“Committee Report of Hon. Alan R. Arrojado, Chairman of the Committee on Police Matters, on “Barangay
Ordinance No. 2020-20 of Barangay San Isidro enacted under Resolution No. 2- 2020, “AN ORDINANCE
MANDATING THE CLEARING OF ROADS AND THEIR EASEMENTS WITHIN THE BARANGAY OF SAN ISIDRO,
PROVIDING OTHER MEASURES FOR ROAD SAFETY THEREIN, AND IMPOSING PENALTIES FOR
VIOLATORS THEREOF AND FOR OTHER PURPOSES”, AN ORDINANCE MANDATING THE CLEARING OF
ROADS AND THEIR EASEMENTS WITHIN THE BARANGAY OF SAN ISIDRO, PROVIDING OTHER MEASURES
FOR ROAD SAFETY THEREIN, AND IMPOSING PENALTIES FOR VIOLATORS THEREOF AND FOR OTHER
PURPOSES”

Ladies and Gentlemen:

“The Committee on Police Matters submits its committee report on the above-stated Barangay
Ordinance of San Isidro, which was referred to this Committee, on the basis of the following representations:

Backgrounder:

The Barangay Council of San Isidro enacted an Ordinance mandating the clearing of roads and their easements
within the barangay, providing other measures for road safety therein and imposing penalties for violators.

Applicable law/s:

“The Local Government Code of 1991”

Section 16. General Welfare. - Every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective
governance, and those which are essential to the promotion of the general welfare. Within their respective territorial
jurisdictions, local government units shall ensure and support, among other things, xxxxxxx, maintain peace and
order, and preserve the comfort and convenience of their inhabitants.

“DILG Memorandum Circular No. 2019-121 enjoining local officials to exercise their powers essentials to reclaim public roads
which are being used for private ends and in the process, rid them of illegal structures and constructions to ensure the speedy
and smooth flow of vehicular traffic.”

Barangay Ordinance No. 2020-20 of Barangay San Isidro, enacted under Resolution No. 2-2020, “AN ORDINANCE
MANDATING THE CLEARING OF ROADS AND THEIR EASEMENTS WITHIN THE BARANGAY OF SAN ISIDRO,
PROVIDING OTHER MEASURES FOR ROAD SAFETY THEREIN, AND IMPOSING PENALTIES FOR
VIOLATORS THEREOF AND FOR OTHER PURPOSES”, AN ORDINANCE MANDATING THE CLEARING OF
ROADS AND THEIR EASEMENTS WITHIN THE BARANGAY OF SAN ISIDRO, PROVIDING OTHER MEASURES

FOR ROAD SAFETY THEREIN, AND IMPOSING PENALTIES FOR VIOLATORS THEREOF AND FOR OTHER
PURPOSES”, is based on the pertinent Provisions of Republic Act (RA) 7160 and the directive per DILG MC No.
2019-121.

“Recommendations

APPROVAL of Barangay Ordinance No. 2020-20 of Barangay San Isidro, enacted under Resolution
No. 2-2020, “AN ORDINANCE MANDATING THE CLEARING OF ROADS AND THEIR EASEMENTS WITHIN
THE BARANGAY OF SAN ISIDRO, PROVIDING OTHER MEASURES FOR ROAD SAFETY THEREIN, AND
IMPOSING PENALTIES FOR VIOLATORS THEREOF AND FOR OTHER PURPOSES”, AN ORDINANCE
MANDATING THE CLEARING OF ROADS AND THEIR EASEMENTS WITHIN THE BARANGAY OF SAN ISIDRO,
PROVIDING OTHER MEASURES FOR ROAD SAFETY THEREIN, AND IMPOSING PENALTIES FOR
VIOLATORS THEREOF AND FOR OTHER PURPOSES”, the same being enacted under the ambit of the legislative
power bestowed by law in the concerned sanggunian, and is anchored on the pertinent Provisions of Republic
Act (RA) 7160 DILG MC No. 2019-121, which actually provides to preserve the comfort and convenience of
the inhabitants.

Now, therefore, on motion of Hon. Alan R. Arrojado, duly seconded by Hon. Allen A. Arquillano and was
carried unanimously by all the Members presents and ASSEMBLED in session,

RESOLVED, that the above stated report be adopted and the recommendation embodied therein be, and is
hereby APPROVED.

11TH SANGGUNIANG BAYAN OF SAN FRANCISCO, CEBU THIS 3RD DAY OF MARCH 2020.
