MEMORANDUM OF AGREEMENT FOR DepEd- LGU PARTNERSHIP

This Memorandum of Agreement is entered into this 8th day of September 2020 by and between:

The Central Azucarera de Tarlac High School, with Identification Number 300960 a public
high school, with principal address at Central, Tarlac City and presented in this Agreement by its
Principal, MARIA LINDA A. CAYABYAB, Filipino of legal age, and hereinafter referred to as
the SCHOOL.
-and-
______________the Republic of the Philippines, with principal address at Tarlac City and
represented in this Agreement by its Partner,___________, Filipino of legal age, hereinafter
referred to us the DepEd- LGU PARTNERSHIP.

WITHNESSETH:
WHEREAS, the Department of Education in the Philippines, hereafter referred to as “ DepEd”,
is the primary government instrumentality mandated to formulate, implement, and coordinate
policies, plans, programs and projects in the areas of formal and informal basic education:
supervise all elementary and secondary education institutions, including alternative learning
systems, both public and private; and provide for establishment and maintenance of a complete,
adequate, and integrated system of basic education relevant to the goals of national development.

WHEREAS, DepEd has introduced the K to 12 basic education reform program that includes all
levels of education, hereinafter referred to as “learners” with the major objective of ensuring that
graduates of basic education are ready for employment, entrepreneurship and higher learning;

WHEREAS, The Department of the Interior and Local Government (DILG) today urged local
government units (LGUs) to assist the public schools in their areas adjust to the new normal as
well as to utilize the Special Education Fund (SEF) to support the localization of the Basic
Education Learning Continuity Plan (BE-LCP) of the Department of Education (DepEd).

WHEREAS Deped believes that for the effective deliver of instruction, there is a need for school-
industry partnerships that will provide the school the necessary expertise and venue for practical,
enterprise- based training for learners:
WHEREAS, in determining the Local Government code (LGU) issued in 1991 (Republic Act
7160) set out the legal framework for the role of LGUs in basic education.
WHEREAS DEPED will start full implementation in new learning modalities School Year 2020-
2021:
WHEREAS, the SCHOOL is Local Chief Executives must immediately convene their respective
Local School Boards to discuss which of the new learning modalities identified by the DepEd can
be utilized in their respective areas and provide the necessary support to their teachers and learners;
WHEREAS, to achieve this objectives, all LGUs to assist in the enrollment activities such as the
provision of kiosk or center in the barangay for the distribution and collection of enrolment forms
of learners in public schools in their respective areas; and assist schools under their jurisdiction in
the delivery and collection of printed modules from the homes of the students.

WHEREAS, the must also advise the Sanggunian Committee on Education on matters of local
appropriations for educational purposes, and discuss the learning modality deemed appropriate in
the context of local conditions and consistent with IATF-MEID guidelines and how to prepare
teachers and school leaders’ delivery modalities.
WHEREAS the to be able partners in the implementation of Oplan Balik Eskwela and BE-LCP
and “to be more creative in assisting schools and students as they immerse in a new learning
environment” under a new normal.
WHEREAS the institutionalization and implementation of the K to 12 programs is among the
priority programs of the Government for promoting inclusive growth.
WHEREAS The Department of Education (DepEd) is seeking the help of local government s
units (LGUs) in distributing learning modules for students in high risk areas who cannot go
to school or have no access to the internet.

WHEREAS, that ever reliable local brgy. officials or local government officials who may
continually have the manpower and volunteers who can help distribute.
WHEREAS, The DepEd had recently announced that the Inter-Agency Task Force on the
Management of Emerging Infectious Disease (IATF-EID) has approved its Basic Education-
Learning Continuity Plan (BE-LCP) with classes set to open on October 5 and end on June
16, 2021.
NOW, THEREFORE, for and in consideration of the foregoing premises, the PARTIES hereby
agree as follows:
RESPONSIBILITIES OF THE PARTIES

A. Joint Responsibilities
Both the SCHOOL and the LGU PARTNER shall:

1. Create a joint working group that will prepare the action plan to operational the
partnership.
2. Aid in the distribution and retrieval of learning kits and other references weekly for
our learners among nearby barangay’s of Central Azucarera de Tarlac High School.
3. Form a joint steering committee to monitor the progress of the partnership and to
make sure that the provisions of this Memorandum of Agreement (MOA) are met.
4. Adhere to all laws, memorandums, and circulars especially those pertaining to child
protection as provided.
5. Formulate schools will adopt various learning delivery options such as, but not
limited to, face-to-face, blended learning, distance learning, homeschooling, and
other modes of delivery depending on the local COVID Risk Severity
Classification and compliance with minimum health standards.
6. In areas where blended learning is allowed, the IATF guidelines will allow teachers
and learners to be in school in certain parts observing social distancing.
7. Develop advocates that bringing decision making closer to schools more responsive to
local needs.
8. Serving as a channel between local communities and education system.

EFFECTIVITY
This agreement shall hold for the duration of the 2020-2021 Academic School Year and is
renewable every year.
LIABILITY
The school, its administrator, and teachers exercising authority and supervision over the
undergoing in the premises of the partner may be held not accountable for.
NONDISCLOSURE PROVISION
It is expressly understood by DepEd and the students that all information on technology
manufacturing process, process standards, quality assurance methodologies, quality standards,
production capabilities, raw material purchasing, marketing finance, and all other related
documents, manuals, operational, and technical matters that shall make available to them shall be
used for the sole purpose of student learning.
OTHER PROVISIONS
It is expressly understood by the PARTIES that the LGU PARTNER is not obliged to pay wage
or salary since no employer-employee relationship exist between them. However, the LGU
PARTNER is not precluded from providing the student with any monetary or financial assistance
in the form of transportation fee, food allowance etc.
