It is submitted that the Judicial Magistrate No.II,

Tindivanam had submitted a letter in D.O.Letter No.1345/2022,
Dated.06.09.2022 and stated that Tmt.N.Muthupoorani, Examiner, Judicial
Magistrate Court No.II, Tindivanam is working more than 3 years and she is
only doing the work of making entries of thabal received register, Despatch
Register and attending the bail bond works. The officer further submitted
that apart from that, she never done any additional work if she placed in-
charge for any staff applied leave or any emergency work entrusted by way of
office note. Such kind of incompatible activities of the aforesaid individual is
being continued day –to – day for not only to the fellow judicial staff working
in her office but also with officer.

It is further submitted that the officer submitted that the

mis-behaving attitude of the aforesaid individual are detailed below:-
1. The individual is not attending the office on time as the time stipulated in
the Rule. Even-though, Bio-Metric attendance is being in-force she never
minds about the such punctuality.
2. She is doing the work lethargically in open court and not maintained the
court decorum by deliberately doing such attitude of eating, drinking
coffee and loudly shouts the names of police personals, Advocates while
functioning of the court.
3. She disobeys the orders of the officer and speaks disquieted by giving
counter to the officer and never minds about the officer order entrusted to
her and wantonly avoiding signing the office note, by telling the Head
Clerk that does whatever wants.
4. Further, the aforesaid person has not worked in allotted places of her i.e.,
open court from 01.09.2022 to till date and left on that place without any
permission of officer as well as any intimation to the Head Clerk. She
voluntarily has taken one place in office room away from the view of
officer and other staff members.

5. For aforesaid lapses and misbehaviors mentioned in Sl.No.1 to Sl.No.4,

the officer issued memo against Tmt.N.Muthupoorani, Examiner, Judicial
Magistrate Court No.II, Tindivanam vide Dis.No.1249/2022,
dated.26.08.2022 and in-turn she submitted her explanation and
blaming the Head Clerk of this office without offering explanation or
reasons for her misbehavior attitude. In this connection , separate
proceedings will be initiated against the said individual under Tamil
Nadu Civil Services (Discipline & Appeal ) Rules.

6. Then in all these incidents, the said Tmt.N.Muthupoorani, Examiner of

copyist of this office has posted the untrue facts in voice message
through whatsapp group on 31.08.2022 by abusing the officer by
depicting as cruel.

It is further submitted the office stated that such kind of

attitude of the said staff causes much inconvenience to her and it is difficult to
engage her to do the office work. Hence, the officer requested that
Tmt.N.Muthupoorani, Examiner, Judicial Magistrate Court No.II, Tindivanam
may be transferred to any other place for her disobedience on the
administration grounds.

feet. But the Municipal Authorities of Tindivanam Taluk have compelled the
petitioner to pay the property tax of Rs.2586/- for his rental building i.e., 8 ½
feet width, 16 feet length and 296 squre feet. Hence, the petitioner had filed a
suit in O.S.No.19/2022 before the Principal Sub Court, Tindivanam and same
was disposed in favour of the petitioner.

It is further submitted that the petitioner further submitted that

the Tindivanam Municipal Authorities have compelled the petitioner to pay a
sum of Rs.2586/- without obeying the court orders. Hence, the petitioner
prays to issue suitable orders to Municipal Authorities and regulate his
property tax for his rental building.

Under the above said circumstances, if your Honour deems fit,

It is submitted that the Chief Judicial Magistrate, Villupuram has

submitted a letter in D.No.5270/2022, dated.26.09.2022 to this office and stated
that the Sessions Case in S.C.No.25/2010, U/S.307 IPC r/w 3 of Explosive Act 1908
had been received from the Principal Sub Court, Villupuram as per the proceedings
of the Hon’ble Principal District Judge, Villupuram in A.R.No.2734/2020,
dated.17.03.2020 and the same is pending before her court.

It is further submitted that the officer stated that PW 1 to PW 7 were

examined on 19.092022 and during the examination of witnesses, it came to know
the said case had been filed U/S. 307 IPC r/w 3 of Explosive Substance Act, 1908 and
also this case has no jurisdiction to try this case. In the above circumstances, the
Additional Public Prosecutor had filed a petition before he court under section 323
Cr.P.C and stated that the case disclosed offence punishable u/s.3 of Explosive
Substances Act, 1908 which is exclusively triable by court of Sessions, since the
prescribed minimum punishment of either description which shall not less than ten
years.

It is further submitted the Hon’ble High Court, Madras in

Roc.No.1999/C/2015/G1, dated.03.04.2017 as follows;

“The discretion is left with the investigating agency and the Principal District
and Sessions Judges/District and Sessions Judges concerned to take a call, on a case-
to – case basis, with regard to making over of cases under Explosive Substances Act
to the Sessions Court for exclusive trial of Bomb Blast Cases, Chennai at Poonamalle
and Sessions Court for exclusive trial of Bomb Blast Case, Coimbatore.”

In the above circumstances, the Chief Judicial Magistrate, Villupuram

prays that necessary orders may be passed to withdrawn and transfer the Sessions
Case No.25/2010 on the file of Chief Judicial Magistrate Court, Villupuram.

It is submitted that the Principal District Judge,Kancheepuram District

at Chengalpattu had sent a letter in D.No. 6048/2022, dated.16.08.2022 to this office
along with letter of the Principal District Munsif, Kancheepuram and her Service
Register.

It is further submitted that the officer submitted in her letter that she
joined as Principal District Munsif, Tirunelveli on 18.09.2015 FN and her annual
periodical increment fell due on 01.07.2016. But, inadvertently the officer’s annual
periodical increment was sanctioned on 01.10.2016 instead of 01.07.2016, even
though in the increment register maintained by this office it was mentioned as
01.07.2016. Hence, the officer is requesting to revise the said increment with effect
from 01.07.2016. On perusal of the Service Register, the claim of the officer appears
to be correct.

Under the above said circumstances, if your Honour deems fit, whether
the annual periodical increment of the officer may be revised and sanctioned w.e.f
01.07.2016 and the service register of the officer together with revised increment
certificate may be forwarded to the Chief Judicial Magistrate, Villupuram for taking
further action at her end with a intimation to the Principal District Judge,
Kancheepuram at Chengalpattu.

1) Tmt.R.Rajeswari, formerly III-Additional District Munsif,
Kallakruichi and now officiating Principal District Munsif, Kancheepuram joined
duty as Principal District Munsif, Tirunelveli on the forenoon of 18.09.2015 and as
such the annual periodical increment of the officer fell due on 01.07.2016. But,
inadvertently, the annual periodical increment was sanctioned on 01.10.2016
instead of 01.07.2016.

2) Now, the officer had made request in the reference 1 st cited to revise
her annual periodical increment w.e.f. 01.07.2016.

3) Accordingly, the annual periodical increment of the officer is hereby

revised w.e.f. 01.07.2016, by granting increment of Rs.770/- and raising her pay
from Rs.27,700/- to Rs.28,470/- in the scale of pay of
