General description
Global Art Gifts Co., Ltd. (Unified Social Credit Code: 91441322MA4WEC9H9E) was located at Zhonggang Suwu, Shiwan
Town, Boluo Country, Hui Zhou City, Guangdong Province, China. This was a private company. The total land area occupied
by the facility was about 800 m2. They started their operation since April 2017. A total of 31 employees including 13 female
employees and 18 male employees were working in the facility during the audit. 4 employees (12.9%) were local workers from
Guangdong Province, 27 employees (87.1%) were domestic migrant workers from Hubei, Hunan, Jiangxi, Sichuan, Chongqing
and Henan Province. No foreign migrant workers. The ages of employees range from 21 to 56 years old. the facility consists
one 3-storey building as production floor, office and warehouse, During this audit, one 5-storey dormitory building was vacancy,
the facility management explained that due to cost and worker did not like lived in dormitory, so this audit did not cover the
building. No dormitory and kitchen was provided by the facility.
The main product manufactured by the facility covered medal, badge, key chain and challenge coin.
The main production processes were listed as follows: Die casting, Punching, Polishing, Color filling, Assembly, Inspection and
Packing.
The production capacity per month was 200,000 pieces.
This full audit was conducted by Intertek Testing Services Shenzhen Ltd. One auditor assessed / verified the facility’s operations
against BSCI Code of Conduct and local legislations on a sampling basis. The management was cooperative throughout the
process of the audit. The documentations requested were provided for review timely. All areas were allowed access for tour, and
a private room was provided for employees’ interview. During closing meeting, the managements were receptive to all findings
and stated that they would make improvement for all raised findings continually. Findings were raised in the PA1, PA2, PA5,
PA6, PA7 and PA12. Please refer to the relevant performance areas for details.
The attendance records from May 1, 2020 to June 11, 2021 were reviewed at this audit. All employees worked for 40 hours
and 5 days per week in 1 shift, the regular working hour was from 8:00 to 18:00 with the break from 12:00 to 14:00. Finger print
attendance system is used for time keeping and every employee should scan their finger print when they go in and out of the
facility. As per facility management interview, the peak season is not obvious in the facility.
The payroll records from May 2020 to April 2021 were reviewed at this audit. Based on the provided records, all employees’
wages were calculated on hourly-rated basis. The lowest basic wages were RMB 1550/month that met legal requirement. For
overtime wages, 150%, 200%, 300% of basic wages were paid to employees for their overtime hours on workdays, rest days
and statutory holidays respectively. Employees were paid by cash on or before 30th of each month after the previous wage
calculation cycle.
Remark:
1. There are no government waivers in the facility, which makes the government waivers not applicable;
2.No Collective bargaining agreements in the facility, which makes the collective bargaining agreements not applicable;
3.There are no agencies or contractor used by the facility, which makes the agency labor contract or contractor not applicable;
4. #COVID-19: The facility abides by all state regulations with respect to COVID 2019. The risk of COVID-19 was low in Huizhou
City of China, masks are required, employee/visitor temperature is taken upon entrance to the facility verification of employee/
visitor current physical condition, the related records were kept by the facility and the facility conducted regularly sterilize with
alcohol at workshop.

Findings

PA1: Social Management System

During document review, auditor found that the facility had not set up an effective management system to implement the BSCI
Code of Conduct. Some non-compliance findings were detected in Performance Areas of Workers Involvement and Protection,
Fair Remuneration, Decent Working Hours, Occupational Health and Safety and Protection of the Environment. For details,
please refer to Performance Area 2、5、6、7 and 12 respectively. The question was scored partial because the facility fully
respects the requirement of other performance areas except performance area 2、5、6、7 and 12. In accordance with BSCI
1.1 requirement, the facility should set up effective a system for BSCI code of conduct.

Through document review and management interview, the facility had set up the workforce planning to reduce the overtime,
however, the workforce planning was not effective, as sampled working hours of employees exceeding local law requirement.
Please refer to checkpoint #6.2 for details. In accordance with BSCI Social Compliance Requirement, the facility should set up
effective workforce planning that allows the auditee to reduce overtime in compliance with local law.

PA 2: Workers Involvement and Protection

Though BSCI standards were posted in public areas, through workers' interview, it was noted that 30% interviewed workers
and worker representative did not aware of BSCI Code of Conduct, such as Continuous improvement and cooperation,
etc. so the question was scored as partial. In accordance with BSCI 2.4 requirement, the auditee should build sufficient
competence to successfully embed responsible practices in the business operation. This refers to managers, workers and
workers representatives.
企业虽把BSCI标准张贴在公共区域,但经⾯谈发现, 30%被访谈员⼯和员⼯代表不了解BSCI⾏为守则, 如持续改善和合作等。
因此该问题判定为部分不符合。 依据BSCI2.4的要求,企业应该充分培养下列⼈⼠的能⼒,以便在业务经营中成功结合责任规

PA 5: Fair Remuneration

During document review, auditor found that the minimum basic wage was RMB 1550 per month which was met local minimum
wage standard in the facility, but the facility did not have a mechanism to provide sufficient remuneration that allows workers to
meet a decent living standard. In accordance with BSCI Social Requirement 5.4, the auditee provides sufficient remuneration
that allows workers to meet a decent living standard.
在⽂件审阅中,审核员发现企业的最低基本⼯资为每⽉⼈⺠币1550元,符合当地最低⼯资标准,但是企业未建⽴机制⽀付⾜够
的报酬使⼯⼈达到体⾯⽣活标准。 依据BSCI社会责任要求5.4,受审核⽅应提供⾜够的薪资以允许员⼯达到体⾯的⽣活标准.
Insufficient social insurance participated. Through document review, auditor found that there were 31 employees in May
2021, and 31 employees eligible for the 5 types of social insurance, there were only 9 employees (29%)had participated in
basic endowment insurance, medical insurance, maternity insurance and unemployment insurance and employment injury
insurance. besides, the facility did not purchase commercial accident insurance for other employees. Remark: 1) Interviewed
workers stated that they did not want to participate in social insurance; 2) There was no retirees working, newly joined workers,
temporary or dispatch worker in May 2021. In accordance with the Social Insurance Law of the People’s Republic of China,
Article 10 Employees shall participate in the basic endowment insurance, and the basic endowment insurance premiums
shall be jointly paid by employers and employees. Article 23 Employees shall participate in the basic medical insurance for
employees, and the basic medical insurance premiums shall be jointly paid by employers and employees in accordance with the
relevant provisions of the state. Article 33 Employees shall participate in the employment injury insurance, and the employment
injury insurance premiums shall be paid by their employers rather than the employees. Article 44 Employees shall participate
in unemployment insurance, and the unemployment insurance premiums shall be jointly paid by employers and employees
in accordance with the relevant provisions of the state. Article 53 Employees shall participate in maternity insurance, and the
maternity insurance premiums shall be paid by employers rather than employees in accordance with the relevant provisions of
the state.
社会保险参保不⾜。通过⽂件审核,审核员发现企业在2021年5⽉有31名员⼯,符合参加5项社会保险条件有31名员⼯,只有9⼈
(29%)参加养⽼保险,医疗保险,失业保险,⼯伤保险和⽣育保险.此外,企业也没有为其他员⼯购买商业意外伤害险。 备注:1)⾯

社会保险法》第⼗条, 职⼯应当参加基本养⽼保险,由⽤⼈单位和职⼯共同缴纳基本养⽼保险费。第⼆⼗三条 职⼯应当参加
职⼯基本医疗保险,由⽤⼈单位和职⼯按照国家规定共同缴纳基本医疗保险费。第三⼗三条 职⼯应当参加⼯伤保险,由⽤⼈
单位缴纳⼯伤保险费,职⼯不缴纳⼯伤保险费。第四⼗四条 职⼯应当参加失业保险,由⽤⼈单位和职⼯按照国家规定共同缴
纳失业保险费。第五⼗三条 职⼯应当参加⽣育保险,由⽤⼈单位按照国家规定缴纳⽣育保险费,职⼯不缴纳⽣育保险。

PA 6: Decent Working Hours

Overtime hours exceeded the legal requirement. Through document review, auditor noted that the monthly overtime hour
of 8 out of 8 randomly selected employees were 74 hours in April 2021(Most current month),8 out of 8 randomly selected
employees were 74 hours in November 2020(random month) and 8 out of 8 randomly selected employees were 74 hours in
June 2020(random month). In accordance with the PRC Labor Law article 41 The employing unit may extend working hours due
to the requirements of its production or business after consultation with the trade union and laborers, but the extended working
hour for a day shall generally not exceed one hour; if such extension is called for due to special reasons, the extended hours
shall not exceed three hours a day under the condition that the health of laborers is guaranteed. However, the total extension in
a month shall not exceed thirty-six hours.
加班时间超过法规要求。通过⽂件审核,审核员发现在抽取的2021年4⽉份(当前⽉)的考勤中,8名随机抽取的员⼯中有8⼈
⽉加班时间为74⼩时, 2020年11⽉份(随机⽉)的考勤中8名随机抽取的员⼯中有8⼈⽉加班时间为74⼩时和2020年6⽉份(随
机⽉)的考勤中,8名随机抽取的员⼯中有8⼈⽉加班时间74⼩时。 依据《中华⼈⺠共和国劳动法》第41条,⽤⼈单位由于⽣
产经营需要, 经与⼯会和劳动者协商后可以延⻓⼯作时间,⼀般每⽇不得超过⼀⼩时;因特殊原因需要延⻓⼯作时间的,在
保障劳动者⾝体健康的条件下延⻓⼯作时间每⽇不得超过三⼩时,但是每⽉不得超过三⼗六⼩时。

PA 7: Occupational Health and Safety

1.There were some findings noted in occupational health and safety section, please refer to relevant checkpoints for details.
In accordance with checkpoint 7.1, the auditee should be in line with the occupational health & safety regulations. 2. Auditor
found that the facility did not conduct occupational health check to relevant employees engaged in post with occupational
disease hazards, such as punching employees. In accordance with the PRC Law of Prevention and Control of Occupational
Diseases Article 35, the employer shall conduct regular occupational health examination for those labourers who are engaged
in works with occupational hazard(s) as required by production safety supervision and administration department and public
health administrative department under the State Council. The occupational health examination shall be conducted before
labourers start to take the post, in the course of the work and after leave the post and the employer shall provide the results of
the occupational health examinations to labourers in written.
1.审核发现职业健康安全部分存在⼀些问题,具体请参考各问题点. 根据BSCI检查清单7.1, 被审核⽅应该符合职业健康安全的相
关规定。 2.审核发现企业没有提供在定期的职业病体检给相应的员⼯,⽐如冲压员⼯。 依据《中华⼈⺠共和国职业病防治法》
第三⼗五条,对从事接触职业病危害的作业的劳动者,⽤⼈单位应当按照国务院安全⽣产监督管理部⻔、卫⽣⾏政部⻔的规定
组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果书⾯告知劳动者。
Insufficient employment injury insurance for employees participated. Through document review, auditor found that there were
31 employees eligible for the 5 types of social insurance in May 2021, only 9 employees (29%) had participated in employment
injury insurance, besides, the facility did not purchase the accident insurance from business insurance company for other
5 retirees working employees. In accordance with the Social Insurance Law of the People’s Republic of China, Article 33
Employees shall participate in the employment injury insurance, and the employment injury insurance premiums shall be paid by
their employers rather than the employees.
⼯伤保险参保不⾜。通过⽂件审核,审核员发现企业在2021年5⽉符合参加5项社会保险条件有31名员⼯,只有9⼈(29%)参加⼯
伤保险。另外,企业也没有给其他员⼯购买商业意外险。 依据《中华⼈⺠共和国社会保险法》第三⼗三条 职⼯应当参加⼯伤
保险,由⽤⼈单位缴纳⼯伤保险费,职⼯不缴纳⼯伤保险费。
Through document review, worker representative interview and employee interview, it was noted that Workers and their
representative were not involved in health and safety risk assessment. In accordance with BSCI Social Requirement7.4, the
facility management should cooperate with worker representative and employees when developing and implementing system
towards ensuring OHS.
通过⽂件审核,员⼯代表访谈和员⼯访谈发现,⼯⼈和⼯⼈代表没有参与健康与安全的⻛险评估。 根据BSCI社会责任要求7.4,
企业在制定和推⾏健康安全系统时,管理层与员⼯代表和员⼯之间应加强合作.
1.No safety label for chemical. During facility tour, auditor found that there was no label for chemical (such as Alcohol) using
at packing workshop on 2/F at production building. In accordance with the Regulations on the Safe Use of Chemicals in
Workplace, Article 12 The unit, which uses chemical, shall set up identification label for all chemicals in using. For dangerous
chemical, a safety label shall be applied and MSDS be provided for worker. 2. Safety facilities for hazardous chemicals were
not compliant with legal requirement. During facility tour, auditor found that hazardous chemicals such as methylbenzene and
dimethylbenzene (Total volume was around 50 L) were stored in paint mixing room, but there was no secondary containment.
In accordance with Regulations on the Safety Management of Dangerous Chemicals article 20, The units producing, storing
dangerous chemicals shall, according to the categories and hazardous characteristics of the dangerous chemicals they
producing, storing, set up the corresponding safety facilities and equipments for monitoring, aeration, protection against
exposure to sun, temperature adjusting, fireproof, fire fighting, flameproof, pressure discharging, prevention of toxicants,
neutralization, moistureproof, protection against thunder, protection against static, antisepsis, prevention of leakage, protection
dams or segregated operations, etc.. In addition, the units shall carry out maintenance and caring regularly according to the
national standards, industrial standards or the relevant provisions of the State, thus to guarantee the safety operations of
facilities and equipments.
1.化学品没有安全标识。在现场巡查时,审核员发现在⽣产楼⼆楼包装⻋间使⽤的化学品(如酒精)没有标识. 依据《⼯作场
所安全使⽤化学品规定》第⼗⼆条,使⽤单位使⽤的化学品应有标识,危险化学品应有安全标签,并向操作⼈员提供安全技
术说明书。 2.危险化学品储存的安全设施不符合要求。在现场巡查时,审核员发现在调油房存放甲苯、⼆甲苯等危险化学品
(总量约50升),没有按要求设置防泄漏安全措施. 危险化学品安全管理条例第⼆⼗条,⽣产、储存危险化学品的单位,应当
根据其⽣产、储存的危险化学品的种类和危险特性,在作业场所设置相应的监测、监控、通⻛、防晒、调温、防⽕、灭⽕、

防爆、泄压、防毒、中和、防潮、防雷、防静电、防腐、防泄漏以及防护围堤或者隔离操作等安全设施、设备,并按照国家标
准、⾏业标准或者国家有关规定对安全设施、设备进⾏经常性维护、保养,保证安全设施、设备的正常使⽤。 ⽣产、储存危
险化学品的单位,应当在其作业场所和安全设施、设备上设置明显的安全警⽰标志。
Machines without protective devices. During facility tour, auditor found that no belt guard installed rolling part for 2 out of 3
punching machines on 1/F of the production building. In accordance with Law of the PRC on Work Safety article 33, The design,
manufacture, installation, application, inspection, maintenance, repair of and safety facilities shall comply with the national or
industrial standards. Manufacturing units shall maintain and inspect the safety facilities regularly to ensure they are in good
working conditions. Maintenance and inspection records should be properly maintained and assigned to relevant staff.
设备缺少安全防护装置。在现场巡查时,审核员发现⽣产⻋间⼀楼的3台冲压机中的2台在转动部分没有安装⽪带轮防护罩。
依据《中华⼈⺠共和国安全⽣产法》第33条 ,安全设备的设计、制造、安装、使⽤、检测、维修、改造和报废,应当符合国
家标准或者⾏业标准。⽣产经营单位必须对安全设备进⾏经常性维护、保养,并定期检测,保证正常运转。维护、保养、检测
应当作好记录,并由有关⼈员签字.
The facility did not conduct evaluation on occupational hazard factors. During facility tour, auditor found that hazardous factors
existed in color workshop on the 2/F at Production Building where hazardous chemicals including benzene, methylbenzene
and dimethylbenzene were used. However, the facility could not provide evaluation report of occupational hazardous factors
in past year for review. In accordance with the Provisions on the Management of Workplace Occupational Hygiene Article
20, Employers with severe occupational disease hazards shall entrust an occupational health technical service agency with
corresponding qualifications to conduct occupational disease hazard factor test at least once a year, and conduct assessment
on current situation of occupational disease hazard at least once every three years. Employers with general occupational
disease hazards shall entrust an occupational health technical service organization with corresponding qualifications to conduct
occupational disease hazard factors test at least once every three years. The test and evaluation results shall be stored in the
occupational health files of employers, and reported to the health authorities and be notified to the laborers.
企业没有按要求进⾏职业危害因素检测。在现场巡查时,审核员发现在⽣产楼⼆楼上⾊⻋间使⽤苯、甲苯、⼆甲苯等危险化学
品,存在职业危害因素。但是,企业未能提供该作业场所最近⼀年的职业危害因素监测报告供审阅。 依据《⼯作场所职业卫
⽣管理规定》第⼆⼗条,职业病危害严重的⽤⼈单位,应当委托具有相应资质的职业卫⽣技术服务机构,每年⾄少进⾏⼀次职
业病危害因素检测,每三年⾄少进⾏⼀次职业病危害现状评价。职业病危害⼀般的⽤⼈单位,应当委托具有相应资质的职业卫
⽣技术服务机构,每三年⾄少进⾏⼀次职业病危害因素检测。检测、评价结果应当存⼊本单位职业卫⽣档案,并向卫⽣健康主
管部⻔报告和劳动者公布。

PA 12: Protection of the Environment

No Environmental Impact Assessment (EIA) for construction project was provided for review. During facility tour, auditor
found that products in the facility are metal products, and the main processes are Die casting, punching, polishing, coloring,
assembling, inspection and packaging, the waste gas, noise and hazardous waste which generated during manufacturing
would cause influence on the environment. EIA document shall be compiled for assessing detailed environmental impacts and
relevant protective measures. However, the facility could not provide EIA document for review. In accordance with the PRC
Environmental Impact Assessment Law Article 16, the state conducts systematic management over the Environmental Impact
Assessment of construction projects in accordance with the degree of impact on the environment. Construction units shall
compile Environmental Impact Report, Environmental Impact Report Form or fill out Environmental Impact Registration Form
(hereinafter referred to as Environmental Impact Assessment Documents) under the following rules: (1) For those that may
cause heavy environmental impact, Environmental Impact Report shall be compiled, and the environmental impact produced
shall be fully assessed. (2) For those that may cause slight environmental impact, Environmental Impact Report Form shall be
compiled, and the environmental impact produced shall be analyzed or specially assessed. (3) For those that have very little
environmental impact and do not need any Environmental Impact Assessment, Environmental Impact Registration Form shall
be filled out. The construction projects’ systematic management directory of Environmental Impact Assessment is made and
published by the executive department of ecological management under the State Council.

⽂件来评估具体的环境影响和相关的保护措施。但是企业没有提供环境影响评价⽂件供审阅。 根据《中华⼈⺠共和国环境影
响评价法》第16条,国家根据建设项⽬对环境的影响程度,对建设项⽬的环境影响评价实⾏分类管理。建设单位应当按照下
列规定组织编制环境影响报告书、环境影响报告表或者填报环境影响登记表(以下统称环境影响评价⽂件):(⼀)可能造成
重⼤环境影响的,应当编制环境影响报告书,对产⽣的环境影响进⾏全⾯评价;(⼆)可能造成轻度环境影响的,应当编制环
境影响报告表,对产⽣的环境影响进⾏分析或者专项评价;(三)对环境影响很⼩、不需要进⾏环境影响评价的,应当填报环
境影响登记表。建设项⽬的环境影响评价分类管理名录,由国务院⽣态环境主管部⻔制定并公布。

review, the facility did not provide the EIA approval for construction project for review. In accordance with The PRC
Environmental Impact Assessment Law Article 22, The construction unit shall submit the Environmental Impact Report
or Environmental Impact Report Form of the construction project to the authorized executive department of ecological
management in accordance with the regulations of the State Council for examination and approval. The state implements
register management for Environmental Impact Registration Form. 2.No environmental protection acceptance checks report
for completed construction project. During facility tour, auditor found that products in the facility are metal products, and the
main processes are Die casting, punching, polishing, coloring, assembling, inspection and packaging, the waste gas, noise and
hazardous waste which generated during manufacturing would cause influence on the environment. However, during document

review, the facility could not provide the environmental protection acceptance check approval for their construction project
for review. In accordance with the Measures for the Administrative Regulation on Environmental Protection of Construction
Projects Article 17, After the completion of the construction project which requires compiling Environmental Impact Report
or Environmental Impact Report Form, the construction entity shall carry out inspection and acceptance for the ancillary
environmental protection facilities and compile the acceptance report in according with the standards and procedures provided
by the administrative department of environmental protection of the State Council.

根据《中华⼈⺠共和国环境影响评价法》第22条,建设项⽬的环境影响报告书、报告表,由建设单位按照国务院的规定报有
审批权的⽣态环境主管部⻔审批;国家对环境影响登记表实⾏备案管理。 2. 企业没有建设项⽬环境保护竣⼯验收。在现场
巡查时,审核员发现企业⽣产的产品为五⾦制品,主要⼯序为压铸、冲压、打磨、上⾊、检验、包装,⽣产过程中产⽣的废
⽓、噪⾳及危险废弃物会对环境造成影响。但在⽂件审核中,企业⽆法提供该建设项⽬的环境保护竣⼯验收报告供审阅。 根
据《建设项⽬环境保护管理条例》第⼗七条,编制环境影响报告书、环境影响报告表的建设项⽬竣⼯后,建设单位应当按照国
务院环境保护⾏政主管部⻔规定的标准和程序,对配套建设的环境保护设施进⾏验收,编制验收报告。
