JOB DESCRIPTION

JOB TITLE: Case Builder - Traffic

SCALE: 5/6

SUPERVISION AND CONTROL: Case & Traffic Manager

PLACE OF WORK: Justice Department

PURPOSE OF THE JOB:

Provide support to the Force with the preparation of prosecution cases and
provide assistance and advice to victims, witnesses and the public to contribute
to the delivery of justice.

Review files submitted for consideration of summons/requisition procedures and


make decisions upon the disposal of these files taking into account diversion
options, the evidential and public interest tests set out in the Code for Crown
Prosecutors and the Director’s Guidance on Charging.

MAIN RESPONSIBILITIES:

1. To provide advice and guidance on criminal/road traffic legislative issues,


evidence, procedures and quality standards to staff driving forward the
decision making process.

2. Manage the building of appropriate cases for prosecution, utilising Justice


Department and other resources as appropriate, ensuring all submissions
for evidential sufficiency, procedural correctness and content are in
accordance with Force practice and procedures to maximise opportunities
for a successful prosecution.

3. To act as Disclosure Officer ensuring that appropriate legislative


requirements and guidelines are met.

4. Using professional judgment action Crown Prosecution Service (CPS) memo


requests in suitable cases.

5. To liaise with the Officer in Case (OIC) and CPS lawyers at all appropriate
stages. Where the CPS is considering the discontinuance of a prosecution,
to mediate on behalf of the Police, as appropriate, through liaison with the
Prosecutors and operational staff.

6. To review summons/requisition cases in liaison with officers, staff and


where appropriate, CPS Prosecutors, in accordance with legal and Force
requirements. Make decisions on whether a case can be prosecuted by way
of summons/requisition, diverted or advised no further action following
assessment of the evidence and requesting further enquiries be completed
where necessary.

7. To oversee the investigation into Road Traffic Collisions and HORT 10s and
make the appropriate disposal decision.

8. Actively identify good practices and shortfalls in evidence gathering


processes, notifying management where appropriate, and suggesting
improvements in working practices to increase efficiency, user satisfaction
and enhance service delivery. Support relationships and systems between
the Force and partner organisations.

9. To interview witnesses and obtain statements.

10. At the discretion of the line manager, provide support to operational staff
with building serious and complex case files.

11. To prepare case papers prior to attending court, liaising with courts over
any queries related to cases listed.

12. To attend court to present specified offence cases, ensuring compliance with
the Data Protection Act, checking the validity of documents produced,
dealing with any legal arguments, liaising with attendees at court over
potential trial issues, resulting case files including driving disqualification,
arranging trials and adjournments and ensuring that costs are applied for
on behalf of Northamptonshire Police.

NOTE:

The job description reflects the major tasks to be carried out by the post holder
and identifies a level of responsibility at which the post holder will be required to
work. In the interests of effective working major tasks may be reviewed from
time to time to reflect changing needs and circumstances. Such reviews and
other consequential changes, will be carried out in consultation with the post
holder. The post holder will be also required to carry out such other duties as
may be determined from time to time to be within the general scope of the post.

CONDITIONS OF SERVICE:

The appointment will be subject to the conditions of service of the Police Support
Staff Council.

The pro rata annual leave entitlement is 25 days with an additional 5 days after 3
years continuous service.

ESSENTIAL CRITERIA:

1. Demonstrate sound analytical and problem solving skills and ability to make
appropriate judgments and decisions, offering practical ideas and innovative
solutions but, knowing when to refer upwards for a decision.

2. Knowledge and understanding of Criminal Law, Road Traffic Legislation,


Police Procedures and Court Procedures, as evidenced by a Legal Degree
and/or experience in the Criminal Justice field commensurate to the level of
this role.

3. Excellent communication and interpersonal skills, including ability to


communicate and influence effectively at all levels, internally and externally,
appreciate others views and be aware of impact of own behaviour on
others.

4. Demonstrates the ability to contribute to continuous improvement and


development by proposing ideas for the work place and identifying their
own development needs.

5. Experience of diverse team working, demonstrated by an understanding


how own objectives fit into team objectives and builds effective working
relationships with members of own and other teams.

6. Experience of working to deadlines and delivering results through effective


planning and organisation of own workload, demonstrating the ability to
prioritise, even under pressure.

7. Computer Literacy and keyboard skills with good report writing skills with
ability to assimilate information accurately, structuring and presenting in a
logical and concise way.

8. Demonstrate the ability to respond to change in the working environment


by showing a willingness to adapt and be flexible in changing
circumstances.

9. Candidates must be able to demonstrate a level of awareness of equality,


diversity and inclusivity issues appropriate to the role.
