CONSTITUENCIES

INTRODUCTION
One of the most important features of the democratic polity is elections at regular intervals.
Elections constitute the signpost of the democracy; these are medium through which the attitudes,
values and beliefs of the people towards their political environment are reflected. Elections are the
central democratic procedure for selecting and controlling leaders. Elections symbolize the
sovereignty of the people and provide legitimacy to the authority of the government. Thus, free &
fair elections are indispensable for the success of the democracy.
An electoral roll or voter list is a list that is released by the Election Commission which includes
the names of all the registered voters of the particular region to which it belongs. Any person who
is a citizen of India and is above 18 years of age is eligible to be enrolled in the electoral roll unless
he or she is disqualified due to some reason. A person is eligible to be enrolled only from a single
constituency during an election. The importance of the electoral roll cannot be understated as it
fulfils many important objectives such as identifying electoral fraud as an electoral roll allows the
responsible authorities to verify the details of a voter. An electoral roll also ensures that a person
cannot vote twice.
The Election Commission of India is a permanent constitutional body that prepares and
periodically revises electoral rolls and registers all eligible voters. According to the Election
Commission of India, with regard to persons enrolled on Voter ID database as per the final
publication of electoral roll as on January 1, 2023, the total number of persons enrolled were
94,50,25,694.1 Usually, electoral rolls are kept in paper form but recently the Election Commission
of India (ECI) adopted electoral rolls in the electronic form. The electronic electoral roll uses
biometric technology2. India has a comprehensive structure of laws to administer preparation and

revision of electoral rolls. The formal legal framework rests on certain constitutional provisions,
the Representation of the People Act, 1950 enacted thereunder and Registration of Electors Rules,
1960 framed under the said Act.

CONSTITUTIONAL PROVISIONS
The Constitution of India has an independent and special chapter, ‘Part XV’ on Elections.
 Article 325 of Constitution of India provides that there shall be one general electoral roll
for every territorial constituency and no person shall be ineligible for inclusion in any such
roll or claim to be included on grounds only of religion, race, caste or sex.
 Article 326 provides for universal adult suffrage and qualifications and disqualifications
for registration in electoral roll.
 Parliament has been authorized by Article 327 of the Constitution to make provisions by
law with respect to all matters relating to, or in connection with, elections to either House
of Parliament or to the House or either House of the Legislature of a State including
preparation of electoral rolls. In exercise of such power, the Parliament has enacted the
Representation of the People Act, 1950.
 Similarly, under Article 328, State Legislatures have been authorized to make law with
respect to all matters relating to elections to the Legislature of the concerned state including
preparation of electoral rolls.

STATUTORY PROVISIONS AND RULES


The electoral rolls are prepared and revised, subject to the overall superintendence, direction and
control of the Election Commission under Article 324 of the Constitution, in accordance with the
provisions of Representation of People Act, 1950 and Registration of Electors Rules, 1960. The
said Act and Rules have detailed provisions relating to procedure of preparation of electoral rolls
and various activities pertaining thereto and also the electoral machinery responsible for
preparation and revision of electoral rolls as per the given procedure. These legal provisions have
a complete mechanism for any person who has a grievance relating to registration in electoral rolls
to avail of the remedy as provided for in them. The Supreme Court has maintained that any matter

relating to electoral rolls can only be challenged in accordance with these legal provisions.
Sections 14-25 of Representation of People Act, 1950, provide for preparation of electoral rolls
for each constituencies under the supervision, direction and control of the Election Commission
and cover the qualification/disqualification for registration of an elector and other conditions
applicable to the preparation and revision of the electoral rolls.
Section 27 deals with preparation of electoral rolls for Council Constituencies.
Sections 28-32 provide for general provisions relating to Central Government’s powers to make
rules, for providing staff for performance of duties in connection with preparation and revision of
electoral rolls, barring jurisdiction of Civil Courts and punishment in case of making false
declaration and breach of official duty.
Registration of Electors Rules, 1960 – Initially, rules for registration in electoral rolls were made
in 1950, named as the Representation of People (Preparation of Electoral Rolls) Rules, 1950. Later
on, these rules were replaced by a new set of rules in 1956 under the name of Representation of
People (Preparation of Electoral Rolls) Rules, 1956. Finally, in exercise of the powers conferred
by Section 28 of the Representation of the People Act,1950, the Central Government, after
consulting the Election Commission, framed Registration of Electors Rules, 1960. The rules were
published by Ministry of Law on 10th November, 1960. These rules provide the manner and
methodology of preparation of electoral rolls.
(i) Rules 4-23 relates to the manner of preparation of electoral rolls.
(ii) Rule 28 deals with issue of identity cards.
(iii) Rules 30 and 31 provide for manner of preparation of electoral rolls
for Council Constituencies.
(iv) Rules 32-35 relate to preservation and disposal of electoral rolls, forms
and connected papers.

ELECTORAL ROLL FOR PARLIAMENTARY CONSTITUENCIES


“Parliamentary constituency” means a constituency provided by law for the purpose of elections
to the House of People. 3
It shall consist of the electoral roll for all the assembly constituency comprised within the

parliamentary constituency and it is not necessary to prepare or revise separate electoral roll for
any such parliamentary constituency.

Part IIB of Representation of the People Act, 1950 contains Section 13D which deals with
Electoral rolls for parliamentary constituencies.

Section 13D (1) states that the electoral roll for every parliamentary constituency, other than a
parliamentary constituency in the State of Jammu and Kashmir or in a Union territory not having
a Legislative Assembly, shall consist of the electoral rolls for all the assembly constituencies
comprised within that parliamentary constituency; and it shall not be necessary to prepare or
revise separately the electoral roll for any such parliamentary constituency:

Provided that for the period referred to in clause (2) of article 371A, it shall be necessaryto
prepare and revise separately the electoral roll for that part of the parliamentary constituency of
Nagaland which comprises the Tuensang district and the provisions of Part III shall apply in
relation to the preparation and revision of the electoral roll of the said part as they apply in relation
to an assembly constituency.
13D (2) states that the provisions of Part III shall apply in relation to every parliamentary
constituencyin the State of Jammu and Kashmir or in a Union territory not having a Legislative
Assembly as they apply in relation to an assembly constituency.

ELECTORAL ROLLS FOR ASSEMBLY CONSTITUENCY


"Assembly constituency" means a constituency provided by lawfor the purpose of elections to
the Legislative Assembly of a State;4
A detailed procedure is laid down in the REPRENTATION OF THE PEOPLE ACT 1950-
PART III B and REGISTRATION OF ELECTORS RULES, 1960 for preparation of
assembly constituency electoral roll.

PROVISIONS IN REPRENTATION OF PEOPLE ACT 1950- PART III


Section 15. deals with electoral roll for every constituency. It states that for every constituency
there shall be an electoral roll which shall be prepared in accordance with the provisions of this
Act under the superintendence, direction and control of the Election Commission.

Section 17 states that no person shall be entitled to be registered in the electoral roll for more than
one constituency. Moreover, no person to be registered more than once in any constituency. —No
person shall be entitled to be registered in the electoral roll for any constituency more than once. 5

PROCEDURE OF PREPARATION OF ELECTORAL ROLL

QUALIFICATION
Section 19. Conditions of registration- Subject to the foregoing provisions of this Part, every
person who —
(a) is not less than eighteen years of age on the qualifying date, and
(b) is ordinarily resident in a constituency,
shall be entitled to be registered in the electoral roll for that constituency.
DISQUALIFICATION
Section 16. Disqualifications for registration in an electoral roll. —
(1) A person shall be disqualified for registration in an electoral roll if he—
(a) is not a citizen of India; or
(b) is of unsound mind and stands so declared by a competent court; or
(c) is for the time being disqualified from voting under the provisions of any law relating
to corrupt practices and other offences in connection with elections.
(2) The name of any person who becomes so disqualified after registration shall forthwith be struck
off the electoral roll in which it is included:
Provided that the name of any person struck off the electoral roll of a constituency by reason of a
disqualification under clause (c) of sub-section (1) shall forthwith be re-instated in that roll if such
disqualification is, during the period such roll is in force, removed under any law authorizing such
removal.
Section 21. Preparation and revision of electoral rolls. —
(1) The electoral roll for each constituency shall be prepared in the prescribed manner by reference
to the qualifying date and shall come into force immediately upon its final publication in
accordance with the rules made under this Act.
(2) The said electoral roll—
(a) shall, unless otherwise directed by the Election Commission for reasons to be recorded in

writing, be revised in the prescribed manner by reference to the qualifying date—
(i) before each general election to the House of the People or to the Legislative Assembly
of a State; and
(ii) before each bye-election to fill a casual vacancy in a seat allotted to the constituency;
and
(b) shall be revised in any year in the prescribed manner by reference to the qualifying date if such
revision has been directed by the Election Commission:
Provided that if the electoral roll is not revised as aforesaid, the validity or continued operation of
the said electoral roll shall not thereby be affected.
(3) Notwithstanding anything contained in sub-section (2), the Election Commission may at any
time, for reasons to be recorded, direct a special revision of the electoral roll for any constituency
or part of a constituency in such manner as it may think fit:
Provided that subject to the other provisions of this Act, the electoral roll for the constituency, as
in force at the time of the issue of any such direction, shall continue to be in force until the
completion of the special revision so directed.

In pursuance of the powers conferred by Articles 326 and 327 of the Constitution, the Parliament
promulgated the Representation of the People Act No. 43 of 1950 (hereinafter referred to as the
1950 Act), which, as the long title would indicate, makes provision for the allocation of seats in,
and the delimitation of constituencies for the purpose of elections to, the House of the People and
the Legislatures of States, the qualifications of voters at such elections, the preparation of electoral
rolls, the manner of filling seats in the Council of States to be filled by representatives of Union
Territories and matters connected therewith.
Section 21 provides for the manner in which the electoral rolls are to be prepared and for their
revision. Under Section 22, the electoral registration officer for a constituency is empowered to
correct entries in the electoral rolls of that constituency and under Section 23 to include in the
electoral rolls names which were wrongly omitted. However, after the last date for making
nominations for an election in that constituency, there can be no amendment, transposition or
deletion of any entry under Sec-tion 22 nor any direction for the inclusion of a name in the electoral
roll under Section 23. Section 24 provides for appeals against the order of the electoral registration
officer under Section 22 or Section 23 Under Section 30, no civil court shall have jurisdiction to

entertain or adjudicate upon any question whether any person is or is not entitled to be registered
in an electoral roll for a constituency. 6

REGISTRATION OF ELECTORAL RULES, 1860

PART II deals with Electoral rolls for Assembly Constituencies

PREPARATION OF ELECTORAL ROLL (FIRST DRAFT)

According to Rule 3, in this Part "constituency" means an Assembly constituency.


Rule 4. Form and languages of roll. —The roll for each constituency shall be prepared in such
form and in such language or languages as the Election Commission may direct.
Rule 5. Preparation of roll in parts. — (1) The roll shall be divided into convenient parts which
shall be numbered consecutively.
(2) The last part of the roll shall contain the names of every person having a service qualification
and of his wife, if any, who are entitled to be included in that roll by virtue of a statement made
under rule 7.
(3) The names of any person holding a declared office and of his wife, if any, who are entitled to
be included in the roll by virtue of a statement made under rule 7 shall be included in the part of
the roll, pertaining to the locality in which they would, according to that statement, have been
ordinarily resident.
(4) The number of names included in any part of the roll shall not ordinarily exceed two thousand.
Rule 6. Order of names. — (1) the names of electors in each part of the roll shall be arranged
according to house number, unless the chief electoral officer, subject to any general or special
instructions issued by the Election Commission, determines in respect of any part that the
alphabetical order is more convenient or that the names shall be arranged partly in one way and
partly in the other.
(2) The names of electors in each part of the roll shall be numbered, so far as practicable,
consecutively with a separate series of numbers beginning with the number one.
Rule 8. Supply of information by occupants of dwelling houses: The registration officer may,

for the purpose of preparing the roll, send letters of request in Form 4 to the occupants of dwelling-
houses in the constituency or any part thereof; and every person receiving any such letter shall
furnish the information called for therein to the best of his ability.

PUBLICATION OF DRAFT ROLL


Rule 10. Publication of roll in draft. —As soon as the roll for a constituency is ready, the
registration officer shall publish it in draft by making a copy thereof available for inspection and
displaying a notice in Form 5—
(a) at his office, if it is within the constituency, and
(b) at such place in the constituency as may be specified by him for the purpose, if his office is
outside the constituency.
Rule 11. Further publicity to the roll and notice. —The registration officer shall also—
(a) make a copy of each separate part of the roll, together with a copy of the notice in Form 5
available for inspection at a specified place accessible to the public and in or near the area to which
that part relates;
(b) give such further publicity to the notice in Form 5 as he may consider necessary; and
(c) supply free of cost two copies of each separate part of the roll to every political party 1 [for
which a symbol has been exclusively reserved in the State] by the Election Commission.

CLAIMS AND OBJECTIONS


Rule 12. Period for lodging claims and objections. —Every claim for the inclusion of a name in
the roll and every objection to an entry therein shall be lodged within a period of thirty days from
the date of publication of the roll in draft under rule 10, or such shorter period of not less than
fifteen days as may be fixed by the Election Commission in this behalf:
Provided that the Election Commission may, by notification in the Official Gazette, extend the
period in respect of the constituency as a whole or in respect of any part thereof.]
Rule 13. Form for claims and objections. —
(1) Every claim shall be—
(a) in Form 6; and
(b) signed by the person desiring his name to be included in the roll;
(2) Every objection to the inclusion of a name in the roll shall be—
(a) in Form 7; and

(b) preferred only by a person whose name is already included in that roll;
(3) Every objection to a particular or particulars in an entry in the roll shall be—
(a) in Form 8; and
(b) preferred only by the person to whom that entry relates.
(4) Every application for transposition of an entry from one part to another part of the roll shall be
in Form 8A.
Rule 14. Manner of lodging claims and objections. —
Every claim or objection shall—

(a) either be presented to the registration officer or to such other officer as may
bedesignated by him in this behalf; or
(b) be sent by post to the registration officer.
PROCEDURE OF ENQUIRY INTO CLAIMS AND OBJECTION
Rule 15. Procedure of designated officers. —
(1) Every officer designated under rule 14 shall
(a) maintain in duplicate a list of claims in Form 9, a list of objections to the inclusion of
names in Form 10 and a list of objections to particulars in Form 11; and
(b) keep exhibited one copy of each such list on a notice board in his office.
(2) Where a claim or objection is presented to him, he shall, after complying with the requirements
of sub-rule (1), forward it with such remarks, if any, as he considers proper to the registration
officer.

Rule 15. IF FILED BEFORE DESIGNATED OFFICER: - Every such officer shall maintain
a list ofobjection and he shall forward it with such remarks, as he considered proper to registration
officer.

Rule 16. BY REGISTRATION OFFICER: - He shall maintain a copy of every claim and
objection asand when received by him whether directly or forwarded by designated officer and
keep a copyof each such list entitled on a notice board in his office.

DECISION ON CLAIM AND OBJECTION

Rule 17. REJECTION – Any claim and objection not lodged within the period or form shall be
rejected
Rule 18. ACCEPTANCE – If officer is satisfied to validity of any claim, he shall allow it without

further inquiry after the expiry of one week from date on which it is entered in list.

NOTICE OF HEARING CLAIMS AND OBJECTIONS


Rule 19. Notice of hearing claims and objections. — (1) Where a claim or objection is not
disposed of under rule 17 or rule 18, the registration officer shall—
(a) specify in the list exhibited by him under clause (b) of rule 16, the date, time and place of
hearing of the claim or objection; and
(b) give notice of the hearing—
(i) in the case of a claim to the claimant in Form 12;
(ii) in the case of an objection to the inclusion of a name, to the objector in Form 13 and to
the person objected to in Form 14; and
(iii) in the case of an objection to a particular or particulars in an entry, to the objector in
Form 15.
(2) A notice under this rule may be given either personally or by registered post or by affixing it
to the person's residence or last known residence within the constituency.
Rule 20. Inquiry into claims and objections. —
(1) The registration officer shall hold a summary inquiry into every claim or objection in respect
of which notice has been given under rule 19 and shall record his decision thereon.

(2) At the hearing, the claimant or, as the case may be, the objector and the person objected to
and any other person who, in the opinion of the registration officer, is likely to be of assistance to
him, shall be entitled to appear and be heard.

(3) The registration officer may in his discretion—

(a) require any claimant, objector or person objected to, to appear in person before him;

(b) require that the evidence tendered by any person shall be given on oath and administer
an oath for the purpose.

INADVERTENCE OR ERROR

Rule 21. Inclusion of names -If it appears to the registration officer that owing to
inadvertence or error during preparation, the names of any electors have been left out of the
roll and that remedial action should be taken under this rule, the registration officer shall—

(a) Prepare a list of the names and other details of such electors;

(b) exhibit on the notice boardof his office a copy of the list together with a notice as to the
time and place at which the inclusion of these names in the roll will be considered, and
also publish the list and the notice in such other manner as he may think fit; and (c) after
considering any verbal or written objections that may be preferred, decide whether all or
any of the names should be included in the roll.

Rule 21A Deletion of names.—If it appears to the registration officer at any time before the final
publication of the roll that owing to inadvertence or error or otherwise, the names of dead persons
or of persons who have ceased to be, or are not, ordinarily residents in the constituency or of
persons who are otherwise not entitled to be registered in that roll, have been included in the roll
and that remedial action should be taken under this rule, the registration officer, shall (a) prepare
a list of the names and other details of such electors; (b) exhibit on the notice board of his office a
copy of the list together with a notice as to the time and place at which the question of deletion of
these names from the roll will be considered, and also publish the list and the notice in such other
manner as he may think fit; and(c) after considering any verbal or written objections that may be
preferred, decide whether all or anyof the names should be deleted from the roll.
FINAL PUBLICATION OF THE ROLL
Rule 22. The registration officer shall thereafter—
(a) prepare a list of amendments to carry out his decisions and to correct any clerical or printing
errors or other inaccuracies subsequently discovered in the roll
(b) publish the roll, together with the list of amendments, by making a complete copy thereof
available for inspection and displaying a notice in Form 16. On such publication, the roll together
with the list of amendments shall be the electoral roll of the constituency. Election Commission
supply, free of cost, two copies of the roll, as finally published, with the list of amendments, if any,
to every political party for which a symbol.
Rule 23. Appeals from orders deciding claims and objections. — (1) An appeal shall lie from
any decision of the registration officer under rule 20, rule 21 or rule 21A to such officer of
Government as the Election Commission may designate in this behalf (hereinafter referred to as
the appellate officer):
Provided that an appeal shall not lie where the person desiring to appeal has not availed himself of

his right to be heard by, or to make representations to, the registration officer on the matter which
is the subject of appeal.
(2) Every appeal under sub-rule (1) shall be—
(a) in the form of a memorandum signed by the appellant, and
(b) presented to the appellate officer within a period of fifteen days from the date of announcement
of the decision or sent to that officer by registered post so as to reach him within that period.
(3) The presentation of an appeal under this rule shall not have the effect of staying or postponing
any action to be taken by the registration officer under rule 22.
(4) Every decision of the appellate officer shall be final, but in so far as it reverses or modifies a
decision of the registration officer, shall take effect only from the date of the decision in appeal.
(5) The registration officer shall cause such amendments to be made in the roll as may be necessary
to give effect to the decisions of the appellate officer under this rule.

In Lakshmi Charan Sen And Ors Etc vs A.K.M. Hassan Uzzaman And Ors.7 A writ petition
was filed in the Calcutta High Court claiming the following reliefs:
(i) That the Chief Election Commissioner and the Chief Electoral Officer be restrained
from acting, either by themselves or through their subordinates, in pursuance of the
instructions or directions issued by them from time to time;
(ii) that they should be restrained from scoring out any names from the electoral rolls which
were finally published;
(iii) that they should be restrained from issuing or publishing any notification under s. 15
(2) of the Representation of People Act of 1951 without preparing the electoral rolls de
novo after the disposal of the appeals against orders whereby claims and objections were
decided; and
(iv) that they should be restrained from holding elections to the West Bengal Legislative
Assembly until the disposal of all the claims, objections and appeals under the
Representation of People Acts of1950 and 1951and the Calcutta HC granted ad interim
relief to the petitioners.

HELD- That the According to sub-rule (3) of rule 23 Or the Registration of Electors Rules, 1960,
the "presentation of an appeal shall not have the effect of staying or postponing any action to be

taken by the Registration Officer under rules 22. Rule 22 imposes A upon the Registration
Officer the obligation to publish the electoral roll which, together with the list of amendments,
becomes the electoral roll of the constituency. Thus, the fact that an appeal is pending under rule
23 (1) against the decision of a Registration Officer under rule 20, 21 or 21A does not constitute
an impediment to the publication of the roll and to the roll, upon such publication, coming into
force. Electoral roll has to be revised extensively and summarily and further held that Rule 22
Registration of Electors Rules, 1960 imposes obligation to publish electoral roll with the list of
amendments.
Rule 24. Special provision for preparation of rolls on redelimitation of constituencies. —
(1) If any constituency is delimited a new in accordance with law and it is necessary urgently to
prepare the roll for such constituency, the Election Commission may direct that it shall be
prepared—
(a) by putting together the rolls of such of the existing constituencies or parts thereof as are
comprised within the new constituency; and
(b) by making appropriate alterations in the arrangement, serial numbering and headings of the
rolls so compiled.
(2) The roll so prepared shall be published in the manner specified in rule 22 and shall, on such
publication, be the electoral roll for the new constituency.
Rule 25. Revision of rolls. — (1) The roll for every constituency shall be revised under sub-
section (2) of section 21 either intensively or summarily or partly intensively and partly summarily,
as the Election Commission may direct.

OVERSEAS CITIZEN
Every Indian citizen -
 Whose name is not included in the electoral roll
 Who has not acquired citizenship of any country and
 Who is absent from his place of ordinary residence in India owing to his employment,
education or otherwise outside India shall be entitled to have his name registered in
the electoral roll in constituency in which he has his place of residence in India.
Any overseas citizen can apply under rule 8A and 8B of REGISTERATION OF ELECTORS
RULES, 1960 and get himself registered in electoral roll.

CONCLUSION
The electoral roll of a constituency is a list of all those people in that constituency who are
registered to vote in the elections. Only those people whose names are there in the electoral rolls
are allowed to vote as ‘electors’. The electoral roll is normally revised every year to add the
names of those who are not less than 18 on a qualifying date years as on the first day of January
of that year, or have moved into the constituency, and to remove the names of those who have
died or moved out of the constituency. The updating of electoral rolls is a continuous process,
which is interrupted only at the time of the elections during the period from after the last date of
filing nominations till the completion of the elections. The administrative machinery involved
in the preparation, maintenance and revision of the electoral rolls has the ECI at the top of the
hierarchy. According to Section 13B of the Representation of the People Act, 1950, the electoral
roll for each constituency in a State/UT is to be prepared and revised by an Electoral Registration

arealso appointed. A detailed procedure is laid down in the REPRENTATION OF PEOPLE
ACT 1950- PART III B and REGISTRATION OF ELECTORS RULES, 1960 for preparation
of assembly constituency electoral roll while that of Parliamentary constituencies is laid down
in Act only.
