MEMORANDUM OF AGREEMENT

This agreement is made and entered into this 14th day of September at Bantay, Ilocos Sur,
Philippines by and between:

The DEPARTMENT OF EDUCATION-SCHOOLS DIVISION OF ILOCOS SUR, an


agency of the government with office address at Quirino Boulevard, Zone V, Bantay, Ilocos Sur,
represented by Schools Division Superintendent, Mr. Jorge M. Reinante, herein referred to as
“DepEd Ilocos Sur”.

-and-
Barangay Alilem Daya (Poblacion) organized and existing under the laws of the
Republic of the Philippines with address at Alilem Daya (Poblacion), Alilem, Ilocos Sur, and
represented in this agreement by its Barangay Captain, Robert B. Lorenzana, herein referred to
as the “PROPONENT”

WITNESSETH:

WHEREAS, the Philippines is one of the countries greatly affected by the COVID 19
Pandemic;

Whereas, in the Ilocos Region, and in the Province of Ilocos Sur, there are still active
cases of COVID 19 as of date;

Whereas, in a televised addresss to the nation, the President of the Republic of the
Philippines expressly stated that no face-to-face classes shall push through unless and until
there will be a vaccine for COVID 19;

Whereas, despite the pronouncement of the President, Department of Education


Secretary Leonor M. Briones stated that education must continue and she has in fact gave a
date on the opening of classes which will be on October 5, 2020;

Whereas, one of the Learning Modalities thought of by the officials of DepEd Ilocos Sur
is through the use of Modular Instruction;

Whereas, because of these pronouncements, DepEd Ilocos Sur has started to find ways
to connect to its learners without face to face interaction;

Whereas, the “Knowledge in a Box” will serve as a mechanism in support of the


Learning Continuity Plan, which contains the modules/Self-Learning Kit (SLK) and health kit of
learners;

Whereas, DepED Ilocos Sur has proposed to the proponent to support the
implementation of the “Knowledge in a Box”.

Now Therefore, for and in consideration of the foregoing premises and the terms and
conditions herein set forth, the parties hereby agree as follows:
Section One: Description of the Agreement

The agreement consists of the distribution and retrieving of the Self-Learning Kit/Health
Kit from the school to the house of the learners by the Barangay Officials, and vice versa.

SECTION TWO: Rights and Obligations of DepEd Ilocos Sur


i. DepEd Ilocos Sur shall provide policy guidance and directions to ensure the proper
implementation of this Agreement;
ii. It shall coordinate with the proponent in the implementation of the Agreement and
accept the assistance of the proponent thru the Schools Division Office;
and
iii. It shall assist in the evaluation and implementation of the Agreement.

SECTION THREE: Rights and Obligations of the Proponent


i. The proponent shall cause the planning and implementation of the agreement;
ii. The proponent shall be entitled to avail and engage the services of knowledge
volunteers to support the implementation of the agreement;
iii. The Proponent shall administer the efficient and effective implementation of the
Agreement. Likewise, It shall coordinate closely with DepEd Ilocos Sur in the
implementation of the Agreement;
iv. All costs in the implementation of the Agreement shall be shouldered by the
proponent, and
v. Precautionary measures shall be undertaken for the health and safety of the
proponent.

SECTION FOUR: Scope of the Agreement


The beneficiary of the Agreement shall be the learners of the aforementioned barangay.

SECTION FIVE: Term of the Agreement


The Agreement shall subsist for the duration of SY 2020-2021.

SECTION SIX: Capacity and Authorization


The parties hereby warrant that they have the capacity, power, and requisite
authorization to enter into this Agreement.

SECTION SEVEN: Separability Clause


Should only part of this agreement be judicially declared null and void, such nullity shall
not affect the validity of the remaining provisions hereof.

SECTION EIGHT: Breach of Contract


The violation or omission of any of the provisions of this Agreement shall be a ground
for the cancellation or rescission of the same without need for legal or court
action.

SECTION EIGHT: Breach of Contract


The violation or omission of any of the provisions of this Agreement shall be a ground
for the cancellation or rescission of the same without need for legal or court
action.

MEMORANDUM OF AGREEMENT

This agreement is made and entered into this 14th day of September at Bantay, Ilocos Sur,
Philippines by and between:

The DEPARTMENT OF EDUCATION-SCHOOLS DIVISION OF ILOCOS SUR, an


agency of the government with office address at Quirino Boulevard, Zone V, Bantay, Ilocos Sur,
represented by Schools Division Superintendent, Mr. Jorge M. Reinante, herein referred to as
“DepEd Ilocos Sur”.

-and-
Barangay Batbato organized and existing under the laws of the Republic of the
Philippines with address at Batbato, Alilem, Ilocos Sur, and represented in this agreement by its
Barangay Captain, Jocelyn M. Sanggawa, herein referred to as the “PROPONENT”.

WITNESSETH:

WHEREAS, the Philippines is one of the countries greatly affected by the COVID 19
Pandemic;

Whereas, in the Ilocos Region, and in the Province of Ilocos Sur, there are still active
cases of COVID 19 as of date;

Whereas, in a televised addresss to the nation, the President of the Republic of the
Philippines expressly stated that no face-to-face classes shall push through unless and until
there will be a vaccine for COVID 19;

Whereas, despite the pronouncement of the President, Department of Education


Secretary Leonor M. Briones stated that education must continue and she has in fact gave a
date on the opening of classes which will be on October 5, 2020;

Whereas, one of the Learning Modalities thought of by the officials of DepEd Ilocos Sur
is through the use of Modular Instruction;

Whereas, because of these pronouncements, DepEd Ilocos Sur has started to find ways
to connect to its learners without face to face interaction;
Whereas, the “Knowledge in a Box” will serve as a mechanism in support of the
Learning Continuity Plan, which contains the modules/Self-Learning Kit (SLK) and health kit of
learners;

Whereas, DepED Ilocos Sur has proposed to the proponent to support the
implementation of the “Knowledge in a Box”.

Now Therefore, for and in consideration of the foregoing premises and the terms and
conditions herein set forth, the parties hereby agree as follows:

Section One: Description of the Agreement

The agreement consists of the distribution and retrieving of the Self-Learning Kit/Health
Kit from the school to the house of the learners by the Barangay Officials, and vice versa.

SECTION TWO: Rights and Obligations of DepEd Ilocos Sur


i. DepEd Ilocos Sur shall provide policy guidance and directions to ensure the proper
implementation of this Agreement;
ii. It shall coordinate with the proponent in the implementation of the Agreement and
accept the assistance of the proponent thru the Schools Division Office;
and
iii. It shall assist in the evaluation and implementation of the Agreement.

SECTION THREE: Rights and Obligations of the Proponent


i. The proponent shall cause the planning and implementation of the agreement;
ii. The proponent shall be entitled to avail and engage the services of knowledge
volunteers to support the implementation of the agreement;
iii. The Proponent shall administer the efficient and effective implementation of the
Agreement. Likewise, It shall coordinate closely with DepEd Ilocos Sur in the
implementation of the Agreement;
iv. All costs in the implementation of the Agreement shall be shouldered by the
proponent, and
v. Precautionary measures shall be undertaken for the health and safety of the
proponent.

SECTION FOUR: Scope of the Agreement


The beneficiary of the Agreement shall be the learners of the aforementioned barangay.

SECTION FIVE: Term of the Agreement


The Agreement shall subsist for the duration of SY 2020-2021.

SECTION SIX: Capacity and Authorization


The parties hereby warrant that they have the capacity, power, and requisite
authorization to enter into this Agreement.

SECTION SEVEN: Separability Clause


Should only part of this agreement be judicially declared null and void, such nullity shall
not affect the validity of the remaining provisions hereof.
