“ENDORSING TO THE OFFICE OF THE MAYOR, THRU THE OFFICE OF THE

MUNICIPAL ENGINEER, FOR APPROPRIATE AND IMMEDIATE ACTION RESOLUTION
NO. 265-22, SERIES OF 2022 OF THE SANGGUNIANG PANLALAWIGAN - ENJOINING ALL
LOCAL GOVERNMENT UNITS (LGUs) IN THE PROVINCE OF SURIGAO DEL SUR TO PUT UP
A SIGN AGAINST DRIVING UNDER THE INFLUENCE OF ALCOHOL”

WHEREAS, presented during the January 3, 2023 regular session was the SP Resolution No.
265-22, series of 2022, as above-titled, for appropriate action of all Local Government Units of this
province;

WHEREAS, Section 5 of Republic Act No. 10586, otherwise known as the Anti-Drunk and
Drugged Driving Act of 2013 provides that, “it shall be unlawful for any person to drive a motor vehicle
under the influence of alcohol and other dangerous drugs and/or other similar substances”;

WHEREAS, Sec. 19-2 (c) under Ordinance No. 06, s. 2014 – Amending Ord. No. 2, s. 2008 –
“Providing rules and regulations for the traffic management within población proper of this municipality
to supplement the traffic rules and regulations of the LTO and providing fines and penalties for violations
thereof, provides the following penal provisions for driving while under the influence of liquor or
prohibited drugs; viz:

First Offense - 500.00

Second Offense - 1,000.00
Third Offense - Confiscation of driver’s license and recommendation
to LTO for total disallowance to drive;

WHEREAS, drunk driving is among the leading causes of road traffic deaths and injuries
worldwide as it impairs a person’s judgment, reaction time, and ability to make sound decisions; but
despite these dangers, governing laws on road traffic are still being ignored by many Filipinos;

WHEREAS, the august Body, after thorough discussion, has found the appeal to be rational as
there is an absolute need to address this concern to deter the continued rise of road crashes and injuries
attributed to drunk driving; hence this endorsement.

NOW, THEREFORE:

BE IT RESOLVED, by the Sangguniang Bayan of Barobo, Surigao del Sur, to:

ENDORSE TO THE OFFICE OF THE MAYOR, THRU THE OFFICE OF THE

MUNICIPAL ENGINEER, FOR APPROPRIATE AND IMMEDIATE ACTION
RESOLUTION NO. 265-22, SERIES OF 2022 OF THE SANGGUNIANG
PANLALAWIGAN - ENJOINING ALL LOCAL GOVERNMENT UNITS (LGUs) IN THE
PROVINCE OF SURIGAO DEL SUR TO PUT UP A SIGN AGAINST DRIVING UNDER
THE INFLUENCE OF ALCOHOL

RESOLVED FURTHER, to attach SP Resolution No. 265-22, series of 2022 for reference;

RESOLVED FINALLY, to furnish copies of this resolution to the following dignitaries and
personalities for their information, guidance, and appropriate action:

1. The Honorable Mayor;

2. The Mun. Engineer;
3. The BPLO;
4. The Sangguniang Panlalawigan

ADOPTED: this 3rd day of January 2023, on motion of Hon. Richard B. Balahay; duly
seconded by Hon. Arnel A. Templanza and Hon. Narciso A. Moresca.
