RESOLUTION ENACTING AN ORDINANCE PRESCRIBING THE NEW

TARIFF RATES FOR ALL PASSENGER TRICYCLES PLYING THE ROUTE
WITHIN THE TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF
ISULAN AND FOR OTHER PURPOSES

WHEREAS, brought to the attention of this Honorable Body for deliberation is the
proposal to prescribe the new tariff rates of all passenger tricycles plying the route within the
territorial jurisdiction of the Municipality of Isulan and for other purposes;

WHEREAS, the tricycle associations have petitioned for the increase of fare to cushion
the ill effect of the unprecedented soaring prices of fuel, oil and lubricants and other basic
commodities which adversely affected the very source of livelihood of the operators and drivers;

WHEREAS, this Honorable Body recognizes the urgency of increasing the existing
passenger tricycle fare which is under the foregoing circumstances is no longer feasible and
reasonable, hence, new tariff rates shall be prescribed;

WHEREAS, the tariff rates prescribed herein shall be temporary until such time that the
gas price will restore to its normal state;

NOW, THEREFORE, after due deliberation and upon motion of Hon. Arnold H. Armada
duly seconded by Hon. Carlo F. Apiado Hon. Rene F. Aristoza and Hon. Mariblithe A.
Cartujano-Garingo and Hon. Ryan M. Dumaran, be it:

RESOLVED, as it is hereby resolved to enact Municipal Ordinance No. 2022-267 ISB, to

wit:

AN ORDINANCE PRESCRIBING THE NEW TARIFF RATES OF ALL

LEGITIMATE TRICYCLES PLYING THE ROUTE WITHIN THE TERRITORIAL
JURISDICTION OF THE MUNICIPALITY OF ISULAN IMPOSING PENALTIES
FOR VIOLATION THEREOF AND FOR OTHER PURPOSES.

Be it ordained by the Sangguniang Bayan of Isulan in its Regular Session assembled:

Section 1. TITLE. This Ordinance shall be known as “The New Tricycle Tariff Rates
Ordinance of the Municipality of Isulan.”

Section 2. SCOPE. This Ordinance shall cover all passenger tricycles plying the
route within the territorial jurisdiction of the Municipality of Isulan.

Section 3. DECLARATION OF POLICY. In adherence to the mandate of R.A. 7160

otherwise known as the Local Government Code of 1991 particularly Section 447 (3) (vi), it is
hereby declared as a policy of this Municipality to provide for regulations on tricycles plying the
route within the territorial jurisdiction of the Municipality. For purposes of convenience, both for
tricycle operators and drivers on the one hand and for the riding public on the other, a new Tariff
Rates is hereby prescribed and made as a matter of law and policy.

Section 4. MINIMUM FARE. As an amendment to Municipal Ordinance No. 2018-

222 ISB, this ordinance prescribes the new minimum fare as follows:

Passenger’s Minimum Fare ₱15.00

Senior Citizens/ High School/
College Students/ PWDs ₱12.00
Elementary Students ₱7.00

Section 5. ROUTES COVERED BY THE MINIMUM FARE. It is hereby established

routes covered by the minimum fare of ₱15.00 with the landmarks as point of origins as
provided hereunder as follows:

a) From the Public Market to all points bounded by Don F. Buencamino Avenue up to
KINGS COLLEGE in Kalawag I and going East to Old Capitol, SKSU-Isulan
Campus, INHS and Capitol Centro in Kalawag II ;

b) From the Public Market passing along Ninoy Aquino Avenue going South but not
exceeding to Isla Adelina, Kalawag I;

c) From the Public Market passing the National Highway going to Dansuli but not
exceeding the junction road to Galinato Village;

d) From the Public Market going West to Kalawag III Elementary School;
e) From public market going east to Kalawag Bridge along National Highway.

Section 6. NEW TARIFF RATES. As an amendment to Municipal Ordinance No.

2018-222 ISB, there shall be prescribed new Tariff Rates exceeding the Minimum Fare for all
routes starting to and from the Public Market which shall be as follows:

Passenger’s Minimum Fare 15.00

Senior Citizens/ High School/College
Students/ PWDs 12.00
Elementary students 7.00

maximum distance of 2 kms. the basic fare is P15.00.

Section 7. MISCELLANEOUS RULES AND REGULATIONS. As provided in

existing ordinances and all applicable rules and regulations provided in the Traffic Code, the
following are strictly prohibited:

a) Overloading of passengers. The tricycle is deemed overloaded when it carried more

than six (6) passengers;

b) Hanging passengers or top loading of passengers;

c) Running at a speed more than forty (40) kilometers per hour in the poblacion area;

d) Willful refusal to convey passenger/s;

e) Other rules and regulations incorporated in existing ordinances which are applicable
and not inconsistent with the provisions of this ordinance shall likewise be
punishable.

f) All tricycle drivers shall wear shoes, long pants and T-shirts while driving. Wearing of
sleeveless is strictly prohibited.

g) All tricycles shall use the outer lane of the highway.

h) Wearing bonnet is strictly prohibited.

Section 8. MANDATORY POSTING OF TARIFF RATES. Every operator or owner

shall post the new Tariff Rates herein fixed inside the side car, most probably, at the left front
side of the side car for the same to be easily visible before the riding public.

Section 9. IMPLEMENTING RULES AND REGULATIONS. The Municipal Tricycle

Franchising and Regulatory Board (MTFRB) created under Municipal Ordinance No. 2001-129
ISB, within ten (10) days after the approval of this ordinance, shall formulate additional
implementing rules and regulations for the effective and efficient implementation of this Section.

Section 10. PENALTY. Any violation of the provisions of this shall be punished with a
fine ranging as follows:

First Offense - ₱1,000.00

Second Offense - ₱1,500.00
Third and succeeding offenses - ₱2,500.00 plus revocation of
Franchise to operate

Section 11. REPEALING CLAUSE. Tariff Rates provided in Municipal Ordinance No.
2018-222 ISB is expressly repealed and such other ordinances relative to tricycle operation, or
any provision thereof, which are inconsistent with the provisions of this ordinance are hereby
repealed or modified accordingly.

Section 12. APPLICABILITY CLAUSE. Rules and Regulations and other prohibitory
provisions of the Traffic Code are all hereby adopted and shall form an integral part of this
ordinance.

Section 13. SEPARABILITY CLAUSE. If, for any reason, any part or provision of this
ordinance is held invalid or unconstitutional by a court of competent jurisdiction, the remaining
provisions not affected thereby shall remain in full force and effect.

Section 14. EFFECTIVITY. This ordinance shall take effect upon its approval and
after its publication in a newspaper of local circulation.
