CONTENT: -

INTRODUCTION: -

We had a summer vacation in May and I have joined in firm for the purpose of the Internship in
high court and City Civil Court for Criminal and civil matters from April 15, 2023 to June 10,
2023. It was great experience of high court and lower courts. In criminal matters we have seen cases
of theft, theft of electricity, forgery, fraud, negotiable instrument and many more and for civil
matters we have seen land related cases, breach of contract as well as bankruptcy cases. It was
great experience as it gave me the real picture of the advocacy, got to know a lot of new tips for
smooth proceedings.

I used to go to the Court at 10:45am to 2:00pm and after that I used to go to my advocate’s office
till 8:00pm. In the court I used to go with my advocate for the hearing and in different judges’
courts, & used to listen to the arguments provided by my advocate. After completing the board I
used to go to the office, there I go through the case files of the whose arguments I have heard in
the court. I would like to discuss about it in detail in this report.

ABOUT THE FIRM AND PRACTISING ADVOCATE: -

Advocate Janak Rajpurohit is a practicing advocate at Gujarat high court and City Civil and
Sessions Court, Bhadra, Ahmedabad. he is a civil lawyer and also did various arbitration. He
prefers to take cases related to back rent, unpaid personal loans, divorce, bankruptcy and land
related matters.

He is also an arbitrator. he has an experience in civil cases for more than 7 years. He also appears
in many high-profile cases. He has a skillful hand in Civil Cases.

ANALYSIS: -

I have analyzed that theoretical world of law is far more different than the practical world of law.
I have analyzed that how to deal with the clients, how to talk or console with them, how to convince
them for anything, how to make them understand the status of their case. I have also learned that
about the court mannerism and etiquettes. I analyzed that how to deal with judges and other
advocate, how to deal with the issues, how to behave or talk to the clients and colleagues and other
advocates.

I have also analyzed that if you don’t know the law, but must know the procedure, if you don’t
know the sections, you must know that how to put up the arguments.

LEARNING OF THE INTERNSHIP: -
This internship has taught me a lot and has provided a lot of knowledge about Indian legislation,
such as important sections of NI Act, Gujarat tenancy and agricultural lands act, CPC, Evidence
Act, etc. In these laws I have learnt few most important orders like order 7 rule 11, order 37 of
CPC, section 14 of SARFAESI Act & section 138 of Negotiable instruments act Furthermore,
section 13(B) od Hindu marriage act

In procedural laws like CPC, I have learnt about various orders which are very important in litigation

I have learnt the procedure of civil matters and how the cases and plaint are filed in the court of law.

I have also learnt how to write the exemption, Pursis, adjournment,and petition and etc. I have also
observed how the proceedings of the cases are taken place. Like how the high court works and
Sessions trial, warrant trial summary trial etc. are being conducted. I have seen the argument
presented by both advocates of both the sides, I have also seen the examination in chief, cross
examination, examination of witnesses and cross examination of witnesses. Most importantly I
have learnt a lot of new terminology in Guajarati as well as in English which an advocate has to
use it in their routine. I have learnt many more things which were important for one to know before
entering to the practical world.

CONCLUSION: -

Overall, it was the great experience. I have learnt a lot of new things which I would not be able to
learn in a close class room. These things were as important to know as law, as this makes a small
difference in daily life while practicing in courts. Personally, what I have noticed majorly was that
theoretical world is not sufficient for one to be an advocate, I have noticed that practical world is
totally different from the theoretical world that’s why it is important for one to have an experience
of practical world also.
