BETWEEN
Shri. Ramesh ChindhaShirsath. a Proprietor Firm registered under provisions respective acts
in force and their office situated at 02, Vedant Plaza, Near Vedmandir, Trimbak Road , Tal &
Dist. Nashik. and managed by Shri. Ramesh C. Shirsath who is aProprietor of the above
mentioned firm.

 Hereinafter for the sake of brevity referred to as "The Owner (Which expressionall unless it be
repugnant to the meaning of context thereof, mean and included the firm of all partners of the
firm, the Company at material time and their Successors)

in force and registered Government contracts registerd in appropriate class with
Goverment of Maharashtra having his /their office situated atAt post Indore , Tal.
DindoriDist.NashikHereinafter for the sake of brevity referred to as "The Hirer" (Which
expression shall, unless it be repugnant to the meaning of context thereof, mean and
included the firm of all the partners of the firm, the company at material time and their
Successors).Party of the Second Part.

Wherein the Party of the first part herein is an absolute owner of the, Drum Mix Plant,
Mechanical paver finisher, Mechanical Bitumen Sprayer, Static Roller,Vibrator Roller,
Sand Screening Machine, Tipper to substantiate or establish in the documentary evidence
in token of voucher enclosed. Where as party of the Second Part herein is a registered
Government Contractors as stated in appropriate class with Government of Maharashtra.

AND whereas the party of the Second part is or is likely to submit the tender for the work of
Improvements :-Notice No 49P.W.(kalwan)Div, 2023-2024Work No.6) Improvements to
Hathgarh Fort Approach Road, Street Light and Campus Beautification at Tal. Surgana,
Dist. NashikAND WHEREAS the party of the second part intends to use the machinery of
the said work as is being stipulated by the Department and the desirous of taking the one/s
on monthly hire charges basis.And whereas the party of the first party is desirous of giving the
hire charges basis to the party of the second part.AND WHEREAS to these presents are desirous
of recording the terms and of the agreement, reduce the same to writing. NOW therefore this
article of agreement witnessed as under. One is to be hired.
It is hereby agreed between the parties to these presents that Drum Mix Plant, Mechanical
paver finisher, Mechanical Bitumen Sprayer, Static Roller,Vibrator Roller, Sand
Screening Machine, Tipperof the second part has agreed to pay an amount of Rs. 3,92,000/- to
the party of the first part on account of monthly wages of the machines as detailed be- low at the
end of each month.

The Party of the second part shall also pay an amount of Rs. 100000/- as interest deposit Rs.
100000/- shall entire be refunded by the first part to the party of the second part or shall be
adjusted in the final of the hire charges of the machines.

Date of Hire: It is hereby expressly declared by the parties to the present that the machines
shall be hired on and from the date of commencement of the work being awarded or that would
be awarded by the Executive Engineer. P.W.D (kalwan)DIV, Nashik of the party of the second
part herein.
It is hereby agreed by and between the parties of these presents that instant agreement shall
remain in force from the date of hire as specified in Clause two above to the date of either
completion of the work in question or six months from the date of hire whichever period
expires later.
Mode of Payment: Monthly hire charges of the machines as specified in Clause one above
shall be paid by the party of the second part as on the last day of each month by issuing a
crossed Account payee Cheque r crossed Account payee Demand Draft.
Repairs and Maintenance: it is hereby agreed by the party of the first part
It shall bear all day to day expenses of the machines on account of fuel, oil and lubricants,
operators, maintenance and repair charges during the currency of the period for which
machines let out on hire charges to the party of the second part.
It is further agreed that if the party of the second part spends on the operators, repairs and
maintenance for the machines hired by it party of the second part has every right to deduct the
said amount from the monthly hire charges payable to the party of the first part.
The party of the first part shall always keep the machine/s is good working conditions that are
given on hire charges basis to the party of the second part. It is further agreed thatthe day spend
on repairs and maintenance shall be excluded for the purpose of calculating-the monthly hire
charges.
The party of the second part shall have right to deducted the Income Tax all source at the
prescribed rate of provisions of Income Tax Act as ordered by the Government of India are
applicable.
In Testimony where of the parties to these present have set and subscribed their respective
signature on the day, month and year herein above written.

2. The undersigned also hereby certifies that neither our firm Vishal Construwell (Pro. Shree.
BhausahebTukaramSangale) have Abandoned any work on National Highways in India nor any
contract awarded to us for such works have been rescinded, during last five years prior to the
date of this bid.
3. The undersigned hereby authorise(s) and request(s) any bank, person, firm or corporation to
furnish pertinent information deemed necessary and requested by the Department to verify this
statement or regarding my (our) competence and general reputation.
4. The undersigned understand and agrees that further qualifying information may be
requested, and agrees to furnish any such information at the request of the Department Project
implementing agency.
