various diagnostic,
‫ד‬ንኛው‫ו‬ ‫עכא‬ያ ‫ֲת‬ን የ‫ֳـ‬ያዩ laboratory, surgery and dental instruments:
የ‫עאץאא‬ያ፣ የֶቦ‫ץِף‬፣ የ‫שׂ‬ዶ ጥገናና
የጥ‫ץ‬ስ ሕክ‫ו‬ና ‫עכא‬ያዎ٤ን ይጨ‫ָףו‬፤

4/ “የ‫א‬ንግ‫ ُם‬የጤና ‫ ֳُד ”והּـ‬በፌዴ‫ָף‬ 4/ “public health institution” means a health service
ወይ‫ו‬ በክָָ ‫א‬ንግ‫ُם‬ ‫ֳוֹ‬ቤُነُ rendering institution owned by the Federal or a
የ‫ـג‬ዳደ‫ ץ‬የጤና አገָግֹُ የ‫רג‬ጥ ‫והּـ‬ Regional State;
ነው፤
5/ “regional state” means any state referred to in
5/ “ክָָ” ‫ֳُד‬ በኢُዮጵያ ፌዴ‫ֶף‬ዊ
Article 47(1) of the Constitution of the Federal
ዴ‫ז‬ክ‫תף‬ያዊ ‫ע‬ፐብֵክ ሕገ‫א‬ንግ‫ُם‬
Democratic Republic of Ethiopia, and includes
አን‫שׂ‬ጽ #7/1/ የ‫ـ‬ጠ‫רשׂ‬ው ‫ד‬ንኛው‫ ו‬ክָָ the Addis Ababa and Dire Dawa city
‫ֲת‬ን የአዲስ አበ‫וֹ‬ና የድ‫פ‬ዳዋ ከ‫דـ‬ administrations.
አስ‫ـ‬ዳደ‫צ‬٤ን‫ ו‬ይጨ‫ָףו‬፤
6/ “appropriate body” means a body responsible
6/ “አግ‫וֹ‬ብ ያֳው አካָ” ‫ ֳُד‬የጤና ‫ُדהּـ‬ን body to regulate the competency of health
ብቃُና የ‫א‬ድ٪ኒُን ደֱንነُ፣ ፈዋ‫ֹּל‬ነُና service institutions and pharmaceuticals safety,
ጥ‫נדֳ ُף‬ጋገጥ ‫ָם‬ጣን የ‫רـ‬ጠው አካָ efficacy and quality;

7/ “‫ג‬ኒስَ‫ ”ץ‬እና “‫ג‬ኒስُ‫ ֳُד ”ץ‬እንደቅ 7/ “Ministry” and “Minister” means the Ministry
ደ‫ـו‬ከ‫ ִـ‬የጤና ጥበቃ ‫ג‬ኒስَ‫ ץ‬እና and Minister of health, respectively.
‫ג‬ኒስُ‫ ץ‬ነው፤

ክፍָ ሁֳُ PART TWO

የ‫א‬ድ٪ኒُ ፈንድ DRUG FUND

3. Establishment
3. ‫והּהּא‬

የ‫א‬ድ٪ኒُ ፈንድ /ከዚֱ በኋֶ “ፈንድ” እየ‫ـ‬ The Drug Fund (hereinafter referred as the
‫ ֳוֹ‬የ‫ג‬ጠ‫ף‬/ በዚֱ አዋጅ ‫ָחשּׁהּـ‬፡፡ “Fund”) is hereby established.

4. የፈንዱ ‫ו‬ንጮ٤ 4. Sources of the Fund

ፈንዱ የ‫ג‬ከ‫ו ִُـ‬ንጮ٤ ይኖ‫ָٍס‬፣ The Fund shall have the following sources.

1/ በዚֱ አዋጅ ‫ ُנטא‬ከ‫א‬ድ٪ኒُ አቅ‫ץ‬ቦُ 1/ net income generated from the supply of
ከ‫ג‬ገኝ የ‫ـ‬ጣ‫ ף‬ገ‫תּ‬፣ pharmaceuticals pursuant to this Proclamation;

2/ ከ‫א‬ንግ‫ ُם‬በዓይነُ ወይ‫ו‬ በገንዘብ 2/ resources allocated by the Government in kind

የ‫רג‬ጥ ድጋፍ፤ እና or in cash; and

3/ ከֳጋ‫ ֹּל‬አካֶُ በዓይነُ ወይ‫ ו‬በገንዘብ

የ‫רג‬ጥ እ‫ץ‬ዳٍ፡፡ 3/ grants in kind or in cash from donor agencies.

5. የፈንዱ አጠቃ‫ושׂ‬
5. Utilization of the Fund
ፈንዱ የ‫ד ףם‬ስኬጃ ወጪዎ٤ን እንዲ₪ፍን
The Fund shall, after covering all overhead costs,
ከ‫ـ‬ደ‫נ‬ገ በኋֶ ‫ָאـ‬ሶ በ‫ד‬ዟዟ‫אֳ ץ‬ድ٪ኒُ
in turn expend for the procurement of
ግ™ እና ֳ‫א‬ድ٪ኒُ አገָግֹُ ‫ד‬ስፋፊያና pharmaceuticals and the expansion and
‫ד‬ጠናከ‫ע‬ያ እንዲውָ ይደ‫נ‬ጋָ፡፡ strengthening of pharmaceutical services.

የ‫א‬ድ٪ኒُ አቅ‫ תּף‬ኤጀን‫ת‬ PART THREE
THE PHARMCEUTICALS SUPPLY AGENCY
6. ‫והּהּא‬
6. Establishment
1/ የ‫א‬ድ٪ኒُ አቅ‫ תּף‬ኤጀን‫ ת‬/ከዚֱ በኋֶ
“ኤጀን‫ ”ת‬እየ‫ ֳוֹـ‬የ‫ג‬ጠ‫ף‬/ የֱግ ‫ר‬ውነُ 1/ The Pharmaceutical Supply Agency (hereinafter
ያֳው ‫שף‬ን የ٢ֳ የፌዴ‫א ָף‬ንግ‫ُם‬ referred as “the Agency”) is hereby established
‫עםא‬ያ ቤُ ֲኖ በዚֱ አዋጅ ‫ָחשּׁהּـ‬፡፡ as an autonomous federal organ having its own
legal personality;
2/ ኤጀን‫ת‬ው ‫ـ‬ጠ‫ע‬ነً ֳ‫ג‬ኒስَ‫ ס‬ይֲናָ፡፡
2/ The Agency shall be accountable to the Ministry.
7. ዋና ‫עםא‬ያ ቤُ
7/ Head Office
የኤጀን‫ת‬ው ዋና ‫עםא‬ያ ቤُ በአዲስ አበ‫ֲ וֹ‬ኖ፣ The Agency shall have its head office in Addis
እንደአስፈֶጊነً በ‫ד‬ናْው‫ם ו‬ፍ‫ ף‬ቅ‫ץ‬ንጫ Ababa and may have branch offices elsewhere as
ፎ٤ ֵኖ‫ ُס‬ይ٤ֶָ፡፡ may be necessary.

8. ዓֶ‫ד‬ 8/ Objectives of the Agency

ኤጀን‫ת‬ው የ‫ג‬ከ‫ ִُـ‬ዓֶ‫ד‬ዎ٤ ይኖ‫ָٍס‬፣ The Agency shall have the following objectives:-

1/ የ‫א‬ንግ‫ ُם‬ጤና ‫ ُדהּـ‬ጥ‫ٍْף‬ው የ‫נـ‬ 1/ to enable public health institutions to supply

ጋገጠ ‫ٍנטא‬ዊ ‫א‬ድ٪ኒِ٤ን quality assured essential pharmaceuticals at
በ‫אـ‬ጣጣኝ ዋጋ ‫שׂ‬ጣይነُ ‫ֳוֹ‬ው ‫ָא‬ኩ affordable prices in a sustainable manner to the
ֳ‫ـ‬ጠቃ‫ג‬ው ሕብ‫רـנ‬ብ እንዲያ‫שּץשׂ‬ public;
የ‫ד‬ስ٢ָ፣
2/ to play a complementary role in developmental
2/ የ‫א‬ድ٪ኒُ አቅ‫ץ‬ቦًን በ‫ד‬ጠናከ‫ץ‬ና
efforts for health service expansion and
ዘֳቄٍ ዊነًን በ‫נד‬ጋገጥ የጤና
strengthening by ensuring enhanced and
አገֳግֹًን ֳ‫ד‬ስ ፋፋُና ֳ‫ד‬ጠናከ‫ץ‬ sustainable supply of pharmaceuticals:
በ‫ג‬ደ‫נ‬ገው የָ‫ ُד‬እንቅስቃሴ አስ‫ـ‬ዋጽኦ
የ‫ד‬ድ‫נ‬ግ፣
3/ to create enabling conditions for enhancing the
3/ ፈንዱ ወጪውን እንዲ₪ፍን ከ‫ـ‬ደ‫נ‬ገ በኋֶ accumulation of the Fund in its revolving and
‫ָאـ‬ሶ በ‫ד‬ዟዟ‫ ץ‬እ‫שף‬ን በ‫ד‬ሳደግ በዚֱ cost recovery process and thereby ensure the
አን‫שׂ‬ጽ ንዑስ አን‫שׂ‬ጽ /1/ እና /2/ የ‫ـ‬ጠ‫שׂ‬ realization of the objectives referred to in Sub-
‫ُש‬ን ዓֶ‫ד‬ዎ٤ እውን ֳ‫ד‬ድ‫נ‬ግ Articles (1) and (2) of this Article.
ሁኔٍዎ٤ን የ‫אד‬٢ُْ፡፡

9. የኤጀን‫ת‬ው ‫ָם‬ጣንና ‫ـ‬ግ‫ץוֹ‬ 9. Powers and Duties of the Agency

ኤጀን‫ת‬ው የ‫ג‬ከ‫ָם ִُـ‬ጣንና ‫ـ‬ግ‫ُףוֹ‬ The Agency shall have the powers and duties to:
ይኖ‫ָٍס‬፣

1/ በ‫א‬ድ٪ኒُ ፈንድ በ‫א‬ጠ‫ ושׂ‬በሀገ‫ ًע‬ዋና ዋና

የጤና ٤ግ‫צ‬٤ ֶይ ያ‫ـ‬ኮ‫ ס‬ጥ‫ٍْף‬ው 1/ establish and implement efficient and effective
የ‫נـ‬ጋገጠ ‫ٍנטא‬ዊ ‫א‬ድ٪ኒِ٤ን በበ‫שּׂ‬ procurement and distribution systems to
‫א‬ጠን፣ በ‫אـ‬ጣጣኝ ዋጋና ‫שׂ‬ጣይነُ ‫ֳוֹ‬ው deliver, by using the Drug Fund and focusing
‫ָא‬ኩ ֳ‫א‬ንግ‫ٍם‬ዊ የጤና አገָግֹُ on the country’s major health problems,
‫ד ُדהּـ‬ቅ‫נ‬ብ የ‫ג‬ያስ٤ָ ‫ָשׂ‬ጣፋና ብቃُ quality assured pharmaceuticals at affordable
ያֳው የግ™ና የስ‫ץ‬ጭُ ‫ץם‬ዓُ ይዘ‫נ‬ጋָ፣ prices sustainably to public health
ይ‫ـ‬ገብ‫ָף‬፣ institutions.

2/ ዘ‫א‬ናዊ የክ‫ו‬٤ُ አስ‫ـ‬ዳደ‫דֳ ץ‬ስፈን 2/ provide adequate and proper pharmaceutical

የ‫ג‬ያስ٤ָ አ‫ ץףר‬በ‫א‬ዘ‫ץ‬ጋُ ‫אـ‬ጣጣ storage facilities to ensure uninterrupted
ኝና ‫ـ‬ገ‫ תּ‬የ‫א‬ድ٪ኒُ ክ‫ו‬٤ُና ያָ‫הּـ‬ supply through establishing a modern storage
‫נ‬ጠ አቅ‫ץ‬ቦُ እንዲኖ‫ ץ‬ያደ‫ץ‬ጋָ፣ management system;

3/ የክ‫ו‬٤ُና የ‫ץם‬ጭُ አውٍ‫צ‬٤ን ፍُ٪ 3/ expand and strengthen storage and distribution
outlets based on equity and effectiveness;
ዊና ውጤٍ‫ ד‬በֲነ ‫ָא‬ኩ ያስፋፋָ፣
ያጠናክ‫ָף‬፤
4/ supply essential pharmaceutical of quality,
4/ አግ‫וֹ‬ብ ‫ֳוֹ‬ው አካָ ደֱንነٍْው፣ ፈዋ‫ֹּל‬ነ safety and efficacy approved by the
ٍْውና ጥ‫ٍْף‬ው የ‫נـ‬ጋገጠ ‫א‬ድ٪ appropriate body to all public health
ኒِ٤ን ֳ‫א‬ንግ‫ ُם‬የጤና ‫ ُדהּـ‬ያ‫ץשׂ‬ institutions; where appropriate and in
‫ָוֹ‬፣ አግ‫וֹ‬ብ ֲኖ ‫ת‬ገኝ በበ‫א שּׂ‬ጠን ֵ‫שׂ‬ accordance with directives of the Board,
‫ שּץ‬ያָ٢ִ የ‫נאـ‬ጡ ‫א‬ድ٪ኒِ٤ን supply to private and non governmental
ቦ‫ץ‬ዱ በ‫ג‬ያወጣው ‫עאא‬ያ ‫א ُנטא‬ን health institutions selected pharmaceuticals
ግ‫ٍם‬ዊ ֲֶָነና ֳግָ የጤና ‫ُדבּـ‬ which are not adequately available;
ያ‫ָוֹץשׂ‬፤

5/ የ‫ד‬ጓጓዣ ‫ץם‬ዓُን በ‫אד‬٢٢ُ ‫א‬ድ٪ኒ 5/ deliver pharmaceutical directly to districts,

ِ٤ን በ‫שׂ‬ጥٍ ֳወ‫נ‬ዳዎ٤ ֲስፒֹٍ٤ና hospitals and selected health centers through
እንደአ‫א‬١ነً ֳጤና ጣ‫תּ‬ያዎ٤ ያደ‫ץ‬ሳָ፤ establishing an effective transport network
system;

6/ በዘ‫ץ‬ፉ ከ‫ג‬ዘ‫נ‬ጋው ስ‫ץ‬ዓُ ጋ‫ ץ‬የ‫ג‬ጣጣ‫ו‬ 6/ establish a logistics management information

ዘ‫א‬ናዊ የֹጂስٌክስ ‫נא‬ጃ ָውውጥ system compatible with the overall
ስ‫ץ‬ዓُ ይዘ‫נ‬ጋָ፤ pharmaceuticals logistics system;

7/ የአጭ‫ץ‬፣ የ‫א‬ካከֳኛና የ‫נ‬ጅ‫ ו‬ጊዜ የግ™፣ 7/ prepare and implement short, medium and
የስ‫ץ‬ጭُ፣ የ‫ד‬ከ‫ُْד‬ና የ‫ד‬ጓጓዝ ዕቅድ long-term plan for procurement, storage and
በ‫ד‬ዘጋጀُ ይ‫ـ‬ገብ‫ָף‬፣ አፈፃፀ‫ב‬ን‫ו‬ distribution, and monitor its implementation;
ይገ‫א‬ግ‫ָד‬፣

Agency;
2/ examine and approve the Agency’s strategies
and implementation guidelines and monitor
and supervise their implementation;
3/ approve and ensure the implementation of the
annual work plan and budget of the Agency;
4/ approve and monitor the implementation of
collection and disbursement procedures of
the Drug Fund;
5/ approve and monitor the implementation of
pharmaceutical procurement, storage and
distribution manuals;
6/ decide on the amount and payment schedule
of bank loans to be taken by the Agency;
7/ approve the recruitment, placement and
termination of services of officials
accountable to the Directors of the Agency;
8/ approve the annual financial reports of the
Agency; appoint external auditors; ensure
that adequate measures are taken in
accordance with audit reports, and ensure that
the audit reports are made public;
9/ decide on disposal of fixed assets and
accounts to be written off;
10/ Where it finds it necessary, establish advisory
committees, guide and coordinate their
activities;
11/ decide on the rate of service charges to be

13. Meeting of the Board
1/ The Board shall meet once every three
months; provided, however, that
extraordinary meetings of the Board may be
held at any time at the call of the chairperson;

04. የዋና ዳይ‫פ‬ክ‫ָם סـ‬ጣንና ‫ـ‬ግ‫ץוֹ‬ 14. Powers and Duties of the Director General
1/ የቦ‫ץ‬ዱ አጠቃֶይ አ‫ ץףא‬እንደ‫ـ‬ጠበ‫שׂ‬ 1/ The Director General shall be the chief
ֲኖ ዋና ዳይ‫פ‬ክ‫ סـ‬የኤጀን‫ת‬ው ዋና ‫ףם‬ executive officer of the Agency and shall,
አስፈጻ‫ ג‬በ‫ֲא‬ን የኤጀን‫ת‬ውን ‫ףם‬ዎ٤ subject to the overall guidance of the Board,
ይ‫ָףא‬፣ ያስ‫ـ‬ዳድ‫ָף‬፡፡ direct and administer the activities of the
Agency.
2/ የዚֱ አን‫שׂ‬ጽ ንዑስ አን‫שׂ‬ጽ /1/ አጠቃֶይ
አነጋገ‫ץ‬ እንደ‫ـ‬ጠበ‫שׂ‬ ֲኖ ዋና 2/ Without limiting the generality of Sub-Article
ዳይ‫פ‬ክ‫סـ‬፣ (1) of this Article the Director General shall:

ሀ/ በዚֱ አዋጅ አን‫שׂ‬ጽ 9 የ‫ֳאـ‬ከًُን a) exercise the powers and duties of the

c) prepare and submit to the Board the

‫א‬/ የኤጀን‫ת‬ውን ሂ‫כ‬ቦ٤ በአግ‫שּוֹ‬ d) keep the Agency’s books of accounts,

እንዲያዝ ያደ‫ץ‬ጋָ የ‫וֹ‬ንክ ሂ‫כ‬ብ open and operate bank accounts;
ይከፍָٍ፣ ያን‫שׂ‬ሳቅሳָ፤

‫ט‬/ ኤጀን‫ת‬ው ከሶስ‫ـ‬ኛ ወገኖ٤ ጋ‫ץ‬ e) represent the Agency in all its dealings
በ‫ג‬ያደ‫ץ‬ጋْው ግንኙነِ٤ ሁִ with third parties;

f) submit reports to the Board on the

15. Modalities of Procurement of Pharmaceuticals

05. የ‫א‬ድ٪ኒُ ግዢና የአገָግֹُ ክፍያ አፈፃፀ‫ו‬
and Payment of Service Fees
‫ץם‬ዓُ

1/ አጠቃֶይ የ‫א‬ንግ‫ ُם‬ግዢ ‫ֲץא‬ዎ٤ 1/ The Agency shall, without prejudice to the

2/ ‫א‬ንግ‫ٍם‬ዊ የጤና ‫ ُדהּـ‬በ‫ִב‬ 2/ Public health institutions shall place orders

የ‫ٍנטא‬ዊ ‫א‬ድ٪ኒِ٤ አቅ‫ץ‬ቦُ only to the Agency for the supply of essential
ፍֶጐٍْውን በ‫שׂ‬ጥٍ ֳኤጀን‫ת‬ው ብ٢ pharmaceuticals; the Agency shall, in case of
ጥያቄ በ‫ד‬ቅ‫נ‬ብ ይገֳገִֶ፡፡ ኤጀን‫ת‬ው failure to supply the pharmaceuticals, advice
የ‫ـ‬ጠ‫ُששׂ‬ን ‫א‬ድ٪ኒِ٤ ֳ‫ד‬ቅ‫נ‬ብ the institutions of the best alternatives
በ‫ד‬ይ٤ָበُ ወቅُ ֳጠያ‫שּׂ‬ዎ٤ ‫ـ‬ገ‫תּ‬ውን thereof. Detailed particulars shall be
አ‫ףד‬ጭ ‫א‬ፍُሔ ይ‫ר‬ጣָ፡፡ ዝ‫ץ‬ዝ‫ץ‬ determined by directives.
አፈፃፀ‫ ב‬በ‫עאא‬ያ ይወ‫ר‬ናָ፡፡
3/ Government health institutions and other
3/ የ‫ٍנטא‬ዊ ‫א‬ድ٪ኒِ٤ አቅ‫ץ‬ቦُና አገָ bodies delivered with essential
ግֹُ የ‫רـ‬ጣْው ‫א‬ንግ‫ٍם‬ዊ የጤና ‫ُד הּـ‬ pharmaceuticals shall be responsible to effect

ֳኤጀን‫ת‬ው ‫ـ‬ገ‫תּ‬ውን ክፍያ ይፈጽ‫ִד‬፡፡ hereunder.

06. በጀُና የ٪ֶፊነُ ‫א‬ጠን 16. Budget and Extent of Liability

1/ የኤጀን‫ת‬ው በጀُ በዚֱ አዋጅ አን‫שׂ‬ጽ 1/ The budget of the Agency shall be covered by

በዕዳ ‫ـ‬ጠያ‫ שּׂ‬አይֲን‫ו‬፡፡ 2/ The Agency may not be held liable beyond its
total assets.
07. የ‫וֹ‬ንክ ሂ‫כ‬ብ
17. Bank Accounts
በዚֱ አዋጅ አን‫שׂ‬ጽ 4 የ‫ـ‬ጠ‫רשׂ‬ው ገንዘብ
The financial contributions referred to in Article 4
በኤጀን‫ת‬ው ስ‫ ו‬በ‫ـ‬ከፈ‫ ـ‬የ‫וֹ‬ንክ ሂ‫כ‬ብ of this Proclamation shall be deposited in a bank
‫דשׂـ‬ጭ ይֲናָ፡፡ accounts opened in the name of the Agency.

08. ስֳክፍያዎ٤ 18. Disbursement

ከ‫א‬ድ٪ኒُ ፈንድ ገንዘብ ወጪ ֲኖ የ‫ג‬ከ Disbursement of the Drug Fund shall only be

ኤጀን‫ת‬ው የ‫א‬ድ٪ኒُ ፈንዱን የ‫ִחـ‬ና The Agency shall keep complete and accurate

የኤጀን‫ת‬ው የሂ‫כ‬ብ ‫א‬ዛግብُና ገንዘብ ነክ The books of accounts and other financial
‫ר‬ነዶ٤ በየዓ‫ًא‬ በውጪ ኦዲ‫צـ‬٤ documents of the Agency shall be audited
ይ‫ִףאנא‬፡፡ በኦዲ‫ ץـ‬የ‫ סאנאـ‬የሂ‫כ‬ብ annually by external auditors. Audited financial
‫א‬ግֳጫዎ٤ የበጀُ ዓ‫ שֳׂוֹ ًא‬በአ‫ُף‬ reports shall be submitted to the Board within
four months following the end of the budget year.

አስ‫א‬ጪና ጅ‫ ֶו‬አከፋፋይ አክስዮን ‫٭א‬በ‫ץ‬ and Medical Supplies Import and Wholesale
‫א‬ብُና ግዴٍዎ٤ በዚֱ አዋጅ ֳኤጀን‫ת‬ው Share Company are herby transferred to the
‫ֶָـ‬ፈዋָ፡፡ Agency.

!2. ደንብና ‫עאא‬ያ የ‫ד‬ውጣُ ‫ָם‬ጣን 22. Powers to Issue Regulations and Directives

1/ የ‫ג‬ኒስُ‫צ‬٤ ‫ו‬ክ‫ ץ‬ቤُ ይֱን አዋጅ 1/ The Council of Ministers may issue regulations
ֳ‫ד‬ስፈጸ‫ ו‬የ‫ג‬ያስፈָጉ ደንቦ٤ን ֵያ necessary for the proper implementation of

ይֱን አዋጅ የ‫ג‬ቃ‫נ‬ን ‫ד‬ናْው‫ֱ ו‬ግ፣ ደንብ፣ No law, regulations, directives or practice shall, in so
‫עאא‬ያ ወይ‫ ו‬የአ‫וָ ץףט‬ድ በዚֱ አዋጅ far as they are inconsistent with this Proclamation, be
በ‫ـ‬₪ፈኑ ጉዳዮ٤ ֶይ ‫ـ‬ፈጻ‫ג‬ነُ አይኖ‫נ‬ው‫ו‬፡፡ applicable with respect to matters provided for in this
Proclamation.

24. Effective Date
ይֱ አዋጅ በፌዴ‫ ָף‬ነጋ‫ ُע‬ጋዜጣ ٍُ‫ז‬
This Proclamation shall come into force up on
