Brief Facts of the Case regarding affiliation of State Institute of Advanced Studies in

Teacher Education (SIATE) Gurugram at DIET, Gurugram to run course B.A. B.Ed/B.Sc.
B.Ed. w.e.f. 2021-22

1. Proposal was received on dated 28-06-2021 from Director, SIASTE


for affiliation for opening of the new college and to start B.Sc.
B.Ed./B.A.B.Ed. four year integrated program under SIASTE in the
campus of DIET Gurugram w.e.f. 2021-22. Accordingly, first reply of
the deficiencies was communicated to SIASTE vide this office letter
No.GUG/CB/2021/1543 dated 09-07-2021 (Copy Attached)

2 Proposal was submitted again by the SIASTE on dated 13-08-2021


and 17-08-2021 but reply of deficiencies was again communicated to
SIASTE (vide this office letter No.GUG/CB/2021/1845 dated 27-08-
2021) with a direction to resubmit the proposal with prescribed fees
and NOC of the Govt. which is mandatory as per provisions of
the Statute-39 of the University Act (copy Attached)

3 In the meanwhile DGHE vide letter dated 11-10-2021 has convey the
decision of the State Govt. to start B.Sc. B.Ed./B.A. B.Ed. course
w.e.f. 2021-22 in premises of DIET, Gurugram under SIASTE, Jhajjar
under the aegis of DGHE Haryana. Moreover, they communicated
that Fresh approval/up-gradation of existing D.El.Ed. course in these
two DIETs is awaited from NCTE and for that Vice-Chancellor,
Gurugram University will grant provisional affiliation to this institutes
from the session 2021-22 (copy Attached). On the perusal of this
letter and various other enclosures attached by the college (along with
prescribed fees) the matter was referred to Legal Advisor with a query
that whether office may accept proposal and process the application
without having NOC of the regulatory body in compliance of
directions of DGHE or not?

4 LA has advised that University can entertain the application


provisionally with clear stipulation that in case during completion of
process of provisional affiliation, if no NOC is received, they would
have no right of affiliation for the session 2021-22. Thereafter,
worthy Vice-Chancellor has considered the application and constituted
the inspection committee vide letter no.GUG/CB/ 2021/2242 dated
21-10-2021 (Copy Attached)
5 Inspection Report was put up before the worthy Vice-Chancellor and
in exercising his powers he has granted provisional affiliation in
anticipation approval of the AC/EC and Provisional Affiliation letter
was issued to SIASTE subject to approval of said bifurcation by the
regulatory body NCTE vide office letter No.GUG/CB/2021/2283
dated 12-11-2021 (Copy Attached).

6 Further, agenda item for AC and EC vide letter no.


GUG/CB/2021/2563 dated 23-11-2021 was forwarded to the academic
branch to place the matter before AC/EC.

7 In the meanwhile, reminder for submission of NCTE approval was


issued to SIASTE vide letter no.GUG/CB/2022/2880 dated 25-01-
2022.
8 The matter was placed before the Academic Council in the meeting on
24-01-22 with a resolution that the item may be brought in the next
meeting of AC along with status of NCTE approval and accordingly,
letter was again issued to the college with a direction to submit
NCTE approval to the University vide letter No.GUG/CB/ 2022/3018
dated 23-02-2022 and GUG/CB-CD/2022 /788 dated 21-06-2022
(Copy Attached).

9 Further, Inspection Committee was constituted for grant of extension


in the 2nd year and continuation in the 1st year and reminder was also
issued to the college for deposition of NCTE approval vide letter
No.GUG/CB-CD/2022/800 dated 21-06-2022.

10 In the meanwhile complaint of Sh. Sandeep was received in the


University and the same was forwarded to the college for
clarifications/comments with a final warning to deposit NCTE
approval vide letter No.GUG/CB-CD/2022/888 dated 30-06-2022.
Reply of the college in response to the complaint of Sh. Sandeep
(vide letter no.2022/GGM/102-103 dated 05-08-2022) was put up
before the Vice-Chancellor and matter of non-submission of the
NCTE approval was referred to the AC/EC. In the meanwhile, on
receipt of legal notice of Adv. Dharmender Kumar and non-
compliance of submission of NCTE approval, the college was directed
no to admit students for academic session 2022-23
(GUG.CB-CD/2022/1663 dated 07-09-2022).

11 Inspection Report for extension/continuation for the session 2022-23


was accepted by the inspection board but the letter for
extension/continuation was put up on-hold and as per decision of the
competent authority the matter was referred to the Executive Council
for decision (agenda vide letter no.GUG/CB/2022/4231 dated 11-10-
2022).
12 The matter was considered by the EC in its meeting dated 14-10-2022
and council resolve to issue show cause notice to the institute and
accordingly, show cause notice to the institute was issued by the
University vide office letter No.GUG/CB-CD/2022/2170 dated 03-11-
2022 along with direction to Registration Branch for not accepting
RR/CR till the deposition of NCTE approval. The college has
submitted the reply of the show cause notice (letter
no.2022/GGM/152-55) and the matter was again referred to the EC
(Copy Attached).

13 In the meanwhile, the students was allowed provisionally by the


University authority to appear in the examination and college was
directed not to admit students for the session 2023-24 without NCTE
approval (letter no.GUG/CB-CD/2023/1588 dated 03-08-2023).

14 The reply of the show cause notice was considered I the meeting of
EC on 05-09-2023 and EC resolved to constitute the committee
comprising of the following to examine the issues and recommended
suitable course of action:
(a) DCDC, Maharshi Dayanand University Rohtak
(b) DOC, Kurukshetra University Kurukshetra
(c) One Professor of Education, Preferably from NCTE (Serving or
retired).
