Atapproximately3:59 PM,Officersinfully markedMadison PoliceDepartmentpateolvehicles
locatedtheebove-mentioned PontiaoGrandPrixintheparkinglotdriveabyHoek,whowasthe
soleoccupant.OneofthePatrolvehicleswas behindthePontiacandactivateditsemergency
lightsandsirentoconduct atrafficstopwithth vehicle.Thevehiclecontinuedaroundthegas.
stationfilingtostop.Theotherparol vkiclespresentintheparkinglotalsohad their
emergencylightsactivatedattempting 0 topthevehicle. Hoekstoppedthevehicleforaperiod |
ofapproximately 10secondsandwesgive verbalcommandsby aMadisonPoliceDepartment |
Officertoshutthevehicleoffandexit bevehicle.Duringthisinteraction,theoffioervasin 1
closeproximity eadthediversidewindowofthevehicle isobservedbeingdown. Hoekthen
fdthoparking lotat a highrateofspeedandtraveledeaston SDHighway34fromMadison
foward129. ThisallisobservedonmultiplerecordedcamerasproducedbyMadisonPolice
Department.
Officerspursuedthevehiclewiththeir emergencyred andbluslightsandsireusactivated
attemptingtostop thevehicle. Officersobserved the vehicletravelingattimesup to 115 MPH,
forcingoncomingtraffictotheshoulder,andpassingvehicleson th rightsidewhiledrivingon
SDHwy34. During thistime,MoodyCountyChiefDeputySherifKeanethProrokinformed
‘pursuingofficersthatbe waspositionedonSDHivy 34near 472% Avenueandpositionedto
deployatiedeflationdevicein &netempttocontainthe fleeingvehicle.

Officers romtheMadison PoliceDepertmeatarrivedatthe locationatapproximately4:10PM
andreportedthecrash,attemptedtorenderaid andsecuredthescene.DepuryProrokwas
declareddeceasedonscene.HoekwasdefinedandmedicallycheckedsttheMadisonHospital
1(SDDCISpecialAgent JeffreyT.Kollars)wasrequestedtoinvestigateandarrivedatthe
location ofthecash atspproximately 5PM.Whea Lerived, I observedChiefDeputyProrok
deceasedintheroadwayon SD Highway34near 472° AvenuewhichisinMoodyCounty,
SouthDakota.ThePontiacGrandPrixwasintheSouthditch ithapparentreddish-brown
stainingonthewindshieldanddemagetothefrontend. Twas advisedby lawenforcementon
scene thatthe HoekwasbeingmedicallycheckedattheMadisonHospitalandnotsuspectedto
baveanyinjuries.Outsideofthevebicleonthegroundwasenwiopenedbottleofliquoreadan.

‘ThePontissGrandPrix wassecuredandlaterprocessedpursuantto asearchwaraatbySpecial
‘AgentswiththeDCIandduringthasearchofth interiorseveralcontainersofcoldmedicine
pillcontainerswereJocatedwithinthevehicle. AlsowithinthovehicleweresuspectedTHC
vapes,miscellaneoussuspectedmarijuanaperephemeliaandbluns.
Ina laterinterviewthat conductedwithHock afterbeingmedicallyclearedandadvisedofhis
Miranda Warningendwaivinghisrights,Hoekadvisedthatbehadbeen atthebusinessthat
generatedthecall forservioe10the MedisonPoliceDepartment,Hestatedthatthereporting
‘perty owedhimmoneyandhewastheretocollect.
‘Whenaskedeboutdruguse,Hoekstatedthethehedused “Narcopacs”sparinglythatincluded
hydrocodoneandTylenolthat hohad soughtfrommultipleERvisits orpaininbisribs,hips,
aad legs.Hestatedtaahewasdeniedthepain medications ththedesiredfrommanydoctors,
endtheytoldhimtotekeTylenolforthe pain.Hestatedtha hehadspentthousandsofdollarson
‘medicationsandthathehadgonebankruptbecauseofthis.Heexpressedfrustuationswiththe
doctorsand medical staffthatdon'tlistento himorgivehimwhathewants/ncedsandthathe is
justlookingforhelpwith thepein.
Hoekspokeaboutbeing kicked out ofseveral reliveshousesfordisputesoverseveralmonths.
butdidnotspecifywha thedisputeswereabout.
Hoekstatedthathehad acollegeeducationandweshighlyemployable,Hestated thathehad
‘oem 0soveralmentalhealthprofessionalsandhadnotbeendiagaosedwithanymentalhealth
seateddiagnoses.Hedidtatethathehad anxietyissuesandsuffecedfrompani sitacksthat he
‘wouldsimply “culupin ball”andnotrememberwhet happened. He statedthathehadbeen
‘prescribedXanaxbutwas notabletospecifythe lastdoseaudreportedthathelostit.Hespoke
abouthismedialmarijuanaprescriptionthatbsusedtotreathisaoxiety.Hestated that he had.
