SUBJECT : NOTICE TO EXPLAIN WITH ADMINISTRATIVE HEARING

This is with reference to the incident report of OFFENSES AGAINST PROPERTY AND PROPERTY
RIGHTS as identified of the Company’s Code of Discipline last November 26, 2023, wherein allegedly
you were operating Company Water truck #5 delivering a water at Mohon sub-office. However, as you
maneuvered, you collided with another company vehicle, DMAX #70, which was parked in the area.
Consequently, DMAX #70 incurred damages to the left tail light.

To give you AMPLE OPPORTUNITY to present your side and defend yourself, you are hereby GIVEN
A CHANCE within FIVE (5) DAYS upon receipt hereof and EXPLAIN IN WRITING WHY NO
DISCIPLINARY MEASURES be imposed against you AS A MATTER OF DUE PROCESS for the
violation of the provision of our company’s Code of Discipline mentioned below:

SEC. 7 1st Offense – 6 Days
OFFENSES AGAINST 7.1 Mishandling or gross negligence in the Suspension
PROPERTY AND use of company property or equipment
PROPERTY RIGHTS 2nd Offense – Dismissal

Furthermore, you are invited to an administrative hearing on January 2, 2024, 10:00 AM at EPCC
Motorpool where you shall be given the opportunity to explain your side on the matter.

Failure on your part to submit your written explanation within the prescribed period and/ or attend the
scheduled hearing shall be considered as a waiver of your right to be heard and the Company shall decide
the matter on the basis of all record and evidence available to it.
