    The International Court of Arbitration has made several decisions regarding the arbitration between Private Fund Ltd, Mr. Flavio Pereira Ferreira, and Fairwood Ltd.     Dear Mesdames and Sirs,

    At its session of 13 July 2023, the International Court of Arbitration of the International
    Chamber of Commerce (“Court”):

    - Decided that this arbitration shall proceed (Article 6(4))

    - Fixed Paris, France, as the place of arbitration (Article 18(1))

    - Directly appointed Kim Lee as co-arbitrator (Article 12(8)

    - Directly appointed Eduardo Fernandez as co-arbitrator (Article 12(8))

    - Directly appointed and Claude Kowalski as the president of the arbitral tribunal (Article
    12(8))

    Copies of the Statements of Acceptance, Availability, Impartiality and Independence and the
    curriculum vitae of Kim Lee, Eduardo Fernandez and Claude Kowalski are enclosed for your
    information.

    Advance on Costs

    As the provisional advance has been fully paid, we are transmitting the file to the arbitral tribunal
    today (Article 16).

    The parties should correspond directly with the arbitral tribunal and send copies of their
    correspondence to the other party/parties and to the Secretariat in electronic form only. The parties
    are encouraged to use ICC Case Connect for communications and document-sharing and (ICC Case
    Connect only) are reminded that hard copies should not be sent to the Secretariat.

    The Court will fix the advance on costs to cover the arbitral tribunal’s fees and expenses, as well as
    the ICC administrative expenses in due course (Article 37(2) and Article 1(4) of Appendix III).
