MEMORANDUM OF AGREEMENT

This Memorandum of Agreement (the “Agreement”) is made and entered into


this __________________ in _____________________, by and among:

The CITY GOVERNMENT OF PASIG with office address at


________________________________, duly represented by its
_________________________ through Resolution/Ordinance No.
________________, 1 hereinafter referred to as the “FIRST PARTY”.

-and-

The Department of Education Division of ____________ with office


address at ________________________ duly represented by its
______________________, hereinafter referred to as the “SECOND
PARTY”.

The FIRST PARTY and SECOND PARTY are hereinafter referred to as such as
a “Party” and collectively as the “Parties”, as the case may be.

RECITALS:

WHEREAS, in consistent with the Constitutional provision on Education


under Article XIV, Section 1 which provides that the state shall protect and promote
the right of all citizens to quality education at all levels, and shall take appropriate
steps to make such education accessible to all;

WHEREAS, the FIRST PARTY, in order to provide better shelters to its people,
relocated numbers of families to SV 10, Eastshine & Hauzville Residences in Tanay,
Rizal on April 19, 2023 pursuant to its socialized housing program. Aside from new
homes, the FIRST PARTY uphold the constitutional mandate to protect and promote
the right to quality education of the children who were affected by the relocation by
providing teachers and other assistance for their benefit;

WHEREAS, the SECOND PARTY formulates, implements, and coordinated


policies, plans, programs and projects in the areas of formal and non-formal basic
education. It supervises all elementary and secondary education institutions,
including alternative learning systems, both public and private; and provides for the
establishments and maintenance of a complete, adequate and integrated system of
basic education relevant to the goals of national development;

WHEREAS, the FIRST PARTY has already provided eleven (11) teachers for
Aldea National High School (ANHS) and Bathala Elementary School;

WHEREAS, as of July 2023, there are twelve (12) new applicants for teachers
on the said schools;

WHEREAS, the Parties desire to have an agreement to set the functions of


each Party in order to promote and provide quality education to the relocated
families therein;

NOW, THEREFORE, for and in consideration of the foregoing premises, the
Parties hereby agree as follows:

1. That the SECOND PARTY will continue to provide teachers and assistance
on education to its people who were relocated in Tanay, Rizal only until
2024.

2. That the teachers who were assigned or who will be assigned by the
SECOND PARTY to provide education assistance to the students of Aldea
National High School (ANHS) and Bathala Elementary School will render
services as such for a period of one (1) whole academic year or until and
will not accept designation from the SECOND PARTY to any public school.

3. That the SECOND PARTY, in line with its mandate to establish and
maintain a complete, adequate and integrated systems of basic
education, shall not designate the teachers under the payroll of the FIRST
PARTY to any public schools other than the Aldea National High School
(ANHS) and Bathala Elementary School, for one (1) whole academic year.

4. In cases of designation or transfer to any other school, the SECOND


PARTY shall automatically absorbed the teachers from its payroll and the
FIRST PARTY’s obligation to give salary to them shall be terminated.

5. This Agreement may be terminated upon the mutual agreement of the


Parties and upon such terms and conditions as they may agree upon in
writing.
