SECTION- I
LETTER OF INVITATION

The SBI Rural Self Employment Training Society (SBIRSET Society), Kerala is a
society registered with the Registrar of Societies under the Travancore- Cochin
Literacy Scientific and Charitable Societies Act, 1955 having Registration No.
TVM/TC/370/2020 and function as per its own Byelaws. The sole ownership
and responsibility for and under this tender document and any subsequent
agreement or documents on the same will be on the said SBIRSET Society alone.

Sealed tenders, under “two bid system with price bidding through e-
tendering”, are invited from reputed, experienced and financially sound
Companies/Firms/Tenderers/Service Providers registered with Regional Labour
Commissioner, Government of India, for supplying qualified manpower for
outsourced services of Skilled / Semi-skilled / Unskilled manpower to be
engaged at RSETIs of SBI Rural Self Employment Training Society (SBIRSET
Society), Kerala on Contract Labour basis for specified period.

without assigning any reason thereof.

The SBIRSET Society reserves the right to cancel the tender process at any stage
without assigning any reason and EMDs or Bank Guarantees will be returned
without interest in such a case.

SECTION- II
Notice of Inviting Tender (NIT)

The SBI Rural Self Employment Training Society (SBIRSET Society), Kerala,
invites bids for providing manpower services on outsourcing basis to the SBI
RSETIs in Kerala State as per the detailed terms and conditions indicated in this
tender document.

1. Period of Contract:

The contract is valid for a period of three years from the date of issue of
work order based on compliances with the applicable statutes, rules,
regulations etc. The performance of the Service Provider shall be reviewed
after the first three months, before confirming the contract. On completion
of the validity period of the contract, same may be renewed at the sole
discretion of the SBIRSET Society with new agreement of contract for a
further period of three years depending on the satisfactory performance
including compliances with the applicable statutes. However the
Charges/amount payable to the Contractor for rendering the Service under
the Contract as agreed at the time of awarding the contract shall remain
fixed and valid throughout the currency of the contract and the extended
period, if any, and no request for enhancement shall be entertained or
permitted under any circumstances by the SBIRSET Society.

Contractor should provide manpower services to the SBIRSET Society as


per the detailed terms and conditions indicated in this tender document
without any interruption on all working days of the Society (“the Services”).

2. Availability of Tender Document:

The Tender forms can be downloaded from the website of SBI,


http://www.sbi.co.in under Procurement News. Though the Tender
Document is carried in the website of SBI, it is made clear that this RFP is
issued by SBI Rural Self Employment Training Society (SBIRSET Society),
Kerala and not by the State Bank of India (SBI).

3. Earnest Money Deposit (EMD):

(a) The Bidders are required to furnish Earnest Money Deposit (EMD) of
Rs. 1,00,000/- (Rupees One Lac only) in the form of Demand Draft
obtained from any scheduled commercial bank, drawn in favour of the
SBI Rural Self Employment Training Society (SBIRSET Society),
Kerala, Payable at Thiruvananthapuram. The EMD of unsuccessful
bidders would be returned without any interest.

(b) The EMD shall be forfeited if the Service Provider fails to submit the
Performance Security Deposit or commence the work as per the work order
or in the event of withdrawal of offer during the validity period of offer or
non-confirmation of acceptance of work order within the stipulated time
after issue of work order by the SBIRSET Society.

(c) Micro and Small Enterprises (MSEs) as defined in MSE Procurement Policy
issued by Department of MSME are exempted from payment of EMD. This
Exemption can only be availed on submission of a valid certificate issued
by the Competent Authority.

4. Submission of tender documents:

Tender documents and Technical Bid, duly completed in all respects along
with all the required supporting documents should be submitted to the
Secretary, SBIRSET Society, C/o Assistant General Manager (LB), State Bank
of India, 3rd Floor, Local Head Office, Poojappura, Thiruvananthapuram-
695012.

Price bid need not be submitted in physical form. Price bidding shall be done
online through e-tendering portal of M/s E-Procurement Technologies Ltd.
The bidder shall register himself in the portal, prior to the date of e-tendering
and obtain used ID & Password for logging in. The bidder shall contact M/s.
E-Procurement Technologies Ltd for any assistance.

5. Opening of Bids:

The Technical bids shall be opened by the Tender Evaluation Committee in


the presence of the bidders or their representatives on 19/05/2022 at 3.00
PM at SBIRSET Society, C/o SBI, LHO, Poojappura, Thiruvananthapuram-
695012. However Bids would be opened even in the absence of any or all the
bidders or their representatives.

The Bidders qualified in the Technical Bid evaluation shall only be allowed to
participate in the online price bidding through e-tendering portal of
M/s E-Procurement Technologies Ltd.

It is mandatory for the representatives of bidders to produce an authorization


letter issued by the participating firm/entity and the authorized
representatives shall submit the authorization letter and his/her Identity
Card to prove the identity.

6. Pre-qualifying criteria:

The bidder (Manpower Service Provider – “the MSP”) should have,

(i) In currency a valid Labour License under Section 12(1) of the Contract
Labour (Regulation and Abolition) Act, 1970 and the Rules thereunder.

(ii) Registered with ESI, EPF, Service Tax and GST authorities and must be in
possession of Permanent Account Number (PAN).

(iii) Successfully executed / completed similar business/works of supply of


skilled/ semi-skilled / unskilled manpower to Central Government
Departments, Autonomous Bodies, Universities and Public Sector
Undertakings for a minimum period of not less than five (5) years ending
as on 31st March 2021.

(iv) Have a minimum average annual turnover of Rs. 30,00,000/- (Rupees


Thirty Lacs Only) for the previous three Financial Years as on 31.03.2021
from the business as above.

(v) Have provided a minimum of 100 (One Hundred) outsourcing personnel in


organization for three years in the last five (5) years.

(vi) Have a proper functioning office in the State of Kerala as on the date of
submission of bid.

Satisfactory documents in support of the above should be submitted along


with the tender.

7. Specific conditions for non- acceptance of bids:

Bids of the following categories shall not be entertained/accepted:


 Bidder is a regular employee/ contract employee / temporary employee /
outsourcing employee / project employee / employee of any outsourcing
service provider / employee of start- up company having tie-up/
partnership with the SBIRSET Society or State Bank of India or a relative
of any employee of the above mentioned categories.

 Bidders without valid registration and license under the relevant statues.

 Bidders with legal suit/criminal case pending or contemplated against the


company, proprietor or any of its Directors (in case of Pvt. Ltd. Company) or the
firm or partners (in case of partnership firm) on grounds of impropriety or for
violation of any of the laws in force.

 Existing or any previous- service provider(s) having outstanding dues


pertaining to salaries or statutory payments like ESI, EPF etc.

 Bidders who did not complete the similar work awarded earlier or exited
from the subsisting contract due to reasons attributable to them or
withdrew during the currency of the contract.

 Bidders debarred/black-listed/removed/prosecuted by public sector


undertakings/public sector banks/ departments like Railway, Defense or
any other department of Government of India / State Government or any
other Organization/ Government Agencies / law enforcement agencies.
The SBIRSET Society is at liberty to make independent enquiries with
reference to the affidavit furnished by bidder. The decision of the SBIRSET
Society shall be final in this regard.

 Parties whose contracts were cancelled by the entities referred above- for
any illegality or gross violation.

8. Affidavit:

An Affidavit / declaration on non- judicial stamp (NJS) paper of Rs. 200/-


duly attested by Notary Public, shall be submitted in the following format:

a. That the bidder or any of its partners/ directors/ employees/ workers are
not regular employee(s)/ contractual employee(s) / temporary
employee(s)/ outsourced employee(s)/ project employee(s)/ of SBIRSET
Society or State Bank of India.

b. That, there is no legal suit/ criminal case pending or contemplated against


the company, proprietor or any of its Directors (in case of Pvt. Ltd.
Company) or firm or partners (in case of partnership firm) or against the
bidder / proprietor of the firm (in case of the proprietorship concern) on
grounds of impropriety or for violation of any of the laws in force.

c. That, the Bidder should furnish hereunder the details of past or present
contract(s), they have with the SBIRSET Society or SBI or any of the
erstwhile associate banks of SBI, (if the information is NIL, it should be
stated as ‘NIL’).

QUALIFICATIONS, SALARY & OTHER REQUIREMENTS OF THE SUPPORT


STAFF:

i. As per the extant guidelines, each RSETI may need 2 Faculty members,
2 Office Assistants, 1 Attender/ Watchman.

ii. The Faculty members and other staffs should have the Minimum
Qualifications and other requirements as specified in the table below.

iii. Desirable age for all outsourced positions is 22-40 years.

iv. Salary of the Faculty members and other staffs should not be less than
the Minimum salary/wages as per the Human Resources Policy framed
for RESETIs by Ministry of Rural Development, Government of India
and as specified in the Section X of this Tender Document.

JOB DESCRIPTION OF SUPPORT STAFF OF RSETIs

A. FACULTY

1. Work as Faculty of the Institute handling sessions relating to


entrepreneurship, motivation, personality development, business
management, conducting business game etc, guiding / educating the trainees
and coordinate the programmes of the Institute.

2. Conducing pre training activities including awareness programmes,


generation of application and selection of candidates.

3. Assisting the Director in preparation of Annual Action plan, designing


customized training Programmes and evaluation of training.

4. Organizing logistics for the training programmes, including training materials


and guest faculty.

5. Handling sessions relating to motivation, entrepreneurship, market survey,


Business Opportunity Guidance, Business plan preparation, launching
formalities and enterprise management aspects (closing, pricing, inventory
management, marketing, customer relations, etc.)

6. Drawing the training curriculum well in advance and fix the resource persons.

7. Providing post training escort services including follow up meets/visits.

8. Preparation of Business plans/Project report for RSETI trained


entrepreneurs.
9. Providing counselling, credit linkage, marketing linkage support etc., to the
trained entrepreneurs.

10. Preparation of success stories/case studies of entrepreneurs.


11. Collection of settlement details from the settled candidates and
updating in MIS.

12. Maintaining and updating of MIS pertaining to the training and post
training activities.

13. Preparation of training session notes, post programme report, monthly


progress report and Annual Activity Report.

14. Organising the functions, events and meetings of the institute.

15. Preparation of press release/reports on the activities of the institute for


media coverage.

16. Supervising the work of the Office Assistant, (checking of day book and
general ledger) sub staff, watchman of the Institute.

17. Monitoring the performance of Guest Faculty (skill training).


18. Maintenance of Fixed assets and Library of the institute.

19. Overseeing the maintenance/upkeep of campus including class rooms,


kitchen, dining hall and dormitories.
20. Maintaining the records of premises/campus of the Institute and all
Fixed Assets including Furniture and fixtures and library books of the
Institute.
21. Maintaining discipline and punctuality in the Institute including the
practices of DAILY ATTENDANCE, PRAYER, MILLY, YOGA and
SHRAMADAAN.

22. Any other work / responsibilities, entrusted by the Director.

B. OFFICE ASSISTANT

1. Assisting the Director and Faculty in functioning of the Institute to achieve


the objectives of the organisation.

2. Maintaining and updating the day book/cash book, General Ledger,


preparation and maintenance of vouchers, maintaining the accounts in MIS,
preparation of monthly and annual receipt and payment statement by
following the prescribed procedure for managing the accounts of the Institute.

3. Maintaining the books and registers of the Institute (Manual or Electronic).

4. Maintaining and updating all data relating to trainings, Follow- up,


Settlement etc.

5. Creating, maintaining and updating data relating to training and all the
activities of the Institute in MIS.

6. Preparation of periodical reports to be submitted to the controlling office,


Ministry and other Agencies.

7. Organizing the required logistics for the training programmes including


boarding and lodging to the trainees.

8. Making registration of candidates for the training, taking daily attendance in


the training as well as for boarding.

9. Post training follow up of trainees and submission of report to the Director.

10. Maintaining of Library books and issuing books to the trainees as and
when they demand.

11. Updating the trainee’s follow up cards of all batches.

12. Upkeep of premises/campus of the Institute and all Fixed Assets


including furniture and fixtures and library books of the Institute.

13. Carry out all the instructions/any other work entrusted by the Director
and faculty from time to time.

C. ATTENDER / WATCHMAN

1. Generally all subordinate work of the institute for assisting the Director and
other staff of the Institute for smooth functioning of the day to day activities.

2. Up keeping of premises including office, training class rooms, dormitory,


bathrooms, filing Cabinet, visitors lounge, etc.

3. Filing the documents in respective files as per the directions of office


Assistant/Faculty/Director.

4. Going to Bank branches for all works like- for getting pass book updating,
depositing cheque, etc. as per the instructions of Director/faculty/office
assistant.

5. Attending to dispatch work and maintaining stationery of the institute.

6. Any other work entrusted by the Director /faculty from time to time.

D. WATCHMAN CUM GARDNER

1. Watch and ward of the premises.

2. Gardening work and maintenance and upkeep of the premises.

3. In Case of need to perform the duties of the attender.

4. Any other work entrusted by the Director/faculty from time to time.

SECTION-III
Procedure for submission

(i) TECHNICAL BID

Tender documents for technical bid shall be submitted in the format specified in
Section- VIII along with all required documents mentioned below, to The
Secretary, SBIRSET Society, C/o Asst. General Manager (LB), State Bank of
India, , 3rd Floor, Local Head Office, Poojappura, Thiruvananthapuram-695012,
in sealed envelope super scribing as indicated below. “Technical Bid for supply
of Manpower Services Tender to SBI RSETIs”.

Envelope - 1. Original demand draft / Banker’s Cheque obtained towards


1 Earnest Money Deposit.

2. Filled in Technical bid form along with the complete set


of tender Document duly signed by the bidder/ authorised
signatory in each page of the same having read, noted and
accepted the contents therein (except Financial bid form).

3. Copies of all supporting documents as required thereof.

Note: Seal the cover properly and super scribe it as “Envelope-1


- Technical Bid-A for supply of Manpower Services Tender to
SBI RSETIs”.

The tender documents for technical bid may be delivered either in person or by
post so as to reach the address mentioned above on or before the due date and
time . The SBIRSET Society will not be responsible for any postal delay / loss /
non-receipt thereof. Tender received after the date / time specified above shall
not be considered under any circumstance.

Information required in Technical Bid typed or neatly written in ink. There shall
be no overwriting / erasures / use of correcting fluid in the Technical Bid and
the bid shall be liable to be rejected on such grounds.

The Tender document shall be signed with seal by the bidder or a person duly
authorised to sign on behalf of the bidder, on all the pages of the tender
document as a mark of acceptance of the terms and conditions of the tender
document.

The Technical bid and all the enclosures are to be serially numbered and signed
by the authorised signatory and sealed with stamp of the service provider / firm
/ company as a mark of having accepted the same. The complete set excluding
price bid shall be stitched or spiral bound so as not to lose sight of any document.

The bidders are advised to mention their name and contact number / email id
on the envelopes in which the bid documents are submitted.

The bidders should also give the superscription mentioned supra in the envelope

and the absence of same may lead to non- consideration of bid-documents.

(ii) PRICE BID

The price bid of the technically qualified bidders will be obtained through e-
tendering through E-procurement Technologies (P) Ltd. The technically qualified
bidders/ short-listed bidders shall register and get user ID & password from the
e-tendering portal of M/s E-Procurement Technologies (P) Ltd. and the same
shall be got approved by the service provider, prior to e-tendering. On the
stipulated date and time of e-tendering, the bidder shall login to the said portal
and enter the rates online in the sealed bid format. The other details like rate in
words etc., will be displayed automatically.

The full terms and conditions for submission of Price Bid is detailed in the
subsequent Sections of this Tender Document.

5. Certificate of Incorporation of Company with Registrar of Companies
under the Companies Act, 1956/2013; Registration of Partnership
firm, sole proprietor etc.
6. Proof of Address.
7. PAN/TAN card issued by the income Tax Department.
8. Income-Tax Returns of the last three financial years, ending March
2021.
9. Certified copies of Annual Reports comprising Balance Sheet and
Profit and Loss Account Income and Expenditure Accounts of the
last 3 years ending 31ST March 2021.
10. Registration under EPF & MP Act, 1952.
11. Registration under Employees State Insurance Act, 1948.

SECTION – IV
METHOD OF EVALUATION
TECHNICAL BID

1. The contract for providing trained, professional and efficient personnel in


the SBI RSETIs campus is made on a competitive tender basis.

2. The Society shall conduct the tender opening in the presence of Bidders or
their designated / authorised representatives at the address, date and time
specified in the NIT. However Bids would be opened even in the absence of
any or all the bidders or their representatives. Only the bidders, who
qualifies the technical bid alone will be allowed to participate in the price
bid. The SBIRSET Society will inform the technical bid qualifiers via e-mail.

3. The Technical Bid would be evaluated by the Technical evaluation


Committee. The bids which do not contain the information as desired or
are not supported by necessary documents including EMD will be treated
as non-responsive and will not be evaluated. Those bids only will be
evaluated, which are determined to be substantially responsive and meet
the requirement set forth by the SBIRSET Society.

4. Those Bidders only whose technically responsive bids as recommended by


the committee would be intimated about the date and time for submitting
online financial bids. The price bid of the technically qualified bidders will
be obtained through e-tendering through E-procurement Technologies (P)
Ltd. and processed further.

5. The selection criteria includes (a) fulfilment of Technical Bid parameters


(b) reputation of the Service provider (c) experience in the relevant field (d)
The quantum of total consolidated charges quoted in the Price Bid.
Fulfilment of all the criteria prescribed in the Technical bid, by the bidder
is the basic requirement for considering the financial bid. The contract
shall be awarded to the responsive lowest Bidder. i.e. the Bidder who has
fulfilled all the criteria prescribed in the Technical bid and submitted the
lowest price bid. The lowest price bid will be decided on the basis of total
consolidated charges quoted through e-tendering of price bid.
Correspondence or queries of disqualified bidders shall not be entertained.

6. The quote shall remain valid for a period of 120 Days from the date of
submission of the Price Bid.

7. Incomplete bids (not furnishing the required information in Technical Bid


or not enclosing supporting documents or conditional bids or bids not
submitted in the prescribed format or bids received after the due date and
time or bids received without EMD) will be summarily rejected. Similarly
Bids in the form of Telex/ Fax/Email/Photography shall not be considered
as valid bids.

8. Each bidder shall submit only one set of tender documents. If a bidder
submits more than one bid, both the bids are liable to be rejected. Bids
received without EMD/ with insufficient EMD will be summarily rejected.

The EMD will be forfeited in the event of withdrawal of the lowest Bidder
during the Bid validity period. The EMD shall also be forfeited on the
events stated in this Tender Document.

9. There shall be no overwriting / erasures / use of correcting fluid in the


Technical Bid and the bid shall be liable to be rejected on such grounds.

10. Bidders shall not be permitted to alter or modify their bids after expiry
of the date of receipt of bids.

11. The lowest bid will be decided on the basis of total consolidated charges
quoted through e- tendering of price bid. If more than one bidder has
fulfilled all the parameters of selection criteria stated against Sl. No. 5 of
Section –IV, the Society reserves the right to choose the eligible Bidder by
following lottery system.

12. EMDs of unsuccessful bidders will be returned to them at the earliest


and at the most on or before the 30th day after awarding of the contract.

13. Failure of the successful bidder to submit the Performance Security


Deposit or to commence the contract within 15 days from the date of award
of contract shall constitute sufficient ground for the annulment of the work
order and forfeiture of the EMD. In that event the Society may, at its
discretion, allot the tender to the next lowest evaluated bidder whose offer
is substantially responsive to the Tender Document and is determined by
the Society to be qualified to perform the contract satisfactorily.

14. Canvassing in any form is prohibited and the bids submitted by the
bidder who resorts to canvassing is liable for rejection.

PRICE BID

A. Business rules for e-tendering of the Price Bid:

 Only technically qualified bidders notified through e-mail by SBIRSET


Society will have to avail the services of e-tendering service provider, M/s.
E-Procurement Technology Pvt. Ltd., who will provide necessary training
and assistance before commencement of online submission of price bids
on Internet.

 The SBIRSET Society will inform the technical bid qualifier/vendor by e-


mail, the details of service provider to enable them to contact and get
trained.

 In case, there is any change in e-tendering service provider, the SBIRSET


Society will inform the qualified bidders suitably at appropriate time.

 Business rules like event date, closing and opening time etc. will also be
communicated through service provider for compliance.

 Bidders have to send by email, the compliance form in the prescribed


format (provided by Service Provider), before start of e-tendering. Without
this the vendor will not be eligible to participate in the event.

 Bidders not qualifying the technical bid shall not be eligible to participate
in the on-line price bidding.

 The e-tendering will be treated as closed only when the bidding process
gets closed in all respects for the item listed in the tender.

B. Terms & conditions of e-tendering:

The SBIRSET Society shall finalize the Tender through e -tendering mode
for which M/s. E-Procurement Technology Pvt. Ltd, Ahmedabad has been
engaged by the SBIRSET Society as authorized service provider. Please go
through the guidelines given below and submit your acceptance to the
same along with your Technical Bid.

a) E-tendering shall be conducted by the SBIRSET Society through M/s.


E-Procurement Technology Pvt. Ltd., Ahmedabad, on pre-specified
date. While the Bidders shall be participating the online e-tendering
from their own offices/ place of their choice, internet connectivity and
other paraphernalia requirements shall have to be ensured by Bidders
themselves. In the event of failure of their Internet connectivity, (due to
any reason whatsoever it may be) it is the bidder’s responsibility and
risk. In order to ward-off such situation bidders are requested to make
all the necessary arrangements /alternatives such as back–up power
supply whatever required so that they are able to circumvent such
situation and still be able to participate in the e-tendering seamlessly.
Failure of power, internet connectivity issues, network problems,
system crash down, etc. at the premises or equipments of Bidders
during the e-tendering cannot be the cause for not participating
in the e-tendering. On account of this the time for the e-tendering will
not be extended and the SBIRSET Society is not responsible for such
eventualities.

b) M/s. E-Procurement Technology Pvt. Ltd., Ahmedabad, shall arrange


to train nominated person(s) of the bidder without any cost. They shall
also explain to the bidders all the Rules related to the e-tendering. The
bidders are required to give their compliance on it before start of bid
process.

c) BIDDING CURRENCY AND UNIT OF MEASUREMENT: Bidding will be


conducted in Indian currency & Unit of Measurement will be displayed
in Online-tendering.

d) BID PRICE: The Bidder has to quote the Bid Price as per the bid format
displayed in the e-tendering portal, as specified in the following para -
Procedure of e-Tendering.

e) VALIDITY PERIOD OF BIDS: The Bid Price shall be firm for the period

specified in the tender document and shall not be subjected to any


change whatsoever. The Bid Price quoted by the Successful Bidder shall
remain valid, firm and fixed during the entire currency of the Contract,
and the extended period, if any.

C. Procedure of e-tendering:

Instructions for the Online Price Bid.


(i) Online e-tendering of the Price Bid would be done by the Society through
the service provider, i.e., M/s. E-Procurement Technology Pvt. Ltd.,
Ahmedabad

(ii) The hardcopy of the Technical bid is available on the SBIRSET Society
website during the period specified in the NIT.

(iii) Online e-tendering is open only to the bidders who are found technically
qualified by the Technical Evaluation Committee for participating in the
price bidding, as per the provisions mentioned hereinabove..

(iv) The rate quoted in the Price Bid should be the total Invoice amount per
month (Total Consolidated Monthly Charges) for providing the Service
to the Society, including the Salary and other payments of the support
staff which should not be less than the Minimum salary/wages as per the
Human Resources Policy framed for RESETIs by Ministry of Rural
Development, Government of India and as specified in the Section X of this
Tender Document.

i. GST amount should not be loaded in the price bid.


ii. The rates should be quoted in Indian Rupees

(v) Within 2 Hours of the closure of the e-Tendering, all Bidders participated
in the Online e-tendering should submit in the prescribed format
mentioned at Section IX of this Tender Document a detailed breakup of the
Bid Price specifying the details of all components/items included in the
Price Bid and the rates thereof, including the Salary and other payments
of each support staff by email from the registered mail id.

(vi) If the Salary/wages quoted by the Bidder for the support staff is found to
be less than the Minimum salary/wages specified in the Section X of this
Tender Document, then the Bid of such bidder will not be considered as
valid and shall be rejected.

(vii) Price Bids of Bidders who fails to submit the detailed breakup of the
Bid Price in the prescribed format and/or within the stipulated timeline,
shall be considered as invalid and shall be rejected.

(viii) The Price Bids in respect of which the detailed break-up is submitted
by the Bidder in the prescribed format and received within the stipulated
timeline shall only be considered for final selection.

ii. The Price-Bid shall be made available online by the Service Provider
wherein the Bidders will be required to fill-in their rates (Total
Consolidated Monthly Charges). The Bidders are advised not to wait till
the last minute to submit their online price bid to avoid complications
related with internet connectivity, network problems, system crash down,
power failure, etc.

iii. It is mandatory to all the bidders participating in the price bid to quote
their rates as per the format prescribed above.

iv. In case, Bidder fails to quote their rates, their tender shall be treated as
“Incomplete Tender” and shall be liable for rejection.

v. After scrutiny of the valid Price Bids and the detailed breakup submitted
by the Bidders, the Bidder who has submitted the lowest Price Bid and
have quoted the Salary/wages for the support staff not less than the
Minimum salary/wages specified in the Section X of this Tender Document
would be selected as the Successful Bidder and asked to submit a Price
confirmation letter. In the event L1 Bidder fails to submit Price
confirmation letter within 24 Hours of communication of the said advice,
his Bid will be rejected and such Bidder will not be allowed to participate
in future tender process of the Society for five years.

vi. In event of rejection of the L1 Bidder as above, the Bank may at it


discretion reserves the right to select the bidder who has given the next
lowest Bid Price as the Successful Bidder and upon such selection, the
said Bidder has to submit Price confirmation letter as mentioned above.

SECTION – V
COMMERCIAL TERMS AND CONDITIONS

1. The successful Bidder shall enter into an Agreement with the SBIRSET
Society on Non- Judicial paper of appropriate value within 21 days of
commencement of work. Non- fulfilment of this condition of executing an
Agreement/ contract document by the Service provider would constitute
sufficient ground for annulment of the award and forfeiture of EMD or
encashment of Bank Guarantee.

2. The conditions of this tender document shall be part and parcel of the
agreement to be executed on getting the contract and the parties will agree
to abide by the same.

3. Performance security deposit (PSD):

The successful Bidder shall furnish a performance security deposit (PSD)


which is equivalent to minimum 5% of the total annual invoice amount
payable to the Service Provider by SBIRSET Society in the form of Term
Deposit with the State Bank of India in the joint names of SBIRSET Society
and the Contractor and all deposit receipt will be kept in the custody of
the SBIRSET Society and the Performance Security Deposit shall be valid
for a period of sixty days beyond the date of completion of all contractual
obligations. However no interest shall be payable on the said amount of
PSD. The PSD shall be forfeited by the SBIRSET Society for non-
compliance of terms and conditions of the Agreement by the Service
provider or frequent absence from duty / misconduct on the part of man
power supplied by the Service Provider or non- compliance with any of the
requirements of the labour laws such as failure to deposit EPF and ESI
etc., amounts with respective statutory authorities by the stipulated dues.

4. Advance payment of any kind will not be paid to the successful Bidder
under any circumstances.

5. The minimum wage as per the notifications issued by the Government from
time to time shall be applicable. There shall not be any deductions from
the salary/wages of the supporting staff other than the statutory
deductions towards contribution of EPFO and subscription to ESIC.

6. The rate quoted in the Price Bid should be the total Invoice amount per
month (Total Consolidated Monthly Charges) for providing the service to
the Society, including the Salary and other payments of the support staff,
which should not be less than the Minimum salary/wages as per the
Human Resources Policy framed for RESETIs by Ministry of Rural
Development, Government of India and as specified in the Section X of this
Tender Document.

7. The Charges payable to the Contractor for rendering the Service shall
remain fixed and valid throughout the currency of the contract and the
extended period, if any, and no request for enhancement shall be
entertained or permitted under any circumstances by the SBIRSET

Society, except in case of any increase of minimum wages as notified by


the Government

8. The service provider shall have submitted a written request to the SBIRSET
Society, for consideration of any increase / decrease of minimum wages by
the Government along with the copy of the concerned notification, at
appropriate time, without any delay. Any increase / decrease in minimum
wages by the Government of India from time to time shall be to the RSETIs
account.

9. The Service Provider shall make payment to the outsourced contractual


staff (the Support Staff) on a monthly basis in the individual Bank
accounts of the outsourcing staff and need to submit proof of the same by
10th of the month to the SBIRSET Society. (Eg: Proof of payment of salary
for the month of January is to be submitted by 10th of February).

10. In case of delayed payment of wages, the Service provider is liable to


pay to SBIRSET Society Rs. 100/- penalty for delay per worker per each
day of delay.

11. The Service provider will submit the invoice / claim to RSETI on a
monthly basis duly supported by proof of disbursement of payment to the
out sourced staff, in triplicate for payment, the Tax-deducted at source
and such other taxes / levies as are required by law are to be deducted on
the total monthly bill of the agency shall be deducted from the charges
payable to the Service provider.

12. The Service Provider shall furnish the consolidated and individual
details of the amount of remuneration of each individual, amount deducted
on account of statutory deductions such as ESI/EPF etc., as employee’s
share and net amount paid to each individual duly supported by details of
payments made to the contractual staff before presenting claim for the next
month.

13. The proof of payment of statutory obligations such as ESI, EPF etc. and
any other applicable taxes must be furnished by the Service provider
indicating the names of the employees and the amount deposited in
respect of each, failing which subsequent payment to the Service Provider
shall be withheld.

14. Payment to Service Provider shall be made on monthly basis. Bill/s


shall be submitted by the Service Provider after completion of every month
duly enclosing therewith

(i) Pay slips of all the personnel deployed under the contract,
(ii) Attendance certified by an officer authorised in this regard by
RSETIs;
(iii) Salary account statement of all the personnel deployed under the
contract showing the payment of remuneration after the statutory
deductions.
(iv) Separate Challans showing proof of remittance of ESI and EPF in

respect of workmen deployed under the contract for previous


month to the respective authorities and,
(v) Quarterly, half yearly and yearly returns required under various
enactments.

The payment to the Service provider shall be released within 15 days


from the date of receipt of invoice provided the claim of the Service Provider
is found to be in order from all angles.

15. The SBIRSET Society reserves the right the Service Provider to deploy
the personnel depending upon the exigencies / needs at any point of time.

16. The Service Provider shall provide the required personnel for a shorter
period also, in case of any requirement of the SBIRSET Society. The Service
Provider shall provide a substitute well in advance in the event of the
person leaving the job due to his / her personal reasons. The payment in
respect of the overlapping period of the substitute shall be the
responsibility of the Service Provider.

17. The successful Bidder shall have to obtain labour licence before
commencement of work from authorities concerned of Labour Department
whatever applicable under the provisions of the Contract Labour
(Regulations & Abolition) Act, 1970 and the rules made there under from
time to time. He shall also ensure renewal of such Licence well before its
expiry.

18. The service provider shall be wholly and exclusively responsible for
payment of wages to the personnel engaged by them in compliance with
all the statutory obligations under all related legislations as applicable to
it from time to time including Minimum Wages Act, 1948, Employees
Provident Fund and Miscellaneous Provisions Act, 1952, Employees State
Insurance corporation Act, 1948 etc. and SBIRSET Society shall not incur
any liability for any expenditure whatsoever on the persons employed by
the Service Provider on account of any obligation.

19. In case, the Service provider fails to make payment of minimum wages
to the personnel deployed under the contract, the Security deposit / other
dues and the amounts running bills under the contract shall be utilized
by SBIRSET Society to discharge primary liability of the Service Provider.

20. No accommodation, any other allowance over and above the amount
given to the personnel so engaged shall be paid for by the SBIRSET Society
under this agreement.

21. The persons provided by the Service provider for the services
mentioned above shall be the employees of the Service Provider for all
intents and purposes and that the persons so deployed shall remain under
the control and administration of the Service provider and in no case, a
relationship of employer and employee between the said employee and the
SBIRSET Society shall accrue/ arise implicitly or explicitly.

22. The personnel so employed by the Service Provider and deputed in the
office of RSETIs shall have no right to employment against any post of the
SBIRSET Society / State Bank of Bank. It is further agreed that their
services are being taken on a purely contractual basis / outsource basis
and the SBIRSET Society reserves the rights to do away with the agreement
as and when so required without assigning any reason.

23. The Service Provider will abide by all the terms and conditions stated
herein and directions given to him from time to time as per the need of the
hour.

24. In case, the Service Provider does not execute the work as per the terms
and conditions of the work order / Agreement, the same shall be got
executed by some other Service Provider and the excess expenditure, ‘if
any’, incurred shall be recovered from the Service Provider’s Security
Deposit / or any other amounts due to Service Provider.

25. The Bidder should have a proper functioning office in the State of
Kerala as on the date of submission of bid and the Service Provider has to
maintain the said office throughout the currency of the contract.

26. No employees or any close relatives of the employees of SBIRSET


Society or State Bank of India are entitled to participate in this tendering
process.

SECTION – VI
GENERAL TERMS AND CONDITIONS

1. By bidding for the Supply of Manpower Tenderer, it is deemed that the


bidder had read and understood the tender document and shall abide by
the terms and conditions scrupulously.

2. The Service Provider shall not assign, transfer, pledge or subcontract the
performance of services under any circumstances.

3. The personnel engaged by the Service Provider shall be the employees of


the Service Provider and shall not entitled to claim any benefit /
compensation/ absorption / regularization of services with the SBIRSET
Society or State Bank of India under any circumstances including under
the provisions of Industrial Disputes Act, 1974 and Contract Labour
(Regulation & Abolition) Act, 1970. An undertaking from the persons to
this effect will be required to be submitted by the service provider to the
Society.

4. The Service provider shall ensure compliance with all laws including
Contract Labour (Regulation & Abolition) Act, 1970, Payment of Wages Act,
1936, The Workmen’s Compensation Act, 1923, Minimum Wages Act,
1948, ESI Act, 1948 and Employees Provident Fund and Miscellaneous
provisions Act, 1952 as amended from time to time.

5. All services shall be performed by persons qualified and experienced in


performing such services.

6. The personnel deployed shall not be below the age of 22 (Twenty Two) Years
and above the age of 40 (Forty) years.

7. The Service Provider shall nominate a Manager who would be responsible


for immediate interaction with the SBIRSET Society, so that optimal
services of the persons deployed by the Service Provider could be availed
without any disruption. Wages for such Managers will not be borne by the
SBIRSET society and the same shall be paid by the Service Provider.

8. The Service provider shall ensure deployment of suitable people after


satisfying itself of proper background verification, including verification
with the local police, collecting proofs of identity like Driving License, bank
account details, previous work experience, proof of residence and recent
photograph and withdraw such employees, who are not found suitable by
the officer for any reasons, immediately on receipt of such a demand.

9. The personnel deployed by the Service Provider shall not have any criminal
record/ cases against them. The Service Provider shall carry out thorough
verification / enquiry with regard to the conduct and antecedents of the
persons whom they would be deploying. A certificate to that extent is to be
submitted to the Society.

10. The SBIRSET Society is entitled, but not obliged to call for records to
audit the verification of personnel deputed / deployed to the RSETIs.

11. The Service Provider has to provide photo Identity Cards to the persons
employed for carrying out the work. These cards to be constantly displayed
and their loss reported immediately to the Service Provider for
replacement.

12. The Service provider shall ensure that individual bank accounts of the
persons deployed are opened in their respective names only and all
payments shall be made through e-transfer only as per the notification
governing minimum wages issued by the Government from time to time.
Payment in cash or by cheque is totally prohibited. Details of bank
accounts of all the persons deployed by the Service Provider shall be
submitted along with the bill for the first month. A certificate that the
wages have been paid in accordance with the said notification should
invariably be furnished by the Service Provider every month.

13. The Service Provider has to open and / or maintain EPF account
under EPF & MP Act, 1952, with The Regional Provident Fund
Commissioner, Thiruvananthapuram in respect of every person deployed
with the RSETIs. A Statement containing names and account numbers of
all the persons deployed with RSETIs shall be submitted with the first bill
of the contract period.

14. The Service Provider has to open and /or maintain ESI account
under ESI Act, 1948with the Regional office of the ESI Corporation,
Thiruvananthapuram in respect of every persons deployed with the
RSETIs. A Statement containing names and account numbers of all the
persons deployed with RSETIs shall be submitted with the first bill of the
contract period.

15. The Service provider shall ensure providing ESI cards to all the
workmen within three months of commencement of work under this
contract to enable them to avail the entitled medical facilities.

16. The Service provider shall submit the copy of the challans and
documentary evidence (ECNR) in support of proof of depositing EPF and
ESI amounts covering both the employee’s and employer’s share, in

respect of persons deployed with the RSETIs and shall entertain queries in
this regard from workers. Any non- compliance by the Service Provider
with regard to the above provisions shall lead to termination of the contract
and forfeiture of PSD.

17. The Service Provider should maintain all the Records/ Registers /
Documents which are necessary under various labour laws applicable to
contract labourers / personnel and also Shops & Establishments Act /
Rules applicable to his / her Establishment and make them available to
SBIRSET Society at all times. The illustrative list of such records include
the following: (a) Register of workmen (b) Employment Card (c) Muster Roll
(d) Register of Wages (e) Wage slips (f) Overtime Registers.

18. The Service provider personnel shall perform their duties effectively
and diligently in accordance with the instructions issued by the RSETIs
from time to time.

19. The Service Provider shall ensure proper conduct of the personnel
deployed in RSETIs and enforce prohibition of consumption of alcoholic
drinks, Paan smoking, loitering etc.

20. The Service Provider’s personnel shall not divulge or disclose any
details of office, operational process, technical know- how, security
arrangements and administrative / organizational matters which are
confidential/ secret in nature, to any person. The Service Provider and all
its personnels engaged in accordance with the arrangement have to
execute suitable undertaking to maintain confidentiality in respect of all
matters pertain to or related the SBIRSET Society or its clients.

21. The Service Provider’s personnel should be polite, courteous, positive


handling the assigned work and their actions shall promote goodwill and
enhance the image of the RSETIs. The Service Provider shall be responsible
for any act of indiscipline on the part of persons deployed by him.

22. The RSETIs shall have right to ask Service Provider to withdraw from
the site of work, any person or persons, employed by the Service Provider,
who may be incompetent or for his / her / their misconduct or services
being not required and Service Provider shall forthwith comply with such
requirements. The service provider shall replace immediately any of its
personnel, if they are unacceptable to the RSETIs because of security risk,
incompetence, conflict of interest and breach of confidentiality or improper
conduct upon receiving instructions from the SBIRSET Society.

23. The RSETI shall not be liable for any loss, damage, theft, burglary or
robbery of any personnel belongings, equipment or vehicles of the
personnel deployed by the Service Provider.

24. The Service provider shall engage the appropriate personnel as


required by the RSETIs from time to time and it shall be the duty of the
Service Provider to pay their wages every month as per the Minimum
Wages Act, 1948, by 7th of the following month. In case of delayed payment
of wages, The Service Provider is liable to pay to Society Rs. 100/- penalty
for delay per worker per each day of delay.

25. Minimum Wages as notified by the Government under the Minimum


Wages Act, 1948 shall be applicable for the Attender and Watchman-cum-
Gardner.

26. In the cases where the minimum wages notified by the Government is
at daily rates, the monthly wages of support staff concerned (i.e., Attender
and Watchman-cum- Gardner) shall be calculated as per the formula
advised in the respective notification issued by the Government. In the
absence of any such formula advised in the notification, the Monthly
Wages shall be calculated as illustrated below:
Monthly Wages = Daily rates notified by Government multiplied by
“X”, where “X” is the number of days in the month concerned excluding
the weekly rest days and 2nd & 4th Saturdays*.
* Note: 2nd and 4th Saturdays to be excluded only if the services are
not rendered on said days.
Payment of the wages components of the support staff concerned (i.e..
Attender and Watchman-cum- Gardner) in the monthly Invoice raised by
the Contractor for the consolidated monthly Charges shall be calculated
as mentioned above and therefore the Contractor shall also pay the
concerned support staff as above.

27. Wherever the Salary/wages of the support staff is specified/notified in


Monthly rates, to arrive at a daily rate applicable for a month, the monthly
rate shall be divided by number of days in the month concerned excluding
the weekly rest days.

28. In case of unpaid leave, for deduction of salary/wages for such unpaid
leave, the per day salary/wages for deduction will be calculated as above.
The payment shall be made to the Contractor after deduction of
salary/wages in respect of any unpaid leave of the support staff as above
and the Contractor shall also pay the support staff as above.

29. Contractor should provide the Services without any interruption on all
working days of the Society. In the event any Support Staff is on

leave/absent, the Contractor should make available suitable substitute


to provide uninterrupted Service on all working days of the Society. Any
non-compliance by the Service Provider with regard to the above provisions
lead to proportionate reduction in the consolidated monthly charges
payable to the Contractor.

30. Any statutory requirement in respect of each personnel of the Service


provider shall be the responsibility of the Service Provider.

31. An attendance Register shall be maintained by the Service Provider for


all the personnel deputed by him, who shall mark attendance daily at the
beginning and at the end of the completion of the duties in the RSETIs and
the payment, shall be made to the Service provider on the basis of
attendance register.

32. The Service provider would be responsible for maintenance of the leave
record of the personnel engaged by the Service Provider. The leave
applications of the outsourcing manpower would be collected and
processed by the Service Provider and the Service Provider would be
responsible to keep record of their leave and follow the relevant Rules, raise
the bill accordingly.

33. Income Tax will be deducted on the gross amount of the monthly bill,
at the rates notified under Income Tax Act, 1961, from time to time by
Government of India. In case, the bidder obtains and submits letter issued
by the Assessing Officer concerned to deduct tax at rates lower than the
prescribed rates, such letter will be acted upon after checking the
correctness of contents of such letter, from the issuer.

34. The Service Provider shall be contactable at all times and message sent
by email / fax / special messenger / SMS / WhatsApp from RSETIs shall
be acknowledged immediately.

35. Any increase / decrease in minimum wages by Government of India


from time to time shall be borne by the SBIRSET Society and the Service
Provider shall submit a formal written request to the SBIRSET Society, for
consideration of any increase / decrease of minimum wages by the
Government along with the copy of the concerned notification, at
appropriate time, without any delay.

Note: GST amount should not be loaded in the price Bid and shall be paid extra
as applicable, by SBIRSET Society. The successful vendor has to submit system
generated GST Tax invoice incorporating Society’s GSTIN and vendor GSTIN
number. Manual GST invoices will not be accepted.

36. Manpower requirements mentioned in this Tender Document is


indicative. It may vary plus or minus 10%.

37. The Contractor shall furnish monthly pay slips in respect of all the
personnel for each month which contains number of working days,
wages, EPF, ESI & any other things being paid to the personnel

38. The Service Provider shall be responsible for any queries from the
Regional / Assistant Labour Commissioner on issues concerning the
personnel deployed with the RSETIs and falling in their jurisdiction.

39. Disputes, grievances, if any, between the Service Provider and the
persons deployed with RSETIs will have to be settled by the Service
Provider only.

40. In case of death or mishap leading to any injury or disability


whatsoever, occurred during discharging the duty, the compensation /
legal or any other liability will solely rest with the Service Provider.

41. The Service Provider should maintain notice boards and display wages,
contract information of ESI, EPF, Labour Department, Principal employer,
Contractor details, periodic circulars issued by the Labour Department
and the Principal Employer should also be displayed.

42. The SBIRSET Society reserves the right to accept or reject any or all
the offers without assigning any reason.

43. The sole authority issuing this tender, processing the same, finalizing
/ executing the agreement and availing the services is SBIRSET Society.
The State Bank of India is not liable or responsible for any such action or
documents. The Service Provider or any of its persons have any right or
remedy against the State Bank of India in any such matters or any other
matter, what so ever arising thereunder.

44. In case, the contract is to be discontinued due to various reasons from


either side, three months’ prior notice is to be served by the Service
Provider or by the SBIRSET Society, as the case may be.

45. In the event of any question, dispute / difference arising under this
contract / agreement the same shall be referred to sole arbitrator to be
appointed mutually or in accordance with the Arbitration and Conciliation
Act. The award of the Arbitrator shall be final and binding on both the
parties. The provision of Arbitration and Conciliation Act, 1996 shall be
applicable.

46. The jurisdiction for settlement of disputes, if any, with regard to


providing services and interpretation of any clause in the agreement, is at
Thiruvananthapuram, Kerala.

47. For clarification, if any, bidders may contact the Secretary, SBIRSET
Society, C/o Assistant General Manager (Lead Bank), FI Department, SBI,
LHO, Thiruvananthapuram on working days between 10.00 AM to 5.00
PM.

48. Disclaimer:- This tender document is issued by the SBIRSET Society


for the services that are to be availed by the SBIRSET Society. The State
Bank of India (SBI) is not directly or indirectly responsible to any person
including a person responding or intent to respond to this tender
document or any person become successful consequent to the tendering
herein or any person employed or engaged by the successful bidder
consequent to this tending process or to any other person or for any other
reason whatsoever. The service provider, if any engaged consequent to the
tendering process herein shall be wholly and exclusively responsible for
the engagement or employment of any person deployed for rendering
services as per this tender document. The SBIRSET Society or the SBI shall
not be responsible for the engagement or employment of any such persons
or to any service conditions related to such person.

SECTION –VII
DECLARATION
1) I/We have gone through the terms and conditions of the SBIRSET Society Tender
Document, (Sections- I to X) NIT NO: 01/2022-23 dated 28/04/2022 meant for
supplying trained, professional and efficient personnel on contract basis to be
engaged at SBI RSETIs in Kerala State.
2) I/We declare that I/we shall abide by the terms and conditions stated in the
Tender Document.
3) I/We shall also abide by the conditions that may be stipulated from time to time
as per the need of the hour by the SBIRSET Society.
4) After going through the terms and conditions and having understood them
completely, I/we intent to submit my/our Price Bid quoting the total
consolidated Monthly Charges for providing the service to the Society,
including the Salary and other payments of the support staff, which should
not be less than the Minimum salary/wages specified in the Section X of
this Tender Document.
5) I/We understand that the rates quoted by me/us in Price Bid has to be
submitted through Tender through e -tendering mode for which M/s. E-
Procurement Technology Pvt. Ltd, Ahmedabad, has been engaged by the
SBIRSET Society as an authorized service provider.
6) I/We understand and agree that in the event of SBIRSET Society awarding
the Contract to me/us, the rate quoted by me/us for rendering the Service
shall remain fixed and valid throughout the currency of the contract and
the extended period, if any, and no request for enhancement other than
the changes on account of increase or decrease in the applicable minimum
wages shall be entertained or permitted under any circumstances by the
SBIRSET Society.
7) I/We shall be held responsible for any damage caused to the SBIRSET
Society property and that I/we shall abide by the decision of the SBIRSET
Society that may be taken under such situations. All disputes relating to
“Supply of Manpower Services” shall be settled with the SBIRSET
Society authorities only.
