1. Purpose

To provide for the established procedures of Water Permit/ Rights processes.

2. Scope

These procedures cover the Water Permit Application (WPA) and Water Use
Conflicts (WUC)/Cases processes.

3. Definition of Terms

Terms Definition

Water shall refer to water under the ground, water above the ground, water
in the atmosphere and the waters of the sea within the territorial
jurisdiction of the Philippines

Water Permit is an application to appropriate and use water for any specific use or

Notice of WPA is a form attached to Water Permit Application which shall be sent to
various government agencies and offices for posting. This is a way
of informing the public that an application for water permit is filed to
appropriate water from a source in a particular area.

Permit to Drill is a permit granted to Applicant to drill a test well, whether or not
such well can produce the volume required by the
Applicant/Proponent without adverse effect to other nearby existino
wells.

Conditional Water is a permit granted to appropriate and use water valid for a period of
Permit 2-3 years depending on the use of the permit. Sets of condition shall
be complied before a water permit is issued.

Water Permit is a document evidencing the right to appropriate water granted to


persons, including government agencies and instrumentalities, local
government units, government-owned and control corporations and
quasi-public corporations.

Annual Water Charge is the annual charge/fee imposed to water appropriators for the use
(AWC) and development of water resources. The amount of which depends
on the volume of water granted in the water permit (Art. 83)

Protest
{The most common example of opposition Permit Section

6. Procedure Details (Water Permit)


5.1 Filing
5.1.1 Qualifications of an Applicant for Water Permit
The applicant must be a citizen of the Republic of the Philippines, or a
corporation, partnership, association, cooperative, duly organized under the
laws of the Philippines, at least 60 percent of whose capital stock or paid up
capita! belongs to citizens of the Philippines;
5.1.2 Filing of Application
a. Applicants submits for checking the duly accomplished Water Permit
Application (WPA) Form with attached documentary requirements to the
Water Rights Division (WRD) - Permit Section (PS).
b. PS determines the completeness of the WPA and its corresponding
requirements and assesses the filing fee due to the Applicant.
c. Applicant pays the corresponding filing fee to the cashier and presents the
Official Receipt to WRD-PS
d. The PS assigns WPA number
e. The numbered WPA Form together with the documentary requirements is
submitted by the Applicant to the Records Section for routing. A copy of
the received WPA is given to the Applicant
5.2 Preparation and sending of Endorsement Letter of WPA and Request Letter for
the Posting of Notice of WPA
5.2.1 The PS prepares endorsement letter addressed to the District Engineering
Office of the Department of Public Works & Highways (DPWH) or the

Provincial Irrigation Office of the National Irrigation Administration (NIA) where


the water source is located for its field/site investigation.
6.2.2 A request letter for the posting of notices of WPA is likewise prepared
addressed to various government agencies and focal government units for
posting of the notices of WPA
5.2.3 The Applicant is also furnished a copy of the endorsement fetter to the DPWH
6.3. Notices of WPA
6.3.1. Notices of WPA’s are posted on the bulletin board of the 10 government
agencies and LGU’s for a period of 15 days. After the 15-day posting period,
the said offices issues certificates of posting and sends it to NWRB.
6.3.2. A Notice of WPA is likewise posted on the bulletin board of NWRB for the
same period.
6.4.Site Investigation/Studies
6.4.1. The DPWH District Engineering Office or NIA Provincial Irrigation Office
conducts site investigation and studies, prepares report and submits to NWRB
within 15 calendar days from receipt of the endorsement letter.
6.4.2. If no report is received from DPWH or NIA. the NWRB sends tracer letter or
conducts the site investigation and studies upon applicant’s request and
prepares report before the start of evaluation.
6.5. Protest
Under the lmP,ementin9 Rules & Regulations of the NWRB. any protest to the
WPA may be filed wrthin a period of fifteen (15) days after the last day of the 15-dav
posting period y
6.5.1. If there is any protest to the WPA, the protestant files to NWRB-WRD its
verified opposition together with payment of protest fee.
6.5.2. Upon payment of the protest fee, the case Is docketed. Once docketed the
protest IS filed in the records section and a copy of the protest is given to the
protestant. The records section will route it to the WRD
6.5.3. The Litigation and Adjudication Section of the WRD will prepare an Order
requiring the applicant/protestee to file its answer. Once an answer to the
protest IS received, a Notice of Hearing for the Preliminary Conference is
prepared and send to the parties concerned
6.5.4. The Chief, WRD then assigns the case to a Hearing Officer for the conduct of
the necessary heanng. WUC cases are governed by the Rules on Pleadings
Practice and Procedure before the NWRB ’

6.5.5. After the conduct of the hearing, an ocular inspection is conducted by the
Board's staff and the inspection/investigation report forms part of the records of
the case
6.5.6. The Hearing Officer prepares draft resolution on the protest and its
recommendation to the Executive Director.

6.6. Evaluation
6.6.1. In conjunction with the report of the site investigation and studies, the ES
evaluates the WPA taking into consideration the water requirement of the
Applicant for beneficial use, water availability within the area, capacity of the
source and effect of the proposed appropriation to other users and protests
filed, if any
6.6.2. The ES will determine the water source. If the water source is a deep well, and
the same is not yet existing WRD-ES prepares and issues Permit to Drill (PTD),
which is valid for 6 months.
6.6.3. After drilling, the Applicant submits to WRD the well drilling data.
6.6.4. If drilling has not been completed during the validity period. Applicant may
request for an extension of its PTD for another 6 months citing the reason why
drilling has not been completed.
6.6.5. The WRD recommends to the Board the amount of water to be granted to the
Applicant.
6.6.6. If the deep well is already existing at the time of application, Applicant pays the
corresponding penalty for drilling the deep well without the PTD.
6.6.7. The WRD recommends to the Board the amount of water to be granted to the
Applicant.
6.6.8. If the water source is a surface water, the volume of water available for
appropnation at diversion point is computed based on historical streamflow
analysis thru drainage area correlation for gauged river and considering
Reference River for ungauged river.
6.6.9. The WRD recommends to the Board the amount of water to be granted to the
Applicant considering the river's environmental flow and water users
upstream/downstream from the Applicant's point of diversion.

6.7. Recommendation and Approval


6.7.1. The Board Secretanat submits all evaluated WPA to the Director of National
Hydrau ic Research Center (NHRC) of the University of the Philippines (who is

recommendation.

6.7.2. The NHRC Director submits his recommendation to the Board Secretariat.
6.7.3. The NWRB Board deliberates upon and approves/defers/denies the WPA with a
recommended amount of water of more than 100 Ips.
6.7.4. The NWRB Executive Director deliberates upon and approves/defers/denies the
WPA with a recommended amount of water of less than 100 Ips.
6.7.5. The Board Secretariat prepares the Board Resolution to be signed by the
Board.
6.7.6. The NWRB Board issues a Board Resolution approving the WPA or confirming
its approval by the Executive Director.

6.8. Releasing of Conditional Water Permit


6.8.1. The WRD/AFD Billing Unit assess the Annual Water Charge (AWC) based on
the volume of water granted in the Permit
6.8.2. The WRD prepares the Conditional Water Permit and signed by the Executive
Director
6.8.3. The Applicant is notified for the approval of the application with the
corresponding AWC assessment.
6.8.4. The Applicant pays the corresponding annual water charges to the cashier and
presents the Official Receipt (OR) to the office the Executive Director.
6.8.5. The Office of the Executive Director releases the Conditional Water Permit to
the Applicant after presentation of the OR
6.8.6. The Applicant formally accepts the Conditional Water Permit.

6.9. Compliance of the Conditions in the CWP


6.9.1. The CWP grantee submits to WRD the sets of compliance stated in the CWP
6.9.2. The WRD-ES reviews the submitted compliance/documents
6.9.3. If conditions have been met, the WRD recommends to the Executive Director
the issuance of Water Permit

6.10. Releasing of Water Permit


6.10.1. The WRD prepares the Water Permit and signed by the Executive Director
6.10.2. The AFD-BillIng Unit prepares the Statement of Account (SOA) and sends to
the CWP Grantee
6.10.3. The CWP Grantee pays the corresponding annual water charges to the cashier
and presents the Official Receipt (OR) to the office the Executive Director.

6.10.4.The Office of the Executive Director releases the Water Permit to the CWP
Grantee after presentation of the OR.
6.10.5. The CWP Grantee formally accepts the Water Permit.
