MEMORANDUM OF AGREEMENT

This memorandum of agreement is made and entered into the Municipality of Lagonoy,
Camarines Sur, Philippines by and between

MUNICIPALITY OF LAGONOY with office address at San Francisco, Lagonoy, Camarines Sur
represented by, Delfin F. Pilapil III, Municipal Mayor, hereinafter referred to as LGU.
-and-
LAGONOY HIGH SCHOOL INC. , a private school and a non-profit institution represented by,
President, JOSEFINA B. VALER, hereinafter referred to LHS INC.

WHEREAS, MUNICIPALITY OF LAGONOY, in its concern to enhance the knowledge, skills,


attitudes, and values of prospective business professionals, has agreed to provide actual office
internship through immersion on Office Trainings and Technical Vocational Skills to Senior High
School students of LHS in the form of actual exposure on office management and technical skills.

WHEREAS, LHS INC. has instituted the Senior High School Program under which students of
the Senior High School on (TVL) and General Academic Strand (GAS), to undergo an Office
Internship as part of their immersion training to acquire the necessary knowledge, skills, attitudes,
and values.

NOW, THEREFORE, for and in consideration of the foregoing premises, LGU. hereby agrees
on and stipulates the following:

LGU. and LHS Inc. shall undertake the selection process of the recommended students in
adherence to LGU. policies and guidelines in recruitment and selection for this purpose;

1 .Ensure that the students undergo training related to their course, and provides the student
interns with work or activities that are varied and challenging;
2. As far as practicable, accommodate the students for two (2) alternate semesters, consistent with
the schedule of the Senior High School Program;
3. Provide students with formal training program or specific training;
4. Provide the students with orientation about the company and about the job;
5. Designate a Program Coordinator who will coordinate with LHS Inc. the various activities under
this program;
6. Assign an immediate supervisor who will monitor and discuss the performance of student interns,
every end of the month, for the duration of the student’s immersion;
7. Ensure a safe and conducive working environment for the students;
8. Accomplish the monthly and term-end evaluation form and discuss the results of the performance
evaluation with the student immersion;
9. Designate a representative during the culminating activity of student immersions; and
10. Inform the school, through the faculty adviser or coordinator, other matters related to the
Academic and Technical Vocational Skills.

B. LHS INC. shall:


1. Recommend students who will undergo immersion under the Academic and Technical
Vocational Skills Program after going through the usual selection process of LGU.;
2. Designate a faculty coordinator and /or faculty adviser who will coordinate with various
activities under this program;
3. Inform LGU. through the faculty adviser or coordinator, other matters related to the Senior
High School Program;
4. Together with the students, faculty, and parents concerned, renounce and waive any claim
against LGU for any injury or loss that the student immersion may sustain or may suffer,
personal or pecuniary, in the performance of their duties and functions while under training
not attributable to the negligence or wilful act of any of the personnel of LGU. The waivers of
the concerned parties shall be submitted to LGU. prior to the commencement of the training.

C. Under this Immersion Program, the following terms and conditions are likewise included:

1. It is expressly understood that there will be no employer-employee relationship between


LGU and the student interns of Lagonoy High School Inc.
2. The student interns will be personally responsible for any and all liabilities for damage to
property or injury to third persons, which maybe occasioned by their intentional or negligent
acts while in the course of their training/immersion;
3. LHS Inc. , through the faculty advisers shall see to it that the student interns complete the
agreed scope of work within the agreed duration of the program;
4. It is expressly understood by LHS Inc. , and the student interns that all information on
technology, process standards, quality assurance methodologies, quality standards,
production capabilities, raw material purchasing , marketing, manuals and operational or
technical matters that LGU.shall make available to them shall be used for the sole purpose of
student training. All of these matters are classified as confidential in nature and proprietary
to LGU .and the student intern hereby undertake to prevent transfer of such LGU. without
the knowledge and written consent of LGU. The student intern hereby acknowledge this
condition specifically after having read and affixed their individual signatures to the
CONFIDENTIAL AGREEMENT, a sample of which is attached herewith, which forms part of
this agreement;
5. Any intellectual property owned by the parties prior to this agreement shall continue to be
owned by them. The student-intern cannot use any confidential information or data from
LGU. to create intellectual property without the express written approval from LGU.;
6. Any intellectual property independently created by the student’s immersion during the
period LGU. provide financial support for the creation of such intellectual property, the
ownership of the intellectual property shall be determined by agreement of the parties
which shall be embodied in a separate written agreement; and,
7. In case the student-intern jointly creates intellectual property with a person employed by
LGU., the intellectual property shall belong to the student-intern and the LGU. jointly in
equal shares, unless the parties agree on a different proportion of ownership.

D. DURATION

This agreement shall hold for the duration of the 2022-2023 Academic School Year of Lagonoy High
School Inc., and is automatically renewable every year, provided that LGU. and LHS Inc., reserve their
respective rights to withdraw their participation in the agreement upon written notice.

CONFIDENTIALITY AGREEMENT

We, the students of LHS Inc. hereby bind ourselves and agree to all information on trade
secrets, technology, quality assurance methodologies, production capacities, documents and
manuals and other technical matters that LGU. shall make available to me or to that I may have
access to in connection with LOCAL GOVERNMENT UNIT (LGU) Lagonoy Camarines Sur concern to
enhance training and development of more and better information on the current and latest
development on the Office Management and Technical Skills program and shall be used for the sole
purpose of developing skills. All of these matters are classified as confidential in nature and
proprietary to LGU.

I agree that such information shall be held in trust and fiduciary capacity, and hereby
undertake to prevent transfer of such information and assigns consciously and unconsciously, to any
party without written consent of LGU.

This Agreement shall be effective upon the signing hereof and shall continue to be in force
and effect even after the termination of the Memorandum of Agreement signed between LGU. and
Lagonoy High School Inc.
