I am concerned for the petitioner in the abovenamed matter. Be pleased to place
on for Physical Hearing the aforesaid Writ Petition bearing no. 2158 of 2017
before Hon’ble Justice Nitin Jamdar and Hon’ble Justice M. M. Sathaye
on ____________.

URGENCY: - That although this Honourable High Court vide order dated

19/06/1967 has held that the acquisition for the Petitioner land has

‘LAPSED’ and further upheld by Supreme Court in Civil Appeal no.

1616-1621 and 1411-1413 dated 11/10/1976 [Reported in AIR 1977

Supreme Court 183] wherein the Honourable Supreme Court has ordered

the Respondent no.1 to initiate afresh acquisition. That although No Award

us 11 of the Land Acquisition Act 1894 nor an Award under Section 32 of

MIDC Act has been passed, the Respondent no.1 (in contradiction to the

Order of this Honourable High Court and the Supreme Court) has sold the

privately owned land of Petitioners for Crores of Rupees without ever

acquiring the same, by trampling upon the petitioner's right to due

procedure established by law and right to Property as enshrined under

Article 300-A of the constitution.

Hence, it is humbly prayed that the Writ Petition no. 2158 of 2017 be

placed for ‘Urgent Hearing’ before the Hon’ble Justice Nitin Jamdar and

Hon’ble Justice M. M. Sathaye on ____________.
