UNDERTAKING

I, Mr. Gaurav Jain S/o Sh. Naresh Chand Jain , aged about 54 Years R/o House No. C-114,
Belvedere Tower, DLF City Phase-2, Gurugram-122002, Haryana do hereby solemnly affirm and
undertake as under –
a) That I/We had booked a Unit no.451 in block 4 admeasuring 500.00 sq. ft. in the project
“Vatika One on One” (hereinafter referred to as “the unit”), developed by the company, M/s
Vatika One on One Pvt. Ltd. having its Corporate office at Ground Floor, Tower A, Vatika
INXT City Center, Sector-83, Vatika India Next, Gurugram – 122012, vide Builder Buyer
Agreement dated 10.08.2016 (“BBA”).
b) That owing to evolving policies, regulations and legal framework governing real estate
investments including the enactment of Banning of Unregulated Deposit Scheme Act 2019”
(BUDS Act) under which the payment of such assured returns / committed Returns in the
unregulated schemes were banned, the Promoter was constrained to stop the payments of assured
returns to the Allottee. I/We am/are providing this undertaking in full consciousness and without
any undue influence that I/We shall not claim any charges/compensation/indemnities towards
committed returns, incurred/accrued on the unit which I/we may have obtained by investing in
the unit, other than the monthly rentals once the said property is put on lease to a suitable tenant
by the developer. I/we hereby further forgo all my/our claims/rights against the unit towards
monthly assured returns as provided under the Allotment Letter / Builder Buyer’s Agreement and
or any other document with regard to the unit and or the company, M/s Vatika One on One Pvt.
Ltd. including the rights as mentioned under the BBA and confirm that I/we shall not be claiming
any dues against the unit mentioned above other than the monthly rent received from the tenant
occupying the said unit in future. I/We also confirm that M/s Vatika One on One Pvt. Ltd. holds
no further financial liability towards me/us in any form whatsoever.
c) That I/we shall be liable to pay the maintenance charges as applicable in accordance to the
builder buyer’s agreement billed by the maintenance agency appointed by the Developer
i.e.Vatika One on One Pvt. Ltd. and shall not dispute the same in any manner whatsoever.
d) That I/We confirm that I have opted the leasing assistance as per clause 18of the Agreement to
Selland therefore I shall be deemed to have in legal possession of the said Unit. I further
undertake not to claim the physical possession of the said Unit.
e) That I/We understand that in the event, if the Company, due to any reason, has to give physical
possession of the said Unit to me, Companies responsibility of providing services such as air-
conditioning, fire fighting and electrical supply shall be limited to catering to modules of area
3000 sq. feet each and it shall be my responsibility to further channelize the same services so as
to cater to my modules, provided that due to technical reasons, physical sub division of floor
spaces into independent units admeasuring 3000 sq. ft or less shall not be permitted. As such, if I
intend to take physical possession of the said Unit . I understand that I have to take the same
jointly/collectively with other co-allottees of the same floor plat wherein the said Unit is located.
