It gives us immense pleasure to announce the 3rd edition of JUSTIFIED- National Moot Court
Competition 2018, to be organized by the Law Centre-II, Faculty of Law, University of Delhi. Such
competitions act as a perfect opportunity for students to nurture their advocacy and drafting skills. As
one of the pioneer institutions of law in India, we have always endeavoured to impart quality legal
education incorporating modern teaching methodologies which help in polishing legal acumen of our
students.

Encouraged by the overwhelming response of the last two editions, we are proud to declare that we
will be hosting JUSTIFIED’2018- the 3rd National Moot Court Competition from the 23 rd to 25th of
March, 2018, at Law Centre-II, Faculty of Law, Umang Bhawan, Chattra Marg (North Campus),
University of Delhi, Delhi-110007.

The Faculty of Law, established in 1924, is one of the oldest and the largest law schools in the country
and its Library is also among the largest law libraries in the country. It enjoys a pre-eminent national
and international reputation for excellence. The school attracts students from every state of India and
more than 20 countries of Asia, Europe, America and South Africa. It has over 6000 students and 120
full-time faculty members anytime on its rolls. The illustrious alumni of this institution include Judges
of the Supreme Court and High Courts, Ministers of Union and State Governments, civil servants, and
many of India's leading lawyers. The Faculty of Law has been pioneer in introducing 3 years LL.B.

Law Centre - II (THE HOST)
The Law Centre-II was started in the year 1971 at the premises of ARSD College, Dhaula Kuan to
offer full-time LL.B. program. It has a glorious past of 46 years. The Centre has excellent professors
of national and international repute. The Law Centre-II had the privilege of being headed by the top
law scholars of India, such as Prof.Upendra Baxi, Prof. Tahir Mahmood and Prof. A.K. Koul.

In 2016, due to Legal Education Rules, 2008, which prohibits the classes of LL.B. being conducted in
the evening, Law Centre-II has taken a new avatar. It has been shifted from the ARSD College
premises to the state of the art building (Umang Bhawan) in North Campus. Now the classes
commence at 8:00 AM and go upto 1:30 PM. Adding strength to the centre is its well-qualified and
dedicated faculty for the overall development of the students which help them to become innovative
legal professionals and public leaders.

The former In-charges of Law Centre-II paved the way to make the Centre one of the premier
educational institutions imparting education in law in the country. Presently, Dr. V. K. Ahuja is In-
charge of Law Centre-II, a dynamic leader in the field of legal education. Law Centre-II has produced
many Judges, distinguished jurists, leading advocates, ministers and some of the best teachers in the
country. Its alumni include Mr. K. J. Alphonse, Minister of Tourism and Information Technology, His
Excellency Mr. B. D. Mishra, Governor of Arunachal Pradesh, Justice B.D. Ahmed, Justice Kailash
Gambhir, Justice S.N. Dhingra, Justice Rajiv Shakdhar, Justice V.K. Rao, SEBI Chairman Mr. M.
Damodran, TDSAT Chairman Mr. G.D. Geha,among many more legal luminaries.

The Centre brings out an Annual Peer Review Publication National Capital Law Journal regularly
since 1996. The Centre has a number of societies viz. the Legal Aid Society, the Moot Court Society,
the Seminar and Conference Society etc. which remain active throughout the year in organising
various programmes and competitions. A substantial number of students from the Centre act as para
legal volunteers (PLVs) every year. The Centre organizes a number of seminars, workshops,
conferences, guest lectures, debates, and Moot Court Competitions. There are a number of
Scholarships and Medals instituted by the Centre to honour meritorious students of the Centre.

PART I: DEFINITIONS

1.1 “Appellant” means the party which is in appeal before the Court.

1.2 “Competition” means JUSTIFIED 2018 - 3rd National Moot Court Competition.

1.3 “Court Master” refers to the student volunteer who shall be entrusted with duties such as
maintenance of order in a courtroom during a round and letting speakers know the time duration for
which they’ve spoken.

1.4 “Knock out rounds” means the Quarter-Final, the Semi-final and the Final rounds of the
Competition

1.5 “Memorial” means the written arguments submitted, on behalf of both the appellant and
respondents, according to the official competition rules by each Team. Memorials are also referred to
as written pleadings.

1.6 “OC” means the Organising Committee as constituted by the management of Law Centre II,
Faculty of Law,University of Delhi.

1.7 “Participants” means those persons eligible to participate and registered under below rules.

1.8 “Researcher” means the team member whose role is confined to preparation of the Memorial and
is not allowed to speak in the oral rounds.

1.9 “Respondent” means the party against whom appellant is in appeal before the Court.

1.10 “Rules” means these official Competition Rules and any applicable supplements to these Rules
published by the Organizing Committee.

1.11 “Speaker” refers to the members of the team who will be pleading before the Judges in the oral
rounds.

1.12 “Valedictory Ceremony” refers to the closing ceremony of the JUSTIFIED 2018 - 3rd
National Moot Court Competition, wherein the distribution of prizes shall also take place.
PART II: GENERAL

1. TEAM ELIGIBILITY

All Law Colleges and Law Schools recognized by the Bar Council of India are eligible to participate
in the competition.
Students enrolled in 3 Year or 5 Year law programme at the time of the competition are eligible to
compete in the competition. Students pursuing Master’s Degree in Law or any post graduate degree
in Law are not eligible to be team members.
Only ONE team from each Law College/School shall be permitted to register.

2. TEAM COMPOSITION

2.1 The team shall comprise of two speakers and one researcher, all of whom shall be regular
bonafide students of the Law Schools recognized by the Bar Council of India.

2.2 Any changes in the composition of team shall be informed and addressed to Mr. Ankush
Bhardwaj, Moot Court Convener( +919990332052) or can be addressed through sending an email at
justifiedmoot2018@gmail.com, latest by February 28th, 2018.

3. NUMBER OF PARTICIPATING TEAMS

3.1 Thirty Six (36) teams only shall participate in the Competition, on first come first serve basis.

3.2 In case there is an odd number of participating teams, organizers will nominate a non-competing
dummy team that will not proceed beyond preliminary rounds.

3.3 Team members must carry current identity-cards issued to them by their institution. Team
members will not reveal their identity or of their college during the progress of the competition, in the
memorials, and even if requested by judges, failing which the team will face disqualification.

4. OFFICIAL LANGUAGE

The official language of the Competition shall be English. All Competition Rounds including the
written submissions (Memorials) will be in English.

5. DRESS CODE

The teams are expected to follow a strict dress code of western or Indian formals.
Men are required to wear a Black suit with a white shirt and a black tie. Women are required to wear
a white shirt, Black trousers/skirt and a black blazer or Salwar kameez and black blazer. Advocate’s
gown and white band are not allowed.

6. CLARIFICATIONS TO THE COMPETITION MODULE

6.1 Teams may submit written requests for clarifications regarding the moot proposition and rules.

6.2 Requests for Clarifications must be received by us by February 15th, 2018. All clarifications will
be issued on February 20th , 2018.

7. ACCOMODATION

7.1 Accommodation will be provided only to participants (not more than three) and shall be for the
duration of the competition only i.e. from 23 rd March to 25th March, 2018. Students shall have to make
their own arrangements after 25 th March 2018. No accommodation will be provided for teams from
colleges in Delhi and NCR.

7.2 Food and Transportation to and from the venue shall be provided to all the teams for the
aforementioned duration.

7.3 The teams are requested to inform the organizers in advance of their arrival details by filling up
the travel form annexed herewith as so as to enable them to make the necessary arrangements.

PART III: REGISTRATION

8. REGISTRATIONS

8.1 The last date for registration for the competition is February 25th, 2018. Soft copy of the duly
completed registration form completely filled and duly signed by the Head of the participating college
along with scanned copy of the Demand Draft must be submitted by email to
justifiedmoot2018@gmail.com.

8.2 All teams shall be given a ‘‘Team Code’’ by the OC on validation of their Registration Form and
Demand Draft. Thereafter the teams shall use their designated “Team Code” for all correspondence
with the Organizers.

9. REGISTRATION FEE

9.1 Registration fee for participation in the Competition is INR 4500/- (Rupees Four Thousand Five
Hundred Only).
9.2 Registration fee is to be paid by Demand Draft drawn in favour of “Registrar, University of
Delhi” payable at New Delhi.

9.3 Scanned copy of the draft must be submitted by email to justifiedmoot2018@gmail.com by

February 25th, 2018.

9.4 Hard Copy of the draft along with the registration form and travel form must reach the following
address by February 28th, 2018:

PART IV: MEMORIALS

10. SUBMISSION OF MEMORIALS

10.1 All memorial submissions must conform to the following general criteria. Teams will be
penalized for failure to abide by these requirements.

10.2 Soft copy of Memorials for both sides has to be submitted by March 15th, 2018 by email to
justifiedmoot2018@gmail.com.

10.3 All teams have to submit 5 hard copies of Written Memorials for each side which shall reach the
office at the address above mentioned in point 9.4 either by post or by hand latest by March 20th,
2018. The cover page of the memorials for the Appellant shall be in Blue and for Respondent shall be
in Red.
10.4 Delay in the submission of memorials will attract a penalty of 2 marks per day up-till a period of
one week (7 days). A delay beyond the stipulated 7 days, will make the team ineligible for the “Best
Memorial” award.

10.5 Once the memorials have been submitted, no revisions, supplements, or additions will be
allowed

11. CONTENTS OF MEMORIALS

Memorials must contain the following:

i. Cover page stating Title of the Competition, Name of the Court, Name of the Case, Title of the
document (viz. “Memorial for the __”) and Team Code should be mentioned on top corner of right
hand side in a square box.

iv. Statement of Jurisdiction

v. Statement of Facts

vi. Statement of Issues

vii. Summary of Arguments (not exceeding 1 page)

viii. Arguments Advanced (not exceeding 20 pages)

12. FORMAT OF MEMORIALS

Memorials shall be made and submitted as follows:

i. Microsoft Word document (compatible with Windows)

ii. Cover: Do not use plastic, leather bound or hard bound material. Use ordinary card paper.

iii. Cover Page: Blue cover for Appellant; Red cover for Respondent.

iv. Total number of pages of memorial should not exceed 35;

v. Summary of Argument should not exceed one page;

vi. Argument advanced should not exceed 20 pages;

vi. Numbered: Bottom-Centre.

vii. Font size and spacing: A memorial shall be printed on one side of the A4 size page only. The
text font for the main body shall be 12, Times New Roman with line spacing of 1.5 and text font for
the footnotes shall be 10, Times New Roman with font spacing of 1.0. Font size for the cover page
may be 14 or 12. The memorials should have a margin measuring one inch on all sides of each page.
The character spacing should be normal and neither expanded nor condensed.

viii. The participating teams should include Header and Footer in their memorials to the effect that the
Header should mention the full Name of Competition and the Footer should mention the side on
whose behalf memorial is submitted along with Page Number at Bottom Center of the Page.

ix. Para Spacing: 2 for text, 1.5 for footnotes.

xi. Soft copies: Memorial for each side shall be a single document. The document file shall be named:
“TEAM CODE_ Memorial for Appellant” and “TEAM CODE_ Memorial for Respondents”. The
subject of the mail submitting memorials shall be: “Memorial – Name of the college”; e.g.:
“Memorial – ABC College”.

xii. The memorials should not contain the name of the participating college in any part thereof. Also,
no logo or any mark of identification should be made in the memorials. Non-compliance with this rule
will lead to immediate disqualification.

13. ADHERENCE OF MEMORIALS TO PRESCRIBED FORM AND CONTENT

13.1. Memorials that do not comply with above specifications will suffer penalty points.

13.2. Memorials of other team received during a round shall be returned to the Court master
immediately after the round is over. Teams shall not put any mark or matter on such memorial
received.

14.1. PRELIMINARY ROUND

i. Preliminary rounds will be held on 24th March, 2018.

ii. There will be two preliminary rounds of argument per team, once as Appellant and the other
as Respondent.
iii. No team will face each other more than once in the Preliminary Rounds.
iv. Each team will face a different Bench in their second round of Arguments.
v. Teams will be provided with their opponent team’s memorials after the conclusion of the
draw of lots.
vi. Top eight (8) teams will qualify for the quarter-final rounds. The qualification to the
quarterfinals will be based on oral score of preliminary rounds and Memorial scores of the
teams.
vii. The teams are required to submit the opposite side memorials to the court master after the
conclusion of each round.
viii. The Best Advocate will be decided on the basis of the scores of the Preliminary rounds only.

14.2. QUARTER FINAL ROUNDS

i. The Quarter Final rounds will be held on 24th March, 2018 and shall be a knockout round.
ii. The teams will be provided with their opponent's memorial after declaration of preliminary
results and the draw of lots for the Quarter Final Rounds.

14.3. SEMI FINAL ROUNDS AND FINAL ROUND

The Semi-Final Rounds and Final Round will be held on 25 th March, 2018 and shall be knockout
rounds.
15. RESEARCHER TEST

Researcher Test will be held on 24 th March, 2018. Best Researcher shall be adjudged on the basis of
this test. The test will comprise of questions relating to the Problem, both legal and factual. The
questions may also test the knowledge of the Researcher in basic areas of laws pertaining to the
problem. The test would be for duration of an hour.
16. TIME AND MARKING SCHEME FOR ORAL ROUNDS

i. Each team will get a total of 30 minutes to present their case in preliminary rounds and each
speaker should speak for a minimum of 10 minutes. While for the Semi-final and Final
rounds, each team will be permitted a total time of 45 minutes and a speaker shall not use
more than 25 minutes of the total time.
ii. The time includes questioning by judges. Rebuttal would be allowed only to the petitioner.
Sur rebuttal would be allowed at the discretion of judges but shall not be allowed in
preliminary rounds.
iii. The oral arguments have to be confined to the issues presented in the memorials.
iv. The maximum time taken for rebuttal/sur-rebuttal shall be 5 minutes.
v. Passing of notes to the speaker by the researcher will be allowed through court masters.
vi. Teams would not be allowed to use any electronic devices like Laptops, LCD Projector and
Video camera during oral pleadings.
vii. At the commencement of each session the team shall notify the Court master as to the
division of time between the 2 speakers (including rebuttal/sur-rebuttal).
viii. Judges’ decision on conduct of proceedings will be final in their court.

PART VI: MISCELLANEOUS

20. CONFIRMATION OF TRAVEL ITINERARY

Participating Teams must confirm their travel itinerary by February 25 th, 2018 and communicate the
same to the OC by email at justifiedmoot2018@gmail.com.

21. ORGANISERS’ EXTRA-ORDINARY POWER

21.1. All Participants are expected to maintain decorum in the Court during the competition and are
expected to conduct themselves in a manner befitting the legal profession. The OC reserves the right
to take appropriate action for any unethical, unprofessional and immoral conduct.

21.2. The OC decision as regards the interpretation of rules or any other matter related to the
competition will be final and binding.

21.3. If there is any situation which is not contemplated in the rules, the OC decision on the same
shall be final and binding.

21.4. The OC reserves the right to vary, alter, modify, or repeal any of the above rules without any
prior notification, if so required and as they may deem appropriate.

21.5. Any issue or matter concerning the Competition will be decided by the OC . Any grievance may
be addressed to the Professor-In-Charge, Law Centre-II, Faculty of Law whose decision will be final.

22. SCOUTING

22.1. Teams will not be allowed to observe the orals of any other team till the time the team is
declared to have advanced to the next round. Scouting is strictly prohibited. Scouting by any of the
teams will result in disqualification.

22.2. Any team can file a written complaint with the OC, regarding a case of scouting. The decision of
the OC will be final.

23. COPYRIGHT

23.1. Upon completion of the competition, the OC reserves the exclusive right to use the memorials
submitted to them, as they deem appropriate. The copyright over the memorials submitted for
participation in the competition is assigned by participants and shall also vest completely and fully in
Law Centre- II, Delhi. The participants shall certify in writing the originality of materials contained
therein and shall be responsible for any claim or dispute arising out of the further use and exhibition
of these materials.

23.2. Further use and exhibition of these materials, electronically or otherwise, shall be the exclusive
right of Law Centre- II, Delhi, and they shall not be responsible for any liability to any person for any
loss caused by errors or omissions in this collection of information, or for the accuracy, completeness,
or adequacy of the information contained in these materials.

23.3. Distribution of these materials on affiliated websites does not constitute consent to any use of
this material for commercial redistribution either via the Internet or using some other form of
hypertext distribution.
24. DISCLAIMER

24.1. The material in the moot proposition is not intended to and does not attempt to resemble any
incident or any person living or dead and is fictitious and any resemblance to any incident or person,
if any, is not intended, but merely co-incidental.

24.2 Participating teams should carry with them ID card issued by the college and required study or
reference materials for their own use during the oral rounds of competition.
