Regulation 44 of Bank of India (Officers') Service


Regulations, 1979-
Leave Travel Concession- In cases where both husband
and wife are working in the same Bank

As per existing provisions under Regulation 44 of Bank of India (Officers')


Service Regulations, 1979, in cases where both husband and wife are working in the
Bank is as under:
Quote
(a) If the husband and wife both are employees of the Bank, only one of them will be
eligible to Leave Travel Concession, as per his / her entitlement, in a particular
block of 4 years. In other words, where one of the spouse avails Leave Travel
Concession under his / her span, the Leave Travel Concession for the other will
have to be surrendered. Proper notes should be taken in the personal folders of
the respective officers.
Where one of the spouse surrenders his/ her entitlement, the LTC will be
admissible to the family on the scale applicable to the husband or the wife, as the
case may be, and not both.
(b) Where husband / wife does not claim LTC for the other, i.e. each prefers to avail
LTC in his/her own right, it may be allowed to him/ her as per entitlement.
In the case of (b) above only husband or wife will be entitled to claim LTC in
respect of dependent children during that span.
Where the husband avails of LTC in his own right, he may also claim LTC for his
parents, brothers and sisters residing with and wholly dependent on him but not the
other dependents of the wife. However, where the wife claims LTC in her own right,
ordinarily she will be eligible to claim LTC facility in respect of her dependent parents
in individual cases, depending upon facts, the Bank may consider allowing LTC to the
wife for her other dependents. It is of course understood that in such cases -
(a) the parents of the female employee ordinarily reside with her; and
(b) the female employee is the only earning member in the family of her parents. (If
there are other members earning but they are married daughters, the Bank may
consider on merits, the claim of the female employee for inclusion of her family)

2. Para 22 (iv) of 11th Bipartite Settlement dated 11.11.2020 (for Award Staff)
states that, "Provisions under Clause 10.13 (iii) of Bipartite Settlement dated 19"'
October, 1966 regarding restrictions on entitlement to LFC where both husband and
wife are working in the same Bank shall stand deleted. Accordingly, henceforth LFC
can be availed independently where both husband and wife are working in the same
bank.". Accordingly, when one of the spouse is an officer and the other is a workman
OR when both the spouses are workmen, the staff were allowed to avail the LFC
facility as per their respective entitlement. However, in cases where both husband and
e are officers, they are not allowed to avail the facility of their respective spouses.
3. Now, we are in receipt of Letter No. HR&IR/MBR/OTR/0660 dated 04.12.2023
from IBA (Copy enclosed as Annexure-I). Vide the said Letter, IBA has clarified that
Managing Committee of IBA has approved on 20.10.2023 that "Where both husband
and wife are working in the same Bank, both will be eligible for LFC facility as
per their respective entitlement". IBA has conveyed that the said facility will be
effective prospectively from 20.10.2023 (i.e. the date of approval by the Managing
Committee of IBA).
4. We are pleased to inform that the Board in its meeting dated 24.01.2024 has
accorded approval for adoption of IBA Advisory dated 04.12.2023 that "where both
husband and wife are working in the same Bank, both will be eligible for LFC facility as
per their respective entitlement" w.e.f. 20.10.2023.

5. Please bring this to the notice of all Staff members working u your
jurisdiction.

one of the spouses is an officer and the other is a workman working in the same bank, it is
within the rules ofthe bank to allow both ofthem to avail thefacility, not violative ofthe service
condition, whereas, where both of them are officers they cannot avail the facility of their

2. The matter was discussed in the Negotiating Committee of IBA during the ongoing
negotiations for the 12th Bipartite Settlement / 9th Joint Note. It was agreed that IBA will issue
a suitable advisory after seeking approval from the Managing Committee that "Where both
husband and wife are working in the same Bank, both will be eligible for LFCfacility as per
their respective entitlement." This facility will be effective prospectively from the date of
approval of the proposition by the Managing Committee.

3. The matter was placed in the meeting of the Managing Committee held on 20.10.2023, which
was subsequently approved.
