This petition is filed directing the respondents to release the petitioner’s new unregistered
Tractor cum Trailer Swaraj 50 hp (bigger rear tyre plough lamp deluxe), bearing engine no.
DC 3009/SAP 29052 chasis no.MBNBT49ABKCP18372, within a suitable time limit specified
by this court , which is under the custody of the 5th respondent from 02.05.2020.
The petitioner A.Panchamoorthi s/o.Ayyanar residing at 2/77, west street, Sivagnana
puram, kullichettipatti, Dindigul Dt, is the owner of the un registered Tractor cum Trailer
Model Swaraj 50 hp, bearing engine no.DC 3009/SAP 29052 chassis no. MBNBT 49ABKCP
18372. The allegation against the petitioner is when the police party has rounds on 02.05.2020
at about 19.45 hrs in vaigai river at sekkapatti–akkaraipetti, the petitioner’s brother Veeria
perumal s/o ayyanar while driving, make threat on seeing the police party. When the police
party searched the vehicle it was found that ½ unit of sand (fg;gp kz;). Hence on the basis of
police party complaint, the 5th respondent/police has registered a case u/s.353 ipc and sec
21(1) of Mines and Minerals (Development and Regulation) Act 1957 falsely against the
petitioner’s brother and unregistered Tractor in cr.no.234/2020 for carrying of sand and
seized the vehicle on 02.05.2020 at about 21.00 hrs. The petitioner never involved in any
illegal activities. The sand is for temple purpose. Till date no order for release of vehicle has
been passed by the respondents. It is submitted that no previous case against the petitioner.
The petitioner undertakes that he will not use the vehicle for any illegal activities in future
and shall produce the same as and when required by the respondents and also the trial
Court. Further it is submitted that the petititioner shall not alienate the vehicle till the
disposal of the proceedings before the authority concerned. Hence this petition is filed for
release of vehicle.
