CONTRACT TO LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and entered into this 6th day of November 2023 at Blk 2 Lot
14 Carmona Estates Phase 7A Barangay Lantic, Carmona City, Cavite, Philippines, by and
between:

JESSIE EVANGELIO GARCIA, of legal age, Filipino, Single, with residence address at
Block 6 Lot 3 PUPA Homes 1 PUPA Road, Putatan, Muntinlupa City, Philippines
(hereinafter referred to as “LESSOR”)

-and-

JEAN CLAUDE NUNAG WOLF, of legal age, Filipino, with residence address at 26
Flaviana St. Suarezville Pinagbuhatan Pasig City, Philippines (hereinafter referred to as
“LESSEE”)

WITNESSETH: That

WHEREAS, the LESSOR is the owner/manager of the house residence located at Block 2 Lot
14 Carmona Estates Phase 7A Barangay Lantic Carmona City, Cavite, Philippines;

WHEREAS, the LESSEE wishes to occupy and lease the abovementioned house residence
under the following terms and condition;

NOW, THEREFORE, for and in consideration of the foregoing premises, the terms and conditions
are hereinafter set forth:

1. FEES, PAYMENT SCHEMES AND SCHEDULES

A. Subject property of this contract is being leased for a sum of TWENTY-FIVE THOUSAND
PESOS (Php 25,000.00) per month.

B. The lease term is fixed for one year, from November 2023 until November 2024.

C. Payment must be made every 15th day of each month, during the lifetime of this Contract
to Lease, without necessity of demand.

D. Payment must made in cash, or bank transfer.

E. As a guarantee to the religious and updated payment of the rental fee, the LESSEE shall
pay the amount of SEVENTY-FIVE THOUSAND PESOS (Php 75,000.00) in cash to the
LESSOR, equivalent to one-month advance, two months deposit.

2. OCCUPANCY

A. That, the LESSEE may occupy the rented property upon of full payment of the agreed
deposit and advance payment.

B. That, the LESSEE shall use the leased premises for residential purpose only and cannot
sub-lease the subject premises as the same is solely for the LESSEE and his/her
immediate family.

C. That, the LESSEE or his/her immediate family or guest may not do any of the following:
(A). Bring in any illegal substance or deposit any unlicensed firearms/explosives or
anything that predisposes the premises to fire hazard. (B). Take care of pets or
domesticated animals. (C). Make writings, signs, or drive nails on any place or place
anything that will deface the original condition of the premises. That, should the LESSEE
wish to make some improvements, extensions, or embellishment, due to extreme
necessity and convenience, prior permission and approval must first be obtained in
writing from the LESSOR; however, should the LESSEE finally decide to remove these
attachments, it can be done only if the removal shall not deface, deform, and destroy the
original conditions of the premises, otherwise, the same shall form part of the subject
premises, without obligation of the LESSOR to make any refund for expenses incurred by
the LESSEE.

D. That, the LESSEE shall provide at its own expense receptacles which city ordinances
required to hold and contain waste matters, garbage and refuse and shall deposit within
its own premises until city garbage trucks come to collect.

E. That, the LESSEE may not transfer this CONTRACT OF LEASE to another person
without written permission from the LESSOR nor allow any former tenant with bad
account to stay within the leased premises. Violation thereof, will be a ground to
terminate this contract.

3. INCLUSIONS

For documentation, enumerated below are the following appliances, fixtures and pieces
of furniture are all in good working conditions which are included in the house being
leased:

A. 1 Unit split type Air condition, Samsung (1 horsepower)


B. 1 Unit split type Air condition, Samsung (2 horsepower)
C. 1 Unit L-shape Sofa/Couch (Large)
D. 1 Unit Dining Set
E. 1 Unit Wooden Double deck bed
F. 1 Unit 50-inch LCD TV, Samsung with ROKU
G. 1 Unit small refrigerator, Panasonic
H. 2 Unit plastic cabinets

4. MAINTENANCE OF THE PROPERTY

A. That, the LESSOR is given the authority to make routine inspections in the premises
subject of this lease, or to make any major repairs of the premises and must not be
obstructed or barred of his movements: and minor repairs on plumbing and electrical
such as replacements of broken faucets, switches, sockets, outlets and clogged drainage
and interior painting shall be for the LESSEE'S account. That the obligations of the
LESSOR for repair are limited only to the roof of the lease premises and the LESSEE
cannot withhold rental payment for any reason whatsoever.

B. That, the LESSEE shall be solely responsible for the payment of electric, water,
telephone, cable and internet bills used and consumed by him/her; failure to pay any
such bill shall deprived the LESSEE of such services.

C. That, the LESSEE shall be responsible in diligently preserving the good and working
conditions of the appliances, fixtures and pieces of furniture enumerated in this contract.

D. That, the LESSOR is not responsible for whatever losses, damages caused by fire,
termites, bugs, faulty electrical circuits and security devices, leaking roof and plumbing
fixture, Acts of God/nature, vandalism, and theft, including that of parked vehicles.

E. That, the LESSOR reserves the right to refuse the LESSEE the use of electric facilities
and water service to LESSEE, if rental is delayed for fifteen (15) days from due date. The
LESSOR reserves the right to padlock the premises and refuse service or to further admit
within the premises the LESSEE, if rental is delayed exceeding thirty (30) days. The
LESSEE hold LESSOR free from any civil or criminal liability arising from the preceding
unilateral disruption of electric and water services and refusal of entry of LESSEE by
LESSOR. Nothing in this contract shall be interpreted as giving to the LESSEE total right
over the premises. The LESSOR's right to protect his rights, property and interest herein
is paramount in this contract.

F. The LESSEE agrees to this condition precedent to his being accepted as a LESSEE
herein.

4. DEFAULT, TERMINATION OR CANCELLATION

A. Prior to reimbursement of rent deposit, LESSEE must show proof that all accounts and
contracts made by LESSEE with any utility company is free from any liability, with all
obligations fulfilled. However, should the LESSEE leave the premises with an un-expired
period of the CONTRACT OF LEASE, or pre-terminate this CONTRACT OF LEASE
during its period of effectivity, all deposits made shall be forfeited in favor of the LESSOR.

B. Should the LESSEE be delinquent in payment of rent for at least one (1) month, and has
failed to notify LESSOR of LESSEE whereabouts, LESSOR may start the process of
having the leased premises declared abandoned.

C. Should LESSEE abandon the leased premises, the LESSOR shall have the right to enter
therein, take custody of the furniture, equipment and fixtures thereon, upon proper
inventory in the presence of any duly authorized Barangay Representative. It is hereby
agreed and stipulated that the leased premises shall be considered deserted or
abandoned, if the LESSEE should fail to answer the demand letters of the LESSOR or to
come and see the LESSOR to make arrangements for any claims against said LESSEE,
not limited to criminal matters within the premises of the building or matters with other

tenants residing in any of the buildings under this management, within seven (7) of the
demand. After a period of seven (7) days from the inventory of unit, if LESSEE still fails to
communicate with the LESSOR, LESSOR ceases to be responsible for the safe keeping
of items inventoried and can then proceed to dispose of said items to recover whatever
indebtedness due to the LESSOR. Demand by written communication given to any
person found in the lease premises or if no person is found therein, by posting a copy of
the notice at the door of the leased premises, will be considered sufficient demand for
purposes of this action.

D. That, the LESSOR shall have the first lien on all properties and goods of LESSEE,
situated or kept in the premises to secure payment of rent due under this lease. In case
of default of payment by LESSEE the LESSOR, may without process of law, take
possession of, and sell said properties as may be sufficient to pay the delinquent rent or
indebtedness. The LESSEE shall not remove, or attempt to remove properties, and
LESSOR or its agents is hereby empowered to seize and detain the same until LESSOR
is fully paid for such rent as shall then be due under the terms of this CONTRACT OF
LEASE.

E. That, in case of conflict on any provision of this contract, the parties herein in accordance
with the Supreme Court/IBP circular shall submit themselves for compulsory arbitration
before the Brgy. Lupon; In case one (1) of the parties refuse or fail to appear after either
written or verbal notice had been given, the Barangay.

IN WITNESS WHEREOF, the parties have hereunto signed this CONTRACT TO LEASE on the
and at the place first above written.
