EXERCISE - 7 : CIVIL REVISION PETITION

FACTS:

Mr David and Mr Joseph jointly entered into a contract for jointly bidding a
tender floated by the public sector unit (PSU). It was agreed that the sale
proceeds would be distributed equally to the bidders.

The parties secured the tender in their favor for Rs. 10,00,000/- (ten lakh
rupees) and the amount was entitled to the Mr Joseph's account but the value
of the tender would least amount to Rs. 20,00,000/- (twenty lakh rupees).

Mr Joseph after receiving the sale proceeds informed Mr David that he had
accepted the tender for Rs. 10,00,000/- (ten lakh rupees). When Mr David
enquired Mr Joseph as to why such low amount were secured. Mr Joseph
gave a evasive response and never explain why such less amount was received.
As per the terms and conditions of the contract half of the financial proceeds
belongs to Mr David.

That the trial court framed issues on 19.01.2023. and directed Mr David to
produce evidence upon which David promptly furnished to the court from
witnesses making a request that witness should be summoned by the court.
Mr David listed four witness, in which two are from PSU. The Judge refused
to entertain such a request. And directed Mr David to secure the attendance
of two PSU witness on his own.

The Judge after cross examining the other two witnesses had passed an order
to close the witness of the plaintiff order dated 15.07.2023.

This order was passed despite a request made by Mr David that at least those
witnesses named in the list who were state witnesses should be summoned in
the court.

at the time with his neighbor, Mr. Govinda aged about 49 years, residing at

the back space towards his side of the property.

Mr. Srinivasan travelled to Shivamogga to his native place on 03.10.2023 due


to his father's death, before leaving he had mentioned to Mr.Govinda that he
would settle the dispute after his return from Shivamogga on 06.10.2023.
MrGovinda had diled an FIR against Mr. Srinivasan accusing him for
physical force on 15.10.2023. on his return from Shivamogga, Mr. Srinivasan
received a call from the investigating officer to attend the police investigation
in HSR Layout police station, Bengaluru. Mr. Srinivasan clearly articulated
that he was not present in Bengaluru, during the said period and he has not
taken any part in the said matter directly or indirectly, investigating officer
threatened to arrest Mr. Srinivasan if he is not present for the investigation in
the concerned police station.

On April 2023, she approached Malleshwaram,police station to register the


criminal complaint under section 498A of Indian Penal Code and section 3 &
4 of Dowry Prohibition Act against Mr. Rakesh and his mother Sushilamma
and his father Ramappa and his brother Lokesh on general cruelty and
demand for dowry police refused to register FIR. Mrs. Rajeshwari reached
out to superintendent of police but failed in getting the FIR registered.

Hence, this suit is filed in Magistrate court by Mrs. Rajeshwari.

FACTS:

Mr Ramgopal, aged abput 52 years, worked as executive officer in AMZ


software co. run by a pvt trust. Mr Ramgopal worked towards the
development of this company day and night. Today it is one of the top most
company in india. Meanwhile, the trust decided to hire new employees for
number of posts including the post of executive officer with immediate effect,
without serving any notice ask them to resign.

Mr Ramgopal was nor given any reason nor provided any compensation on
sudden removal. When asked they mentioned that it is a pvt trust under no
obligation provide any reasons or compensation whatsoever.

Mr Ramgopal approach the advocate to help him to draft a petition, to get his
constitutional rights enforced under art.226.

The famous Journalist named Jai Kiran is the editor in chief of NTV,
