SPECIAL ELECTION GUIDELINES OF THE BOARD OF DIRECTORS


FOR THE TERM UNEXPIRED TERM OF 2023

1. Number of Board of Directors to elect


Thirteen (13) Board of Directors

2. Voters
2.1 Qualifications
2.1.1 An eligible voter is a registered homeowner listed in the Master List of
the Association on the date of the election
2.1.2 Who has updated accounts three (3) months prior
to the Election Day and not declared as Delinquent
Member as per Revised 2021 IRR of RA 9904
2.1.3 Long term lessee. Long term lessee must submit a contract not less than
one (1) year and a written consent / authorization from the owner of
the housing unit informing the Association that he/she is waving
his/her right to be a member

2.2 Proxy Voting


A homeowner who will vote by means of proxy shall submit the following nine
(9) days before the date of election: March 19, 2023, on or before 5:00PM
2.2.1 His/her written authorization for his/her proxy to participate in
his/her behalf; A proxy form will be provided by the HOA Secretary
2.2.2 His/her email address and/or contact number and that of his/her
proxy;
2.2.3 Scanned copy of his/her and his/her proxy’s valid IDs with photo
with residence address and signature.
2.2.4 See Section 58. Proxies RA- 9904 - IRR-Magna Carta for HOA

2.3 Posting of Names of Qualified Voters List

3. Qualifications and Requirements of Candidates for the Position of Board of


Directors
3.1. Must be a Filipino citizen
3.2. Must be of legal age
3.3. Must be a registered homeowner.
3.2.1 Spouses may run for Board of Director if
1. The TCT stated that ownership is within spouses;
2. If registered photocopy of the marriage certificate will be presented
to the HOA Secretary alongside of the Certificate of candidacy.
3.2.2 Parents, siblings, sons or daughters is not
qualified to run for the position of Board of
Director in lieu of the member if the member will
issue a letter informing the Association that
he/she is waving
his/her right to be a member and passing it
on to the above stated personalities. See revised
IRR otherwise known as Magna Carta of HOA.
3.2.3 Long term lessee. Long term lessee must submit a notarized contract
or lease not less than two (2) years and a notarized written consent
/ authorization from the owner of the housing unit informing the
Association that he/she is waving his/her right to be a member and
membership will be given to the long term lessee.

3.4. Must be a member in good standing as of three (3) months prior to the date
of election
3.3.1 Must be paid on monthly dues, other fees and
assessments until
December 2022
3.3.2 Clearance signed by the HOA Secretary and HOA Treasurer

3.3.2 Must attend all meetings called by Election Committee. Proxy on


meetings is not allowed.

3.5. Must be an actual resident for at least six (6) months as certified by the
Association Secretary

3.6. Has not been convicted by final judgment of an offense involving moral
turpitude
3.7. Updated Resume
3.8. Certified True Copy of any of the following
3.7.1. Transfer Certificate of Title or eCAR
3.7.2. Tax Declaration
3.7.3. Deed of Sale
3.7.4. Deed of Absolute with Assumption of Mortgage

3.7.5. Deed of Conveyance if acquired through BFS


3.7.6. Affidavit of Undertaking if acquired through NHMFC or HDMF Note:
Item No. 3.7.3 – 3.7.6 should be notarized and all items should be
filled out.
3.7.7. Long term lessee can be given by the owner the rights to vote,
however can’t be elected in executive positions such as; president,
vice president, treasurer, secretary & auditor but only board of
directors, BOD.

4. Filing of Certificate of Candidacy


The Certificates of candidacy shall be filed with the General Assembly’s
Nominated, Elected and Ratified Election Committee (EleCom) who shall have a
ministerial duty to receive said Certificates of Candidacy. Only the received
Certificate of Candidacy shall be consolidated and reviewed by the EleCom to
determine the candidates’ right to be voted in accordance of the guidelines.

5. Meeting with the Aspirants


A meeting will be then called by the Election Committee to all aspirants who
submitted complete requirements for a deliberation. Once qualified, the Election
Committee will then discuss the rules of procedures and calendar of activities of
the election.

6. Posting of names of qualified candidates


The Assigned Official of the ELECOM shall prepare a consolidated list of
candidates for the Board of Directors and shall post said list and respective
updated resume, duly signed by the ELECOM official, either in the covered court,
bulletin board, village main gate and other conspicuous place.

If within three (3) days from posting of the list of candidates after office hours,

- no objection in writing, indicating the grounds thereof, is filed with the


ELECOM, all the candidates so listed, shall be deemed qualified to vote and
be voted
- no appeal for disqualified aspirant in writing is filed, all disqualified
candidates can no longer be a candidate for 2023 HOA Elections

7. Campaign Period
Campaign period is nine (9) days. Campaigning during the Election Day shall be
strictly prohibited. Last day of Campaign Period will last until 5:00PM only.
Liquor ban will be implemented to the candidates a before, during and after the
election.

PROCEDURE FOR FACE-TO-FACE VOTING


(subject to current IATF and LGU Rulings)
Voters Identification
Only homeowners and tenants/renters whose names appear in the Qualified
Voter’s list shall be allowed to vote. No names of members or proxy will be added
on the day of Election.

Voting Procedure

1. Upon arrival, the EleCom will have the member reminded of the observance
of social distancing and if the member has its own pen.
2. Elecom will check the name of the member on the master list of qualified
voters.
3. The EleCom will let the member affix their signature beside his/her name
4. The EleCom will write the ballot number and give to the member.
5. The member will go to the designated area to cast his/her vote after which,
it will be submitted to the EleCom member assigned in the sealed ballot box.
6. The EleCom member will cut the ballot into two and the member will drop
the ballot to the sealed box.
7. The EleCom will let the member sign on the attendance sheet signifying that
the voting is already finished.

At the close of the voting time


The unused ballots shall be marked “UNUSED”, torn into halves and then place
into two separate envelops, each sealed and marked “UNUSED BALLOT”. The
number of unused ballots shall be stated in the minutes of the voting.
Thereafter, the ballot box shall be opened.

Procedure for counting of votes in the voting precinct


a) ELECOM arranges the ballots in piles of 20 ballots each, held together by
rubber bands.
b) An assigned ELECOM official shall start the counting by reading all votes
written on each of the ballots, starting with the first pile.
c) Watchers and the public shall be allowed to view the ballot being read by
the ELECOM official, as well the Tally Sheet and the Tally Board.
d) As votes are read, Taras will be placed on the Tally Sheet and Tally Board
at the same time.
e) After counting all the ballots, Taras will be summed up in words and in
figures both in the Tally Sheet and Tally Board.
f) ELECOM and watchers shall sign and affix their thumbprints on the Tally
Sheets and Tally Board
g) After the counting and signing of the Tally Sheets and Tally Board, the
ELECOM chairman will immediately announce the total number of votes
received by each candidate for the board of directors
h) Place the counted ballots in the envelope for counted ballots and seal and
sign the envelope.
i) Place the accomplished tally sheet in an envelope.

Note: Election Committee must:

1. Ensure that counting of votes shall be conducted at the designated polling


place, start at the designated time, and in the presence of the
representatives of the candidates or parties
2. Ensure that only the EleCom and the representatives of the candidates or
parties are in the designated polling place; that the total number of persons
physically present shall not be more than the maximum number allowed
under the prevailing government – mandated health protocols or measures;
and that all other mandated health protocols or measures are strictly
complied with;

3. To protect the confidentiality of the votes cast and / or secrecy of the voter’s
identity, immediately after the counting of ballots, all ballot papers and
counterfoils shall be placed in separate sealed boxes or envelopes and shall
be opened only if necessary and by the designated HOACD Division Staff of
the DHSUD Regional Office

10. Proclamation of winning candidates


The winning thirteen (13) candidates shall be immediately proclaimed as Board
of Directors. They may immediately or within seven (7) days convene to elect
from among themselves the president, vice-president, secretary, treasurer, and
auditor.

11. Protest
Post proclamation protest may be filed with ELECOM within five (5) days from
winning candidates, specifically stating the grounds thereof. ELECOM shall
resolve the protest within five (5) days from the filing thereof. Should the case
presented would require time for deliberation, ELECOM will communicate with
the protesting party directly for to arrive at a more reasonable deadline.
