MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (MOA) made and entered into this ___________
in Sorsogon City, by and between:

The DEPED SCHOOLS DIVISION OF SORSOGON, a national government

agency mandated by law, particularly Batas Pambansa Blg. 232, otherwise known as
the Education Act of 1982 as amended by R.A. No. 9155, otherwise known as the
Governance of Basic Education Act of 2001, with office address at Balogo Sports
Complex, Brgy. Balogo, Sorsogon City, represented by JOSE L. DONCILLO, CESO V,
Schools Division Superintendent, herein referred to as the FIRST PARTY,

-and-

(Here insert the full name of the tutor), Filipino, of legal age, with residence
address at (here insert the residence address of the tutor), herein referred to as the
SECOND PARTY,

-WITNESSETH-

WHEREAS, Sec. 1, Art. 14 of the 1987 Constitution provides that “the State
shall protect and promote the right of all citizens to quality education at all levels and
shall take appropriate steps to make such education accessible to all.”

WHEREAS, DepEd, through the External Partnerships Services (EPS) and the
Education Support Services of DepEd RO V, believes that partnership is an important
paradigm in delivering and achieving DepEd’s education development goals and
services and to fulfill the mandate of the Constitution to make such quality education
accessible to all;

WHEREAS, DepEd has the responsibility of securing resources to make the

public schools competitive and is now calling on the private sector to serve as major
partner for the improvement of the public education system and in the nation’s
development;

WHEREAS, the engagement of Learning Support Aides in all public elementary

and secondary schools including senior high schools is guided by D.O. No. 32, s. 2020
as amended by D.O. No. 28, s. 2021;

WHEREAS, the Second Party desires and is willing to take part in the Brigada
Pagbasa program of the First Party as Volunteer Tutor;

WHEREAS, both Parties agrees to enter into an agreement to formalize their

undertaking;

NOW THEREFORE, for and in consideration of the foregoing premises and the
terms and conditions herein set forth, the parties do hereby covenant and agree to the
following:

I. RIGHTS AND OBLIGATIONS OF THE

DEPED SCHOOLS DIVISION OF SORSOGON

1. Deploy the volunteer tutor in the school in accordance with pertinent issuances
governing Brigada Pagbasa and other applicable regulations.

2. Terminate the services of the volunteer tutor for violation of DepEd’s child
protection policy, or for any violation of established laws.

3. Determine the reading and learning materials to be used in the Brigada Pagbasa.

4. To monitor the performance of the Second Party.

5. To orient, facilitate and assist the Second Party in the conduct of learning process
particularly in Reading and Numeracy.

6. To provide the Second Party Brigada Pagbasa Facilitator Kit (soft or hard copies)
from World Vision Philippines.

7. To give the Second Party Certificate of Appreciation after completion of the program.

8. To grant the Second Party corresponding points for Relevant Teaching Experience
consistent with D.O. No. 7, s. 2015 which the Second Party can use for purposes of
applying for the position of Teacher I in the Schools Division of Sorsogon.

II. RIGHTS AND OBLIGATIONS OF THE

VOLUNTEER TUTOR

1. To demand from the First Party to issue a certification on the number of hours
rendered as volunteer tutor with the corresponding points for Relevant Teaching
Experience.

2. Subject to the flexibility of schedule and in coordination with the school head of the
school where the volunteer tutor is deployed, negotiate on the number of hours to be
rendered and the time of the actual service as volunteer tutor.

3. Report to the school head the fact of his/her being a volunteer tutor.

4. Responsible in the preparation and submission of documents as evidence of service

rendered.

5. Comply with the submission of report as may be required by the school head or by
the First Party.

III. OTHER TERMS AND CONDITIONS

1. The services of the Volunteer Tutor will be on a voluntary basis, however, it shall be
used as teaching experience that shall be credited in the ranking of teachers, of which
points will be given for the services rendered to wit:
a. 0.15 point per month of service
b. 1.5 points for the entire school year
Education volunteers are not subject to monetary compensation.

2. The service of the voluntary tutor shall be from ______________________ until

______________________________. (pls take note that BP Phase 2 will start on August 29, 2022
and ends on July 2023. It is the volunteer to decide up to when they would like to serve.)

3. This agreement shall be construed in conformity with the pertinent laws and rules,
and parties hereby commit to comply with the stipulations contained in this
agreement in good faith.

IV. CONFIDENTIALITY OF RECORDS OR

DOCUMENTS

Whatever information, records or documents obtained by each party from each

other shall be treated with utmost confidentiality and cannot be disclosed without
the consent of the other party.
