State Policy behind the enactment of the law?


- To promote the ideals of good governance in all its branches, departments, agencies, subdivisions, and instrumentalities,
including government-owned and/or controlled corporations (GOCCs) and local government units (LGUs) (Sec. 2, RA 9184)

What is the GPRA?

Principles of Procurement (P-A-C-T-S)

from the previous winning bidder whenever there arises a need to replenish goods procured under a contract previously
awarded through Competitive Bidding, subject to post-qualification process prescribed in the BD and provided all the
following conditions are present:
a. The unit price must be equal to or lower than that provided in the original contract
b. The repeat order does not result in splitting of requisitions or purchase orders
c. Except in special circumstances defined in the IRR, the repeat order shall be availed of only within six months from
the date of the Notice to Proceed arising from the original contract
d. The repeat order shall not exceed twenty five percent (25%) of the quantity of each item of the original contract

5. The amount involved does not exceed the amount of the ongoing project and
6. The contractor has no negative slippage
Provided, that negotiations for the procurement are commenced before the expiry of the original K. Wherever, applicable,
the principle shall also govern consultancy K, where the consultants have unique experience and expertise to deliver the
required service

e. Purchases of goods from another agency of the government (Agency-to-Agency), such as the Procurement Service of the
DBM (PS-DBM), which is tasked with a centralized procurement of commonly used Goods for the government

f. Scientific, Scholarly or Artistic Work, Exclusive Technology and Media Services


Where G/IP/CS can be contracted to a particular S/C/C and as determined by the HoPE, for any of the following:
1. Requirement is for:
(a) Work of art, commissioned work or services of an artist for a specific skill set (Ex. singer, poet, writer, painter,
sculptor, etc.)
(b) Scientific, academic, scholarly work or research, or legal services
(c) Highly specialized life-saving medical equipment, as certified by the DOH
(d) Scientific, technical, economic, business, trade or legal journal, magazine, paper, subscription, or other exclusive
statistical publications and references
(e) Media documentation, advertisement, or announcement through television, radio, newspaper, internet, and other
communication media
Due to the nature of the information to be disseminated, alongside principles of transparency, efficiency and economy,
award to more than one supplier may be made by the PE.
2. The construction or installation of an Infrastructure facility where the material, equipment, or technology under a
proprietary right can only be obtained from the same contractor.

g. Highly Technical Consultants


In the case of individual consultants hired to do work that is (i) highly technical or proprietary or (ii) primarily confidential or
policy determining, where trust and confidence are the primary consideration for the hiring of the consultant: Provided, that
however, that the term of the individual consultant shall, at the most, be on a six month basis, renewable at the option of
the appointing HoPE, but in no case shall exceed the term of the latter.

h. Defense Cooperation Agreement

i. Defense Inventory-Based Items


The DND may directly negotiate with an agency or instrumentality of another country with which the PH has entered into a
defense cooperation agreement or otherwise maintains diplomatic relations when the procurement involves major defense
equipment or material and/or defense-related consultancy services.

j. Small Value Procurement


Procurement of (a) goods not covered by Shopping, (b) under Infrastructure Projects and (c) under Consulting Services,

38. A warranty is required in the procurement of goods to ensure that the supplier, manufacturer or distributor, as the case
may be, will correct any manufacturing defect.
39. For the procurement of goods, a warranty shall be required from the contract awardee for a minimum period of three (3)
months, in the case of supplies, and one (1) year, in the case of equipment, after the acceptance by the PE of the goods
and/or equipment.
40. A latent defect is one that is not apparent to the buyer by reasonable observation. A latent defect is “hidden” or one that is
not immediately determinable.
41. An example of a latent defect is this - a ballpen that writes .75 kilometers instead of the expected 1.5 kilometers.
42. An example of a latent defect is this - a ballpen that does not write is latently defective.

43. In all instances, the PE shall ensure that the most advantageous price for the Government is obtained.
44. The Approved Procurement Plan (APP) reflects the entirety of the procurement activities that will be undertaken by the PE
within the calendar year as approved by the HoPE.
45. Sub-contracting means the division or breaking up of contracts into smaller quantities and amount, or dividing the
contract implementation into artificial phases or sub-contracts for the purpose of evading or circumventing the
requirements of law.
46. The Bidding Documents shall be prepared by the PE following the standard forms and manuals prescribed by the GPPB.
47. The Bidding Documents shall include the Form of Bid, Price Form and Bill of Qualities.
48. Pre-procurement conference is led by the BAC.
49. Bidders may be asked to pay a fee to recover the cost for the preparation and development of the Bidding Documents
pursuant to the Guidelines on the Sale of Bidding Documents.
50. The concerned BAC shall make the Bidding Documents available from the time the Invitation to Bid / Request for
Expression of Interest need not to be advertised/posted until the deadline for the submission and receipt of bids.
