Terms & Conditions
1. Hyundai Car (hereinafter “Car”) booked by you is governed by the terms as mentioned herein.
2. The details in the Digital Booking Docket (hereinafter “Form”) are verified and confirmed as
correct by the Customer.
3. These terms & conditions and booking docket supersede all previous understandings and
communications pertaining to the booking – vehicle details, waiting period, price details or
any other related information.
4. The terms hereunder are accepted by the Customer digitally after carefully reading and
understanding the same.
5. Cars can be booked by individuals/firms/companies, etc. who are competent to enter into
contract within the meaning of Indian Contract Act, 1872.
6. In case the booking amount falls short or balance amount / consideration for delivery as
specified not paid within time for any reason whatsoever, the order will automatically stand
rejected. No interest will be paid in such cases.
7. Hyundai Motor India Limited (HMIL) and its Dealers reserve the right to deliver cars to the
Customer at their discretion and priority.
8. For color and variant preference, customer is requested to opt one color choice for a particular
variant only. In case of any subsequent change in either color or variant preference, the
booking shall be rejected and Customer need to book the car a fresh as per applicable
process.
9. Payments
a. Customer is required to pay the specified order acceptance price in full as may be
prevalent at the time of order acceptance. Payment of specified order acceptance price is
to be made by Demand Draft/ Pay order/ Cheque or Transfer from Savings / Current
Account through N EFT/RTGS / UPI payable in favour of DEALER from the account of the
Customer Only. If payment is through N EFT/RTGS, Customer has to provide valid proof
to DEALER that the transfer made from the account is pertaining to the Customer. No
receipt is valid unless stamping obtained on DEALE R's official receipt. If it is found till
delivery of the Vehicle that any of the amount towards booking or balance sale price is
paid from the account other than the Customer, the Dealer is free to cancel the booking
at the sole cost of the Customer and without any liability of the Dealer.
b. The balance amount towards the price of the car for delivery is payable to DEALER within
10 days of the intimation to customer.
c. The Vehicle specification & price including statutory levies (Import Duty, Excise Duty,
Taxes and other levies) will be applicable as prevailing on the date of invoice issued by
Dealer to the Customer.
d. Customer irrevocably instruct and authorise the Dealer to make all correspondence and
take all instructions relating to the order made, including cancellation transfer and
change of address only form Finance Company/Bank, financing the loan without
clearance from the Customer.
e. Loans shall be disbursed at the sole discretion of the Bank/NBFC/Financing Company,
financing the loan and HMIL/ DEALER shall not be responsible in the event of delay or
rejection of Loan by the Bank/NBFC/Finance Company. The Loan Agreement that may be
executed between the customer and the Bank/NBFC/Financing Company shall be
exclusively between them and shall bind them only. HMIL and/or DEALER have no
association of any kind whatsoever concerning such Loan Agreement or its terms and
conditions.
10. Delivery
a. The Booking Reference Number (depending on vehicle model, variant and Color) of the
Customer is assigned by the Dealer at the time of order acceptance. The delivery of Car is
according to seniority of order Acceptance Price deposited by Customer with the DEALER
and is subject to sub clause (d) below of this clause.
b. Car Registration & Delivery shall be given after realization of full payment on the Bank
account of the DEALER and is subject to production and supply of car from HMIL.
c. The delivery of the Car shall be made after registration number is allotted on payment
receipt by the Transport Department.
d. Documents required for registration of the car have to be submitted as per the policy,
rules & regulation of the transport authority of the concerned State Government.
11. Cancellation:
a. Notice of cancellation should be sent to the DEALER together with the original payment
receipt.
b. Once cancelled, customer order cannot be reinstated.
c. In the case of financed orders, cancellation request shall be sent to the DEALER through
the financing entity and refunds will be made by the DEALER to the concerned financing
entity to the extent of total disbursed loan amount and the balance amount if any shall be
made to the Customer.
d. Dealer reserve its right to cancel the booked vehicle anytime without assigning any
reason and can also limit the number of bookings by a person.
12. HMIL reserves the right to change / discontinue model, specifications and features without
prior notice.
13. Customer is advised to quote the Booking Reference number & the date thereof for any
enquiry regarding delivery position.
14. In case of disputes, the same will be subject to the exclusive jurisdiction of the Courts of the
City of the DEALER with whom the car is booked.
15. Value of Car for exchange may vary. Actual price will be determined based on condition of old
car, at the time of handing over old car by Customer to the DEALER.
16. Customer making claim under any promotional schemes viz., Exchange Bonus, Loyalty Bonus
etc. as notified by HMIL / Dealer from time to time, shall fulfil criteria/conditions applicable
for such Schemes and submit claim along with the required documents to the DEALER within
the time specified, failing which Customer's claim will be summarily rejected and no
correspondence will be entertained in this regard.
17. Ex-showroom prices for CSD Customer is as per applicable rules & consent to the dealer from
CSD for vehicle delivery to the Customer.
18. Waiting Period indicated is tentative only and is subject to "force majeure" conditions and/or
Delivery Clause above. The term "force majeure" means any circumstances which are
unusual, unforeseeable and are beyond the control of HMIL and/or DEALER concerned, the
consequence of which could not have been avoided even if all due care had been exercised,
including but not limited to acts of god, war or threat of war, riot, civil strife, hostilities,
political unrest, government action, industrial dispute, natural or other disaster, nuclear
incident, terrorist activity, sabotage, blockage, embargo, weather conditions, transport
strike, fire, flood, typhoon, tempest, drought, epidemic, Pandemic, Lock downs, short supply
of labour, fuel, raw material, or manufactured produce, or otherwise preventing or hindering
the manufacture or delivery of the car and all similar events beyond the control of HMIL
and/or DEALER concerned.
19. In case of new product, vehicle price & tentative waiting period details shall be informed to
customer at the time of launch of the product.
20. Customer undertakes to take delivery of the Car after registration by the transport authority
concerned and understands that the registration of the Car is at the sole discretion of the
transport authority concerned.
21. Customer further understands that the agreement of sale of the Car mentioned in the Form is
exclusively between Customer & DEALER only and that Hyundai Motor India Limited, which is
operating with the DEALER concerned on principal to principal basis relationship, is not
bound by such terms or any representation or promises made by the Dealer to Customer in
any manner whatsoever.
22. Customer agrees that the car booking and the terms & conditions mentioned therein shall
bind on his/her/their legal heirs, executors, legal representatives, administrators, successors
and assigns as the case may be.
23. Customer confirm that it has the information and knowledge about the Diesel Particulate
Filter (DPF) feature in the Vehicle. Customer is fully aware of the consequences of not
following the self-regeneration process after DPF light appearance on cluster.
24. Customer hereby expressly consents HMIL to store/transfer the personal data (i.e. personally
identifiable data) that voluntarily supplied herein and process and use it by HMIL or its
affiliates I associates/ Dealers/ Agencies / Representatives to contact the Customer through
outbound call by Telephone / Mobile Numbers or send SMS / WhatsApp or Email for offers,
marketing and/or promotions, product related information, newsletter, market survey, poll,
research, study., programs, enquiries about offerings, services and other legitimate
purposes.
25. All personal data accumulated will be acquired, processed, and used according to the
applicable regulations governing the protection of personal data for the sole purpose of
managing and maintaining HMIL’s own legitimate business interests.
26. Personal Data furnished in the Form may be used by HMIL as it deems appropriate or shared
with third parties viz., affiliates, auditors, dealers, legal advisers and marketing partners,
representatives, etc. contacted to provide services on HMIL’s behalf. HMIL may disclose
information if required to do so by any law enforcing agency.
27. Although HMIL takes reasonable measures to safeguard against unauthorized disclosures of
information, it cannot assure that Personal Data that Customer provides will never be
disclosed in a manner that is inconsistent with the Policy.

28. After sales service of KONA EV will be available only at limited cities with selected dealers,
kindly visit at www.hyundai.com/in for more details and update.

29. In CNG equipped vehicle, all component of CNG kit including but not limited to cylinder,
changeover switches, etc. are directly warranted by CEV Engineering (P) Ltd.
30. Customer is prohibited from posting or transmitting on any social media or in public
(i) any unlawful, threatening, libellous, defamatory, obscene, pornographic, indecent,
harmful, abusive, inflammatory or other material or content that is otherwise objectionable
or is likely to violate rights of public and/or privacy or is likely to violate any law.
31. The terms and conditions set out herein shall be governed by the laws as applicable in India.
32. Customer agrees to indemnify and hold harmless HMIL and its respective officers, directors,
employees from any claim or demand, or actions including reasonable attorneys' fees due to
or arising out of dispute between the Customer and Dealership pertain to the booking or the
terms mentioned herein.
33. Digital Booking Docket is not a substitute to receipt, please collect your payment receipts
from the accounts for money paid to the Dealer.

34. Please do not accept any verbal commitments from the dealer or its staff.

35. Purchase of insurance policy & accessories from dealer are optional.
