 The President of Islamic Republic of Pakistan is the


ceremonial head of the state of Pakistan and
Commander-in-Chief of Pakistan Armed Forces.
 The constitution prohibits the president from directly
running the government. Instead, the executive power is
exercised on his behalf by the prime minister.
 All appointments at higher commands of
the military must be made by the President on a required
and necessary basis, upon consultation and
approval from the prime minister.

Eligibility:-
1. He must be a citizen of Pakistan.
2. He must be a Muslim.
3. The minimum age required is 45 years.
4. He must be qualified to be elected as member of National Assembly.

 Article 41 (2):- “A person shall not be qualified for election as President


unless he is a Muslim of not less than forty-five years of age and is
qualified to be elected as member of the National Assembly.”

Selection Procedure:-

 Article
41 (3):- “The President shall be elected by
the member of an electoral college consisting of:-
a. The members of both Houses;
b. The members of the Provincial Assemblies.”

Powers and Role of President as per Constitution:-


 Article 41 (1):- President to be head of State.
 Article
42:- President to take oath before Chief Justice of
Pakistan.
 Article43 (1):- President can not hold any other office
after being President.
 Article43 (2):- President can not be a candidate for
election as a member of National or Provincial Assembly
after becoming President.

 Article 44 (1):- Tenure of President to be 5 years.
 Article 44 (2):- No one can be president for 3rd time.
 Article44 (3):- President can give written resignation to
Speaker of National Assembly.
 Article45:- President have the power to grant pardon or
suspend any sentence pass by any court.
 Article 46:- Prime Minister to keep informed the President on
all matters of internal, foreign policy and legislative proposals.

 Article 47:- Procedure to remove President.
 Article48:- President to act on the advices of the Cabinet
and Prime Minister.
 Article 49:- In President's absence, the chairman of
Senate exercises the responsibilities of the post, until the
actual president resumes office, or the next office holder
is elected.
 Article
56:- President can address one House or both Houses
assembled together.

58:- President can dissolve National Assembly if
advised by Prime Minister.

70 (3):- Bill to be presented to President after
passing from both houses.
 Article 89:- President have power to issue ordinance.
 Article
232:- President can declare emergency on
account of war or internal disturbance.
