Act, 2005 and explain why penalty should not be imposed on him for not

The original RTI of Sri Mahesh Prasad Agrawal was received in this office 'on-line' on
It.l1.20l7.ln his RTI the Applicant sought information on four points, which related to his
Disciplinary Authority, i.e., ST.DEN/C/LKO and as such his case was transferred 'on-line' by
this office to CPIO/ Engineering on the same day.
It is pointed out here that the first Appeal in this case was marked by PIO/NR/LKO
only to FAA/ Engineering and not to FM/ Accounts. Hence the question of replying to the
RTI Applicant or Appellant by this office does not arise.
Now in his decision the CIC has directed the respondents to send a point-wise reply
to the appellant within 15 days period and to show cause in writing the reasons for
contravening the provisions of the RTI Act 2005 and to explain why the penalty should not
beimposed for not replying the appellant till date, within a period of 15 days.
ln this connection it is pointed out that timely action was taken by this office by
transferring the RTI to concerned CPIO on the very day, it was received. Hence the charges
for not replying the RTl, could not be attributed to this office.

2. As the cPIo had not provided the requested information within a period
of
30 days, the appellant fired the rrrst appear dated 09-1r-2017 requesting
that now
the information should be provided to him. As the first appeliate authoriry
did not
give him any repry, he fired a second appear u/Section 1 9(3) of
the RTI Act before
the commission on this ground and requested the Commission to take
appropriate
legal action against the CPIO u/Section.20 of the RTi Act.
