About Us
Heritage Law College has been set up with a view to advancing and
disseminating learning and knowledge of law and legal processes
and their role in national development. The aim is to promote legal
knowledge and to make law and the legal process, efficient
instruments of social development. Our educational philosophy is
dedicated to develop in the students a sense of responsibility to
serve society in the field of law by developing skills with regard to
advocacy, legal service, legislation, law reforms and the like and also
to promote inter-disciplinary study of law in relation to
management, technology, international cooperation and
development. A harmonious integration of valued traditions with
modern outlook is the guiding principle behind the development of
the academic environment that constitutes the basic philosophy of
the Law College.

The Heritage Law College's official mooting organisation and


management of mock trials is the Moot Court Committee. Members
of the Committee are drawn from each of the five B.A LL.B. batches.
These members are led by the fifth-year students. who work under
the direction of the Chairperson.
A Chairperson, joint Vice-chairperson, Faculty Representative,
President, Vice-president, Secretary. Treasurer, Deputy Secretary
and members from each batch make up the committee. All students,
especially those in their junior years, will receive instruction and
preparation from the Committee on the difficulties of advocating,
drafting, and mooting.

Proposition
1. Mr. Vijay Verma, a highly regarded and long-established
retailer of garments, presides over a thriving shop
strategically located in the bustling G.G. Hogg Market, situated
within the vibrant city of Kalcutta. With aspirations to further
elevate his flourishing business, Vijay Verma established a
contact with KapraBecho Wholesale Retail Company, a
renowned e-commerce platform specializing in the wholesale
distribution of garments to discerning retailers.

2. On the 2nd of September 2023, Vijay Verma's 17-year-old son,


Manish Verma, embarked on a substantial transaction. Manish,
utilizing the KapraBecho website, placed a sizable order for
garments amounting to a total value of Rs. 24,000. With
commendable promptness, Manish executed the payment for this
order, employing the widely-used and trusted mobile payment
service 'Who-Pay App.' Following the successful transaction,
Manish received a confirmation text message, affirming the
successful placement of the order. The text message further
stipulated an estimated delivery timeline of 15 days to the
designated delivery address.

3. It is to be noted that Mr. Vijay Verma is a graduate from a


business school but he is not technologically accustomed.
That is why, Manish is used to place most of the orders online
and made transactions.

4. However, the course of events took a devastating turn on


the 15th of September 2023. On this ill-fated day, a
catastrophic flood, unforeseeable and unparalleled in its
destructive force, swept through the region, wreaking
unprecedented havoc. The extensive damage inflicted by this
cataclysmic event extended to the complete obliteration of
KapraBecho's primary warehouse—a pivotal center for their
operations. Consequently, Manish's eagerly anticipated
shipment, encompassing the fulfillment of his ordered
garments, lay in ruins. This calamitous turn of events left both
Vijay Verma and Manish Verma in a profound state of distress
and inflicted significant financial loss.

5. On the 5th of October 2023, Vijay Verma, acting decisively


to protect his and his son's interests, filed a Suit before the
Court. In this Suit, he fervently prays for damages and
compensation, seeking the court's wisdom to address this
intricate and compelling dispute.

Rules and
Regulations
The Moot Court Committee of Heritage Law College will have
exclusive authority to interpret the rules in the interest of just
and fair competition.
Important rules and regulation for the competition are
mentioned below:

1. ELIGIBILITY AND PARTICIPATION


The competition is open to all students of 1st, 2nd, 3rd &
4th Year of Heritage Law College
Each team shall consist of minimum 2 members or
maximum of three members (2 speakers or 2 speakers and
1 researcher), respectively.

2. REGISTRATION PROCEDURE
All Teams should register themselves though the
registration link, which is circulated herewith.
The Last Date of Registration is 29th October 2023.
Two hard copies of the memorial drafted to be submitted
on the first day of the event.

3. DRESS CODE
The participating teams must adhere to the following dress
code during the competition.
Male- Western formals, i.e., white shirt, black trousers, tie
and black coat/blazer.
Female- Indian formals, i.e., white salwar-kurta, or Western
formals, i.e., white shirt, black trousers/skirt and Black
coat/blazer.

4. LANGUAGE
The official language of the competition shall be English
only.

5. MEMORIAL SUBMISSION
All memorials submitted for all purposes of the
Competition shall firmly comply with the rules of the
competition.
Each participating team must prepare two written
submissions, one for each Petitioner/Appellant as well as
Respondent/Defendant side.

6. MEMORIAL CONTENT
Cover Page – The cover page shall contain the Case Title,
Side of the Memorial, Year of the Competition, Name of the
Team, and Semester.

Statement of Jurisdiction
Statement of Facts
Issues Raised
Summary of Arguments Pleadings
Arguments Advanced
Prayer

The Memorial shall not exceed 20 Pages in total and


Arguments Advanced shall not exceed 8 Pages.

7. FORMAT OF THE MEMORIAL
The memorial shall be typed on an A4 size paper and all the
pages of the memorial should have a page number at the
bottom.
The Font shall be in Times New Roman, Size 12 pts with Line
Spacing of 1.5
Footnotes shall be in Font Times New Roman, Size 10 pts
with Line Spacing of 1.0
Page Margins shall be an inch on all sides.
All the citations and footnotes must be consistent and in
compliance with the 20th Edition of Bluebook.
Any revision to the memorial after submission shall attract
penalties.

8. FORMAT FOR ORAL ROUND **


Each team shall be given a maximum of 8 minutes to
present their arguments. This shall be exclusive of the time
for rebuttal. The maximum time for rebuttal is 2 minutes.
Sur-rebuttal shall be at the discretion of the judges.
The organisers shall have its own time-keepers, wherein
there shall be two warning bells. The first bell shall be rung
4 minutes before the time run out and the second bell shall
be rung 7 minutes before the time run out. The third bell
shall connote that the time is up.

9. RESEARCHERS TEST
There shall be a researcher test, to be conducted on 1st
November, 2023.
The researcher of each participating team must take the
test.
The Researcher Test will be conducted prior to the oral
argument rounds of the moot court competition.
The Researcher Test will evaluate the research and legal
analysis skills of the participants.
Questions will be based on the moot court problem or
case at issue in the competition.
Questions may encompass legal research, case analysis,
statutory interpretation, and other related legal topics.
Any communication between participants or with external
parties during the test is strictly prohibited.
Plagiarism or any form of academic dishonesty during the
test is not tolerated.
The test duration will be predetermined by the organizing
committee and communicated to participants in advance.
Participants must adhere to the specified time limit, and
no extra time will be granted.
The Researcher Test will be graded by a panel of qualified
judges or evaluators appointed by the competition
organizers.
