FACTS:
Mr David and Mr Joseph jointly entered into a contract for jointly bidding a
tender floated by the public sector unit (PSU). It was agreed that the sale
proceeds would be distributed equally to the bidders.
The parties secured the tender in their favor for Rs. 10,00,000/- (ten lakh
rupees) and the amount was entitled to the Mr Joseph's account but the value
of the tender would least amount to Rs. 20,00,000/- (twenty lakh rupees).
Mr Joseph after receiving the sale proceeds informed Mr David that he had
accepted the tender for Rs. 10,00,000/- (ten lakh rupees). When Mr David
enquired Mr Joseph as to why such low amount were secured. Mr Joseph
gave a evasive response and never explain why such less amount was received.
As per the terms and conditions of the contract half of the financial proceeds
belongs to Mr David.
That the trial court framed issues on 19.01.2023. and directed Mr David to
produce evidence upon which David promptly furnished to the court from
witnesses making a request that witness should be summoned by the court.
Mr David listed four witness, in which two are from PSU. The Judge refused
to entertain such a request. And directed Mr David to secure the attendance
of two PSU witness on his own.
The Judge after cross examining the other two witnesses had passed an order
to close the witness of the plaintiff order dated 15.07.2023.
This order was passed despite a request made by Mr David that at least those
witnesses named in the list who were state witnesses should be summoned in
the court.
