TO ALL TO WHOM THESE PRESENTS SHALL COME SIVAM SHANTHAN, I (Holder
of National Identity Card No.654979856 V) No. 34,Nanayakara Mawatha, 1st Lane,
Rajagiriya in the Democratic Socialist Republic of Sri Lanka the Executor nominated by
the Last Will and Testament of RASAKANNU JANAKAN deceased in Testamentary Case
No.3621/T in the District Court of Colombo (hereinafter called and referred to as “the
Executor” which term or expression as herein used shall where the context so requires
or admits mean and include the said SIVAM SHANTHAN in the capacity of such Executor
of the Last Will and Testament of the said late RASAKANNU JANAKAN deceased and his
successor and successors in the said office of Executor as aforesaid)

-: S E N D S G R E E T I N G S :-
WHEREAS the said RASAKANNU JANAKAN was during his lifetime seized and
possessed of or otherwise well and sufficiently entitled to all that and those two
allotments of land and premises marked Lots B and C on Plan No.121 dated 16th October
1967 made by K. Kuwaneshvaran Licensed Surveyor more fully described Firstly and

Secondly in the First Schedule hereto under and by virtue of Executor's Conveyance
bearing No.4 dated 22nd June 1980 attested by G. Magesh Notary Public of Colombo.

AND WHEREAS the said RASAKANNU JANAKAN duly executed his Last Will and
Testament bearing No.4649/A dated 6th February 2001 and attested by the Notary
attesting these presents (a certified copy whereof is annexed to the Original of this Deed)
whereby he appointed his son the said SIVAM SHANTHAN of No. 34, Nanayakara
Mawatha 1st Lane, Rajagiriya as Executor of the said Last Will and Testament for the
purpose of selling inter alia the said properties and premises in the schedule hereto more
fully described (hereinafter referred to as the said “lands and premises”)

AND WHEREAS the said RASAKANNU JANAKAN whilst being so seized and
possessed of the said lands and premises departed this life on the 6th of June 2004 at the
Western central Hospital within the Jurisdiction of the District Court of Colombo without
altering revoking or cancelling the said Last Will and Testament.

AND WHEREAS the said SIVAM SHANTHAN as an executor named in the said
Last Will and Testament proved the same in Testamentary proceedings No.3621/T in the
District Court of Colombo and probate thereof was granted to me in the said
Testamentary proceedings on the 7th of August 2006 under the hand and seal of the
District Judge of Colombo (a certified copy of the said probate is annexed to the Original
of this Deed).

AND WHEREAS the said Executor have by virtue of the probate faithfully executed
the said Last Will and Testament and duly administered the said Estate and have also
exhibited in to the said District Court of Colombo a true full and perfect Inventory of the
properties belonging to the said deceased.

AND WHEREAS in accordance with the provisions contained in the said Last Will
and Testament the said RASAKANNU JANAKAN devised and bequeathed unto his son
the said SIVAM SHANTHAN all his properties both movable and immovable.

AND WHEREAS for better manifestation of title of the said RASAKANNU


JANAKAN to the said land and premises morefully described in the Schedule hereto it has
become expedient and necessary to execute these presents.

NOW KNOW YE AND THESE PRESENTS WITNESS that the said SIVAM
SHANTHAN in his capacity as Executor of the Last Will and Testament of RASAKANNU
JANAKAN in pursuance of the provision of the said Last Will and Testament No.3621/T
and in consideration of the said premises doth hereby transfer convey set over and assure
unto himself the said SIVAM SHANTHAN (as devisee under the said Last Will and
Testament No. No.3621/T) the said land and premises morefully described in the
Schedule hereto together with all and singular the rights ways easements servitudes and
appurtenances thereto belonging or in anywise appertaining or usually held and
occupied therewith or reputed or known as part and parcel thereof and together with all
the estate right title interest property claim and demand whatsoever of the said deceased

of in to upon or out of the said land and premises in the Schedule hereto morefully
described and every part or portion thereof together with all the title deeds vouchers and
other writings therewith held or relating thereto.

TO HAVE AND TO HOLD the said land and premises hereby granted and
conveyed or entitled so to be unto the said SIVAM SHANTHAN his heirs executors
administrators and assigns absolutely and forever.

AND the said SIVAM SHANTHAN in his capacity as Executor in accordance to the
Probate granted to him as aforesaid doth hereby covenant promise and declare to and
with himself (being the beneficiary and the devisee under the aforesaid Last Will and
Testament No.3621/T) his heirs executors administrators and assigns that he has not at
any time hereto made done or committed or been party or privy to any act deed matter
or thing whatsoever whereby or by means whereof the said premises hereby granted
conveyed and assured or expressed or intended so to or any part or portion thereof are
is can shall or may in any wise have impeached or encumbered or prejudicially effected
in title charge estate or otherwise howsoever
IN WITNESS WHEREOF the Executor SIVAM SHANTHAN doth her signatures
and place her thumb of left hand impression hereunto and two others of the same tenor
and dates as these presents set their hands at Colombo on this Seventh 5th day of
September Year Two Thousand and Twenty Three (2023).
THE SCHEDULE ABOVE REFERRED TO:-
Firstly
ALL that divided and defined allotment of land marked Lot B with the house and
everything standing thereon depicted on Plan No.121 dated 16th October 1967 made
by K.Kuwaneshvaran Licensed Surveyor of the part of the garden called
“AMBAGAHAWATTA” premise bearing Assessment No.125, Wennawatta Road,
Wellampitiya situated at Wennawatta Divisional Secretariat Division of Kolonnawa in
Division of Wennawatta 304 within the Pradeshiya Sabha Limits of Kotikawatte
Mulleriyawa in Ambatalen Pahala of Aluth Kuru Korale South in the District of Colombo
Western Province and which the Lot B is bounded on the NORTH by Lot D and Lot E in
the said Plan No.1214, on the EAST by 1/5th share marked Lot C and allotted to Kamal
Wimalanathan the 1st defendant of the D.C. Colombo partition Case No.46853/P now
held and possessed by Charls Mathew the sole heir of the said Kamal Wimalanathan on
the SOUTH by the property belonging to Kamal Weerasinghe and others and on the
WEST by 1/5th share marked Lot B and allotted to the Plaintiff in D. C. Colombo
Partition Case No. 96853/P and containing in extent TWENTY PERCHES (A0-R0-P20)
according to the said Plan No.1214 Registered at the Land Registry of Colombo under
Volume/Folio B 922/234.
Secondly
ALL that divided and defined allotment of land marked Lot C with the house and
everything standing thereon depicted on Plan No.121 dated 16th October 1967 made
by K.Kuwaneshvaran Licensed Surveyor of the part of the garden called
“AMBAGAHAWATTA” premise bearing Assessment No.125, Wennawatta Road,
Wellampitiya situated at Wennawatta Divisional Secretariat Division of Kolonnawa in
Division of Wennawatta 304 within the Pradeshiya Sabha Limits of Kotikawatte

Mulleriyawa in Ambatalen Pahala of Aluth Kuru Korale South in the District of Colombo
Western Province and which the Lot C is bounded on the NORTH by Lot G in the said
Plan No.1214, on the EAST by the property belonging to Mr. Bernard Valentine on the 4
SOUTH by the property belonging to Udayan Kumaraswamy and others and on the
WEST by the 3/5th share marked B and allotted to the 2nd Defendant in the said D.C.
Colombo Partition Case No.66853/P, Sara De Silva and containing in extent TWENTY
PERCHES (A0-R0-20) according to the said Plan No.1214 Registered at the Land
Registry of Colombo under Volume/Folio B 922/235.

Judicial zone of Colombo do hereby certify and attest that the foregoing instrument
having been read over and explained by me, the said Notary, to the executor within
named SIVAM SHANTHAN (Holder of National Identity Card No.654979856 V) who
signed this instrument “illegibly” and “illegibly” and affixed his thumbs of left hands
impressions in the presence of Rajan Remy (Holder of National Identity Card
No.654979856 V) of No.19A, 2nd Lane, Temple Road, Rajagiriya and Roy Abinash (Holder
of National Identity Card No.654979856 V) of No.5A, Hospital Road, Colombo,
subscribing witnesses hereto, and who signed “illegibly” and “illegibly” respectively and
the same was signed by the said Executant, the said Witnesses and also by me the said
Notary in my presence and in the presence of one another, all being present at the same
time at Colombo on this 5th day of September Two Thousand and Twenty Three (2023).
And I certify that the said Executor and the witnesses are known to me and I have checked
their identity by the inspection of their National Identity Card and prior to the execution
of the foregoing instrument, I have inspected the identity card of the executant.
AND I further certify and attest that the stamp duty to the value of No stamp and the
Original of this instrument bears an adhesive stamp of the value of Rs. 1/=.
And I also certify that I have renewed my License for the year 2023.
