AN ORDINANCE AUTHORIZING THE TRICYCLE SERVICE ROUTE OF
WALTERMART (CAPAS) TO ANY POINT OF CAPAS, ESTABLISHING
THE WALTERMART CAPAS TERMINAL, PROVIDING FOR THE
POLICIES, RULES AND REGULATIONS IN ITS OPERATION, AND FOR
OTHER PURPOSES

BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF CAPAS THAT :


Article 1
Title
Section 1. Title. This Ordinance shall be known as the “WALTERMART CAPAS
TRICYCLE SERVICE ROUTE ORDINANCE”, and hereinafter referred to as the
“Ordinance.”
Article 2
Coverage
Section 2. – This Ordinance shall apply to the authority and institution of the
motorized tricycle service route of WalterMart Capas to any point of Capas and the
establishment, operation and management of the WalterMart Capas Terminal
covering motorized tricycles and passenger jeepneys.
Article 3
Definition of Terms
Section 4. Definition of Terms. For purposes of this Ordinance, the following terms
and acronyms shall be understood to mean as:
MOTORIZED TRICYCLE is a kind of a transport vehicle composed of a
motorcycle fitted with a single wheel sidecar or motorcycle with a two wheel
cab operated to render transport service to the general public for a fee.
TRICYCLE FOR HIRE refers to a motorized tricycle which was granted a
valid franchise by the municipal government of Capas.
FRANCHISE is a special privilege conferred by the municipal government of
Capas through the Municipal Land Transportation Franchising and Regulatory
Board to a motorized tricycle to operate as a public vehicle conveyance in the
Municipality of Capas for a fee.
SERVICE ROUTE is the way of passage or line of travel where a tricycle-for-
hire may operate and convey passengers.
ZONE refers to a location composed of several contiguous or adjoining
barangays which were lumped into a particular area.
TERMINAL refers to the WalterMart Capas Terminal located at the parking
space of WalterMart Capas in Barangay Sto. Domingo 1, this Municipality.
PARKING PREMISES pertains to the front paved open area of the
WalterMart Capas facing the MacArthur National Highway.
PARKING SLOTS is an area within the parking premises of WalterMart
Capas which is specifically designated to passenger jeepneys and motorized
tricycles.

PASSENGER JEEPNEY is any motor vehicle covered with a valid Certificate


of Public Conveyance (CPC) and registered as “jeepney for hire” with the
Land Transportation Office.
MTFRB is the acronym for the Municipal Land Transportation Franchising
and Regulatory Board;
TODA is the acronym for Tricycle Operators and Drivers Association;
CENTRAL BUSINESS DISTRICT ZONE covers the area comprising
Barangays Cut-Cut 1 proper, Cut-Cut 2 proper, Sto. Rosario, Cub-Cub, Sto.
Domingo 1 and Sto. Domingo 2.
SOUTHERN ZONE covers the area comprising the sitios of Buca, Riverside,
Susuba, Almans, Malutung Gabun and Madera, all in Barangay Cut-Cut 1,
and Sitio Salangui in Barangay Cut-Cut 2.
SOUTHWESTERN ZONE covers the area comprising the sitios of Kawili-
wili and Kalangitan in Barangay Cut-Cut 2.
CENTRAL ZONE 1 covers the area comprising Barangays Aranguren proper,
Manlapig and Lawy.
CENTRAL ZONE 2 covers the area comprising Barangay Cristo Rey and the
sitios of Kasulukan, Calumpit Bakle, Aquino Page Village and Sitio Kamatis,
all in Barangay Aranguren.
WESTERN ZONE 1 covers the area comprising Barangay Sta. Lucia from
Sitio Transmitter through Purok 5.
WESTERN ZONE 2 covers the area comprising Barangay O’Donnell from
Sitio San Agustin to Sitio Calanat.
WESTERN ZONE 3 covers the area comprising Barangays Sta. Juliana and
Bueno.
WESTERN ZONE 4 covers the area comprising Barangay Maruglu.
Article 4
WALTERMART CAPAS
MOTORIZED TRICYCLE SERVICE ROUTE
Section 6. WalterMart Capas to any point of Capas Service Route. There is hereby
authorized and instituted the motorized tricycle service route of WalterMart Capas to
any point of Capas to provide public conveyance service to the passengers in
WalterMart Capas. For this purpose, an initial one hundred (100) units of tricycles-
for-hire with existing franchises in the Municipality of Capas shall be granted an
amended franchise to cover the service route herein authorized subject to the
following minimum allotments from different tricycle associations :

In case any TODA does not submit any unit for listing in the WalterMart
Capas service route as herein provided, the allotted units for that TODA shall accrue
to the TODAs in the Central Business District Zone to be determined by the
Sangguniang Bayan.
Section 7. Submission of Qualified Units. In determining the motorized tricycle units
as specified above which shall be authorized and instituted in the service route of
WalterMart Capas to any point of Capas, each of the concerned TODA shall draw
lots from among their members who are willing and qualified to be authorized and
instituted in the said service route. The President of the concerned TODA shall then
submit the list of the motorized tricycle units drawn from their TODA to the MTFRB.
Section 8. Grant of Amended Franchise. Upon such submission to the MTFRB, the
MTFRB shall submit the same to the Sangguniang Bayan which, upon verifying the
validity of the existing franchise of the motorized tricycle units included in the list,
shall grant the amended franchise for the service route of WalterMart Capas to any
point of Capas thereto.
The existing franchise of the motorized tricycle units which were granted an amended
franchise for the service route of WalterMart Capas to any point of Capas shall be
deemed revoked and cancelled.
Section 9. Association. The motorized tricycle units which were granted an amended
franchise for the service route of WalterMart Capas to any point of Capas shall
organize themselves into an association.
Article 5
FARE RATES
Section 10. Fare Schedule. The fare rates for the service route of WalterMart Capas
to any point of Capas shall be as follows :

Article 4
WALTERMART CAPAS TERMINAL
Section 11. WalterMart Capas Terminal. There is hereby established a terminal at
the WalterMart Capas to be situated inside the parking premises of WalterMart
Capas.

Section 12. Parking Slots. The management of WalterMart Capas shall provide at
least fifteen (15) parking slots for the franchised motorized tricycles inside the
parking premises of WalterMart Capas. Another minimum of at least five (5) slots
shall be provided for public utility jeepneys. No terminal fee shall be imposed by
WalterMart Capas on the tricycles-for-hire which were authorized to park inside the
terminal.

Section 13. Administration, Operation and Maintenance of the WalterMart


Terminal. The administration, operation and maintenance of the WalterMart Capas
Terminal shall be supervised by the management of WalterMart Capas which shall
have the following duties and responsibilities:
a) To adopt and enforce rules for orderly vehicle movements and parking
inside the terminal and ensure that vehicles entering and exiting the
parking space of WalterMart will not cause traffic along the MacArthur
National Highway;
b) Aside from the minimum 15 slots for franchised motorized tricycles, to
allow another 6 slots for passenger jeepneys within the parking premises
of WalterMart Capas which shall serve as their terminal;
c) To issue identifying vehicle sticker to all franchised motorized tricycles
and passenger jeepneys which will be accredited to park inside the
terminal;
d) To provide appropriate directional signages and markings within the
parking premises of WalterMart Capas which will guide motorists and
mart-goers on where to go or where to park;
e) To maintain the upkeep of the parking premises of WalterMart Capas and
ensure that it is always clean and free from scattered litters and garbages;
f) To keep the terminal clear of vendors, peddlers, hawkers and illegal
occupants;
g) To maintain peace and order inside the terminal;
h) To require all franchised motorized tricycles and passenger jeepneys
which were designated with terminal slots inside the terminal to submit to
its office the following information :
i. Name & Address of Driver
ii. Copy of Driver’s License

iii. Name of Operator


iv. Copy of Certificate of Registration of motor vehicle
i) To perform all other functions as may be required by an ordinance or by
the Municipal Mayor for the efficient operation of the terminal.

Section 14. Rules and Regulations. The following rules and regulations shall be
observed in the operation of the WalterMart Terminal :
a) The tricycles-for-hire which were granted franchise for the service route of
WalterMart Capas to any point of Capas shall ensure that all the (15) slots
allotted to them inside the parking premises of WalterMart Capas are
always occupied with standby units. They shall ensure that their tricycles
are properly parked on these slots;
b) Maintenance services and repairs of any vehicle shall not be allowed
inside the terminal;
e) Passenger vehicles waiting for passengers must be parked properly on the
parking slots provided for them;
j) Drinking of alcoholic liquor and gambling of any kind shall not be
allowed in the parking premises.
i) To ensure cleanliness and maintain sanitation, motorized tricycles and
passenger jeepneys shall provide their own garbage receptacles for bio and
non-biodegradable wastes.

Article 8
Penalty, Amendatory, Separability, Effectivity Clauses
Section 15. Penalty Clause. – Any person violating the provisions of the foregoing
Sections shall be penalized as follows:
First offense ……………… Php 500.00

Third offense ………......... Php 2,500.00
Fourth offense ………… Cancellation of Franchise
Section 16. Amendatory Clause. – All Ordinances, Resolutions, Orders, Memoranda
and other Issuances inconsistent herewith are hereby amended, repealed or modified
accordingly.
Section 17. Separability Clause. If, for one reason or another, some part of this
Ordinance is found to be invalid or unconstitutional, all other provisions hereof not
affected thereby shall remain to be in full force and effect.
Section 18. Effectivity Clause. This Ordinance shall take effect immediately after
fifteen (15) days following the completion of its full publication in any newspaper of
general circulation in the Province of Tarlac.
