Information with respect to the Munsiff's Court and Judicial 1st Class

Magistrate Court­III, Mavelikara under section 4(1)(b) of the Right To


information Act, 2005

1. Organisation, functions and duties

Munsiff's Court is presided by the Munsiff and Judicial 1 st class Magistrate


Court­III by Judicial 1st Class Magistrate­III.

Staff of this establishment consist of Junior Superintendent­1, Head


Clerk­1, Senior Clerks­6, Clerks­4, Confidential Assistant­1, Fair Copy
Superintendent­1, Selection Grade Typist­1, Senior Grade Typist­3, L.D.Typist­
2, Attender­1, Court Keeper­1, Office attenders­2, Part Time Sweeper­1.

The functions and duties of this Court are mainly based on


administration of Justice within its jurisdiction.

2. The Powers and duties of officers and employees

The Munsiff Court exercises Jurisdiction on original side in civil matters and
Judicial First Class Magistrate Court­III exercises jurisdiction on criminal side
in criminal matters arising within its territorial jurisdiction. On the Judicial
side, the duties are to receive and dispose cases and matters pertaining to the
administration of justice and in the administrative side, that are as prescribed
in the manul of office procedure, Service Rules and various rules of practices.

3. The procedure followed in the decision making process, including


channels of supervision and accountability

In the judicial side, proceedings are channeled through Junior


Superintendent­> Court Fees/Inward Section Clerk­> Bench Clerk­> Judicial
Officer. In the administrative side, files are channeled through Clerks/Junior
Superintendent­>Judicial Officer.

4. The norms set for the discharge of functions

The functions are discharged in accordance with the various rules and
regulations constituted for the purpose. Issues are dealt with on priority basis,
expeditiously taking into account, the various instructions issued from
superior courts from time to time.
5. The rules, regulations, instructions, manuals and records held or
under the control or used by the employees for discharging the
functions

In the Judicial functions of the Courts:

• Various Central and State Acts and Rules in Civil and Criminal matters.

In Administrative functions of the Courts:

• Manual of Office procedure.


• Kerala Service Rules.
• Kerala State and Subordinate Service Rules
• Kerala Civil Services (Classification, Control and Appeal) Rules
• Special Rules for Kerala Last Grade Servants
• Kerala Government Servant's Conduct Rules.

• Documents and records pertaining to cases, pending and disposed


• Documents and records of administrative matters

Complaint committee for the prevention of sexual harrassment at work

The monthly remuneration is likely to change depending on the grant of


increments and variation in the dearness allowance sanctioned by the
Government from time to time. The sanctiond strength and pay scales
of the officers and employees of this establishment are furnished at
Annexure­A

plans,proposed expenditure and disbursment made

No subsidy programmes are executed by this establishment and no


amount has been allocated for the same.

The history of cases from the date of filing till disposal have been
reduced to electronic form and are available in the website

15. Facilities avilable to citizens for obtaining information including the

use
