THIS INDENTURE IS MADE AND ENTERED INTO BY AND BETWEEN
VIMALARASA AMUTHAN (Holder of National Identity Card Bearing No. 61 8100 038V)
of No. 49, T.B Jaya Road, Grandpass, Colombo – 14 in the Democratic Socialist Republic of
Sri Lanka (hereinafter referred to as “the First Declarant” which term or expression as
herein used shall where the context so requires or admits mean and include the said
VIMALARASA AMUTHAN and her heirs executors and administrators) of the FIRST

AND SARAVANAMUTHTHU KAMILAN (Holder of National Identity Card Bearing


No. 91 527 3083V) of No. 49, T.B Jaya Road, Grandpass, Colombo – 14 in the said Republic
of Sri Lanka (hereinafter referred to as “the Third Declarant” which term or expression
as herein used shall where the context so requires or admits mean and include the said
SARAVANAMUTHTHU KAMILAN and her heirs executors and administrators) of the
THIRD PART

WHEREAS by Deed of Gift bearing No. 179 dated 05th day of August 2019 attested
by M.I.F. Ishara Notary Public of Colombo the First and Second named Declarants hereof
and the said Donors Gifted to the said SARAVANAMUTHTHU KAMILAN (who is the 2
said Third Part Declarant hereof) the land and premises morefully described in the First
Schedule hereto.

AND WHEREAS the said Deed of Gift No.179 in respect of the said allotment of
land and premises morefully described in the First Schedule hereto was registered in
Folio G 103/ 66 at the Colombo Land Registry.

AND WHEREAS in the said Deed of Gift No.179 indicate incorrectly the property
morefully described in the First Schedule hereto instead of correctly morefully described
in the second Schedule hereto.

called KANDAPAHALA depicted in plan No.35/2005 dated 02nd day of February 2005
made by P.M Leelarathna Licensed Surveyor situated in Madunagoda village in ward 7
within the Grama Niladari Division of Kotikawatta and Divisional Secretariat Division of
Kolonnawa Unit 03 of Colombo Development Council in Ambatalenpahala of the Colombo
Mudliyer’s Division (presently within the Pradeshiya Saba Limits of Kotikawatta-
Mulleriyawa) in the District of Colombo Western Province and which said Lot “B51” is
bounded on the NORTH by Lot “B” in Plan No. 77/2002 and by Lot “B” of the same land
on the EAST by divided and separated Lot B of this land, on the SOUTH by divided and
separated Lot “B5” of this land and on the WEST by Lot “B7” in Plan No. 77/2002 and Lot
“B4” reserved for Road in Plan No. 77/2002 and divided and separated Lot “B5” of this
land and containing in extent EIGHT PERCHES (A0-R0-P8) according to the said Plan
No. 35/2005 aforesaid.

All that divided allotment of land and premises marked Lot 51 divided and
separated from the land called KANDAPAHALA depicted in Plan No. 35/2005 dated 02nd
day of February 2005 made by P. M. Leelarathna Licensed Surveyor situated in
Madunagoda village in Ward 7 within the Grama Niladari Division of Kotikawatta and
Divisional Secretariat Division of Kolonnawa Unit 03 of Colombo Development Council in
Ambatalenpahala of the Colombo Mudliyer’s Division (presently within the Pradeshiya
Saba Limits of Kotikawatta-Mulleriyawa) in the District of Colombo Western Province
together with the Right of Ways and all other similar rights to use in common with the
other users which are more fully described in the Second Schedule hereto and which said
Lot 15 is bounded on the NORTH by Lot B7 in Plan No. 77/2002 and by Lot B of the same
land on the EAST by Lot B divided and separated from this Land, on the SOUTH by Lot B
divided and separated from this Land and on the WEST by Lot 4 reserved for Road in Plan
No. 77/2002 and containing in extent EIGHT PERCHES (A0-R0-P8) according to the said
Plan No. 1719 together with the larger land and building soil trees plantations and

everything else standing thereon and registered in Volume and Folio G 103/ 66 at the
Land Registry of Colombo.

AND WHEREAS by reason of such oversight, it has become necessary to rectify


and alter the Schedule of the said Deed of Gift bearing No. 179 by stating the Second
Schedule hereto instead of the First schedule hereto.

It is necessary to rectify and alter the correct Schedule of the said Gift Deed bearing
No. 179 aforesaid.

IN WITNESS WHEREOF I, the said Declarant, VIMALARASA AMUTHAN, do set


my hand, and the said KANIAMUTHAN THEVAN also set her hand and
SARAVANAMUTHTHU KAMILAN also set her hand hereunto and to two others of the
same tenor and date as these presents at Colombo on this Fifth (5th) day of September in
the year Two Thousand and Twenty Three (2023).

All that divided allotment of land and premises marked Lot “B51” of the land
called KANDAPAHALA depicted in plan No.35/2005 dated 02nd day of February 2005
made by P.M Leelarathna Licensed Surveyor situated in Madunagoda village in ward 7
within the Grama Niladari Division of Kotikawatta and Divisional Secretariat Division of
Kolonnawa Unit 03 of Colombo Development Council in Ambatalenpahala of the Colombo
Mudliyer’s Division (presently within the Pradeshiya Saba Limits of Kotikawatta-

separated from the land called KANDAPAHALA depicted in Plan No. 35/2005 dated 02nd
day of February 2005 made by P. M. Leelarathna Licensed Surveyor situated in
Madunagoda village in Ward 7 within the Grama Niladari Division of Kotikawatta and
Divisional Secretariat Division of Kolonnawa Unit 03 of Colombo Development Council in

declarant VIMALARASA AMUTHAN (Holder of National Identity Card Bearing No. 61
8100 038V) the second declarant KANIAMUTHAN THEVAN (Holder of National Identity
Card bearing No. 79 319 0170V) and the third declarant SARAVANAMUTHTHU KAMILAN
(Holder of National Identity Card Bearing No. 91 527 3083V) who signed this deed
“illegibly” and “illegibly” and affixed their thumbs of left hands impressions in the
presence of ELILARASAN KARUPPU (Holder of National Identity Card No.654979856 V)
of No.19A, 2nd Lane, Temple Road, Rajagiriya and LOGESH KANAGARAJ (Holder of
National Identity Card No.654979856 V) of No.5A, Hospital Road, Colombo, subscribing
witnesses hereto, and who signed “illegibly” and “illegibly” respectively and the same was
signed by the said Executants, the said Witnesses and also by me the said Notary in my
presence and in the presence of one another, all being present at the same time at
Colombo on this 5th day of September Two Thousand and Twenty Three (2023).
And I certify that the said Executors and the witnesses are known to me and I have
checked their identity by the inspection of their National Identity Card and prior to the
execution of the foregoing instrument, I have inspected the identity card of the executant.
AND I further certify and attest that the stamp duty to the value of No stamp and the
Original of this instrument bears an adhesive stamp of the value of Rs. 1/= and it was
supplied by me, the said Notary.
