My observation of contract are written between two people who sign them freely they
contain all of the information that can only be obtained via a business. The implication
of contract law to the tourism and hospitality industry are extensive any contact signed
needs to have unambiguous terms be clearly accepted have an exchange of value and
be signed by an adult with full mental capacity or by an authorized signatory of the
organization.

2. Based on your observation and what you have learned about obligations and
contracts, draft a sample contract (e.g., purchasing contract, catering
contract) assuming you own a tourism and hospitality-related business.

Terra Bites Catering Agreement:

This CATERING AGREEMENT is made between Karl Hernandez, henceforth referred to as the customer,
and Terra Bites Catering, hereby referred to as the caterer, on April 22, 2024.

Particulars

WHERAS the CATERER is a properly licensed and registered catering firm,
Therefore, the caterer undertakes to cater the above-mentioned event/function for the
customer. Now, both parties bind themselves and agree to the following:

1. DEPOSIT: 50% of the projected contract cost of PHP 10,000 is payable and
demandable at the time of booking, and will be subtracted from the Total Final
Payment, unless otherwise specified. There have been prior agreements established.
2. FINAL PAYMENT: At least seven (7) days prior to the event date, final payment is due
and demandable by 12:00 noon on or before Friday. If no additional arrangements have
been made, the amount will be handled using the payment method on file at this time.
Upon request, payment arrangements are available.
3. MENU: Menu choices must be made by Friday, at least thirty (30) days prior to the
event date and are subject to product availability and/or upcharge. Changes to a menu
made less than thirty (30) days before the event date may incur a cost at the caterer's
discretion.
4. COST: Menu pricing is subject to variation within thirty (30) days of the event due to
the shifting cost of food products. When a significant change in the cost of a menu
component happens, the client will be notified within thirty (30) days and will have two
options: pay the higher cost based on the current adjusted pricing or substitute
alternative menu items to keep the agreed-upon cost per person/item.
5. PAYMENT METHOD: Cash, checks, and all major debit/credit cards are accepted. A valid
debit or credit card must be on file at the time of booking, regardless of payment
method. Payments by check must be received on or by Friday, seven (7) days prior to
the event date. If the caterer does not receive the check by the deadline, the
outstanding money will be charged to the debit or credit card on file. On request, a cash
payment discount is available. and at the caterer's discretion.
6. SERVICE CHARGE: All transactions will be liable to an 18% service charge for events
or functions. Except if stated otherwise, The fee covers insurance, advertising,
administrative personnel, truck upkeep, petrol to go to events, and other running
costs in general. This is NOT a gratuity for the event/function.
7. GUEST COUNT: The final guest count, which cannot be reduced, is required five (5)
days before the event. Any additional guests beyond the indicated duration will be
subject to additional costs imposed by the caterer.
8. CHILDREN: Unless the customer decides to offer services for them, children under the
age of five are free. At the agreed-upon cost per person, children aged six to twelve

12) will be paid half price.
9. FOOD QUANTITY: Based on the final guest count supplied by the customer, the
caterer will prepare between 5% and 10% overage. A portion of this surplus is set aside
for personnel or service suppliers. This will not be charged to the client.
10. LEFT OVER: The caterer reserves the right, in compliance with applicable health codes,
to discard any remaining food products if there is a realistic chance of foodborne
disease occurring beyond the agreed-upon event timeframe.
11. BEVERAGES: The client agrees to provide all bar and beverage supplies as needed.
As previously agreed in writing, the caterer may additionally provide beverage
service or bar support.
12. TIME: Any time extension beyond the agreed-upon period will be charged to
the customer as additional employee hours.
13. CHANGE OF EVENT DATE OR VENUE: Subject to the caterer's availability, the whole
remainder of the client's deposits and payment will be applied to another event.
All prices are subject to change without notice.
14. RENTALS: The caterer may offer all or part of the event rentals. Certain purchases,
however, may be subject to restocking and cancellation costs. The customer will
have paid the rental directly if the caterer arranges rentals for the client through a
rental business. Any rental loss or damage will be invoiced to the customer after the
event.
15. STORAGE: Any storage service before or after the event/function requires prior
consent from the caterer.
16. ASSIGNABILITY: Without the previous written approval of the other party, this
contract cannot be assigned to Caterer.
17. CANCELLATION BY CLIENT/VENUE/ACTS OF GOD: If the event is canceled by the
customers, the venue, or by an act of God ninety (90) days or more before the
event date, all prepayments and deposits will be refunded in full.
18. CANCELLATION BY CATERER: The caterer retains the right to end this contract at any
time for any reason. If the caterer cancels the contract up to 30 days before the event,
the event will be canceled. All deposits and prepayments will be refunded in full
within 10 days of the due date.
19. DAMAGE: The caterer retains the right to end this contract at any time for any reason. If
the caterer cancels the contract up to 30 days before the event, the event will be
canceled. All deposits and prepayments will be refunded in full within 10 days of the
due date.
20. CATER LIABILITY: Except for third-party claims, the client releases Caterer from any
liability. Caterer's conduct and/or the carelessness of its personnel For example,
claims are limited to a certain amount of time.
21. INSURANCE: Cater ensures adequate general liability and vehicle insurance limits.
22. TAXES: The current fee for all services delivered will be changed by the client as per
a decision made by the relevant government agency.
23. UNLAWFUL ACTIVITIES: The client will abide by all Philippine laws, local regulations,
and authorized police and fire department orders, and will not conduct anything on the
event/function premises that violates any laws, ordinances, rules, or orders.
24. AMMENDMENT AND SUPPLEMENT: Any revisions or supplements to this
agreement will only take effect if both parties sign a formal agreement 5 days prior
to the event/function date.
25. GOVERNING LAW: The agreement will be regulated by and subject to consultation in
line with the following: the Philippines' legal system. IN WITNESS WHEREOF, the parties

SUMMARY OF THE ESSENTIAL ELEMENTS OF THE CONTRACT

I assumed that there are a number of criteria and components we need to take into account
when creating a contract to make it legally enforceable in a court of law because we investigated
and produced a contract relating to the tourist and hospitality business, specifically a catering
contract. In general, a genuine contract can only be considered to exist when both parties sign it
after the offer has been accepted. A contract will also take a while to complete since both
parties must concur on its terms and circumstances before it can be recognized by governing
legal authorities and put into effect.
