This is with reference to an incident of OFFENSES AGAINST PROPERTY AND PROPERTY RIGHTS
reported against you by way of MISHANDLING OR GROSS NEGLIGENCE IN THE USE OF THE
COMPANY EQUIPMENT in GROSS VIOLATION of the COMPANY’S CODE OF DISCIPLINE.

Based on record, you stated during the administrative hearing on November 15, 2023, around 10:50 in the
morning, you were driving SVDC #15, providing transportation for employees heading to Butuan City.
When you reached Tagcatong, Carmen, you did not expect an incident to happen as you were maintaining
a speed limit of 40-50 km/h. However, the road was slippery, possibly causing the vehicle to start
zigzagging. Despite your efforts to maneuver the vehicle back on track, the lack of weight in the back
caused it to overturn. You acknowledged that your attempts to maneuver the vehicle may have led to it
dancing and overturning, resulting in damage to the unit. Furthermore, the total amount of the damage
cost incurred is Thirty-One Thousand Seven Hundred Fifty-Two Pesos (₱31,752.00). Moreover, you
admitted that you were at fault in this situation and agreed to pay for the damages through salary
deduction.

After thorough review and discussion on the matter, we find your action a clear violation of the
Company’s Code of Discipline. You are hereby SUSPENDED for SIX (6) DAYS WITHOUT PAY
effective immediately upon the receipt of this memo and PAYMENT FOR THE DAMAGES
amounting to Thirty-One Thousand Seven Hundred Fifty-Two Pesos
(₱31,752.00) which is subject for salary deduction. An amount of One Thousand Three Hundred
Twenty-Three Pesos (₱1,323.00) will be deducted from each pay period until the full amount is paid.
You can coordinate with your Immediate Superior with regards to the turnover of duties and
responsibilities.

All attendees appeared before the undersigned for this conference and as recorded through
the phone.

The alleged violation of Mr. Ramie B. Tapic of OFFENSES AGAINST PROPERTY AND
PROPERTY RIGHTS specifically MISHANDLING OR GROSS NEGLIGENCE IN THE USE OF
THE COMPANY EQUIPMENT as indicated in the Company Code of Discipline has been thoroughly
discussed.

Mr. Tapic gave his statement on the alleged violation that was imposed on him on October 28,
2023, around 6:00 in the morning wherein allegedly he was operating the company vehicle SVDC #15
when he suddenly lost control and skidded on a zigzag route near Tagcatong, Carmen. This resulted in the
vehicle overturning, causing damage, and the passenger sustained minor injuries.
According to Mr. Tapic, he was driving SVDC #15, providing transportation for employees heading
to Butuan City. When he reached Tagcatong, Carmen, he did not expect an incident to happen as he was
maintaining a speed limit of 40-50. However, the road was slippery, possibly causing the vehicle to start
zigzagging. Despite his efforts to maneuver the vehicle back on track, the lack of weight in the back
caused it to overturn. He admitted that his attempts to maneuver the vehicle may have led to it dancing
and overturning, resulting in damage to the unit. Thus, he acknowledged his responsibility for the incident
and he also accepted responsibility for the repair costs and agreed to pay for it.

The statement of Mr. Tapic and reports submitted to this office were attached as evidence during
this hearing.

This case will be endorsed to Mr. Jason Barquero for the final decision. Furthermore, Mr. Tapic will
shoulder the damage cost of the damaged unit.
