This contract of employment is entered into between P&O Cruises (hereinafter


referred to as „Employer‟) and PARMOD KUMAR.Passport Number : P3214092
(hereinafter referred to as „Employee‟) on 29/03/2024.We are confident you will
find this new opportunity both challenging and rewarding.

The following points outline the terms and conditions we are proposing.

NOW THEREFORE THE PARTIES agree as follows:

1. REMUNERATION

Position title : HELPER ( BAGGAGE SERVICES)


Period of Contract : 2 Years
Start Up Date : 29TH Mar 2024
Wages : Salary/allowance are paid in Kuwait Dinar
Training Period : 7 days training prior to joining date
Basic Salary : 180,KD/ ( One Hundred Eighty, KD) Monthly
Place of Employment : Kuwait International Airport
Working Hours : 8 Hours per day
Working Days : Saturday to Thusday
Annual Leave : 60 days Two Year
Air Ticket During Leave : 2 ticket/ Twice in 2 Year (Provided by the company)
Accommodation : Well-furnished Provided by the Company
Transportation : Provided by the company
Air Ticket while joining&
Upon Return : Provided by the company
Medical Benefits : Provided by the Company
Gratuity : As per Kuwait Law
Notice Period : 3 Month
Maternity Leave : 60 Days paid
Sick leave : 15 Days paid
Food : Provided by Company
2. OBLIGATIONS

You shall faithfully and to the best of your ability perform your duties that may be
entrusted to you from time to time by the management. You will be bound by rules,
regulations and orders promulgated by the management in relation to conduct,
discipline and policy matters.

During the tenure of your services, you will wholly devote yourself to the work
assigned to you and will not undertake any other employment either on full or part
time basis without prior permission of the Company in writing. Any contravention of
this condition will entail termination of your services from the Company.

During the period of service with the company, you shall not indulge and/ or take part
in any activity of formation of council and / or association or become a member being
part of management staff which are found to be detrimental in the interest of the
company in any way. Such an action shall be deemed as infringement to service
conditions of the company and amount to causing damage to its interest and shall call
for disciplinary action being taken against you, as it may deem fit and appropriate. In
the event you are absent from duty without information or permission of leave or
you overstay your sanctioned leave, the Management will treat you as having
voluntarily abandoned the services of the Company.

3. CONFIDENTIALITY

All documents, plans, drawings, prints, trade secrets, technical information, reports,
statements, correspondence etc., written or unwritten and also information and
instructions that pass through you or come to your knowledge shall be treated as
confidential.You shall not utilize them for your own use or disclose to other
persons during or after your employment.

During the course of employment with the Company, you will acquire, gain,
generate, gather and develop knowledge of and be given access to business
information about products activities, know – how, methods or refinements and
business plans and business secrets and other information concerning the
products / business of the Company, hereinafter called the “SECRETS”. You
will be liable for prosecution for damages for divulgence, sharing or parting any of
such information during course of employment and on cessation for at least 2 years
period.
4. OTHER INTERESTS

While you are in employment of the company , you may be given or handed over
company ‟s property and / or equipment for official use and you shall take care of
them including their upkeep. On cessation of employment with the Company, you
shall return all documents, books, papers relating to the affairs of the Company,
purchased with the Company‟s money, which may have come to you, and also any
property of the Company in your possession.

Any balance of advance or loan taken by you from the Company, shall be fully
recovered from your salary and any other legal dues including Gratuity , at the time
of your leaving the services of the Company.

While working as an employee if you enter into any business transaction with any
party on behalf of the company within your permissible limits, it shall be your
responsibility to ensure recovery of outstanding. If any outstanding remains at the
time of leaving the services of the company, it shall be your responsibility to recover
for remittance to the company before you proceed to settle your legal dues in full and
final settlement of your account.

All disputes arising out of this letter will be subject to the jurisdiction of the Kuwait
Court. And that the courts, tribunals and/or authorities at Kuwait only shall have
jurisdiction to entertain, try and decide such disputes or differences arising out of or
pertaining to this contract of employment, irrespective of your working HQ being
elsewhere at that times.

5. TERM

The terms of this Agreement shall be governed and construed in accordance with the
laws of Kuwait.

6. PLACE OF WORK

You will be employed in Kuwait, and the Company may at any time require you to
work at any other location of the Company or of any client to which the Company
is providing services according to the business needs.

7. TAXATION

The Kuwait government does not collect income tax. Whether or not a non-Australia
national will be required to pay tax in his or her home country will depend on the tax
regime applicable to each individual. The Kuwait government does not collect social
security contributions for non-Australia nationals. However, with respect to Kuwait
nationals, both the employer and the employee are required to make
Overtime is when the Employee more than 40 hours a week. All endeavours should
be made to avoid overtime. Overtime, if any, will be made up at the end of the month
and be paid separately.

At the Employee‟s option, overtime will be paid either by way of time off in lieu or as
overtime pay according to the Kuwait Law

8. CHILDREN’S ILLNESS ETC

The Employer agrees to provide and to pay the premiums for health, hospitalization,
surgical, vision, dental and comprehensive medical insurance for the Employee and
his/her dependents equal to that which is provided to all other employees.

9. HOLIDAYS AND DAYS OFF

The Employees are entitled to 30 calendar days of paid vacation after they have been
Employed for one year. This is roughly equivalent to 22 working days. In addition,
Employees are entitled to official public holidays declared for the sector in which they
are working (public or private). Muslim employees are also entitled to 30 days‟
unpaid leave once during their employment to perform

10. TRAVEL ARRANGEMENT/EXPENSES

The Employee shall be solely responsible for and bear expenses of securing entry
visa/work permits will be reimbursed upon arrival and P&O Cruises shall be solely
responsible for the flight ticket. The Employee shall pay for all necessary fees and
expenses incurred from the acquisition of work permit in accordance with the Kuwait
regulations.

11. COMPETENCY/DEVELOPMENT/DEVELOPMENT INTERVIEW

The Employee has the right and duty to participate in competency development,
which is relevant for the employment, including educational courses. The Employee
has the right to participate in continuing education for a minimum of 2 weeks a year
and the expenses will be paid by the Company according to invoice. The Employee is
entitled to time off work with pay for up to three days for preparation for exam(s), as
well as on the day of the exam(s).
Once annually a development interview is to be held between the Employee and
his/her nearest manager. The purpose of the employee‟s development interview is to
ensure a goal-oriented and systematic development of the Employee‟s professional
and personal competencies. In the employee‟s development interview a written;
personal development plan must be drawn up, where development goals and activities
for the Employee must be expressed.
The parties are mutually bound to follow up on the development goals and activities
agreed in the development plan.

12. INCREMENT

Your future increments or promotion or any other salary increase shall be based on
merit considering your periodic and consistent overall performance, business
conditions and other parameters fixed from time to time at the discretion of the
management and shall not be considered merely as a matter of right.

13. AMENDMENT/TERMINATION

This Agreement may be amended or cancelled by mutual agreement of the parties


without the consent of any other person and, so long as the Employee lives, no person,
other than the parties hereto, shall have any rights under or interest in this Agreement
or the subject matter hereof The Employment Period shall terminate as of the earliest.

14. RENEWAL

This agreement shall remain in force for a period of Two years and extendable by
mutual consent accordance with the Labor Laws of Kuwait..

15. NEWSPAPER, MAGAZINES, TELEPHONE AND HOME OFFICE

The Employee is entitled to paid subscriptions for newspaper(s) and magazine(s).


The Company will make a cell phone available to the Employee. Besides, the
Employee is entitled to a paid fixed-line telephone and Internet connection.
At the Employee‟s home a home office will be set up, including the necessary
hardware and software to perform the work.

The above equipment may be used both for work and private purposes, and the
Company will pay the establishment costs as well as the on-going costs..

16. TRAVEL/ENTERTAINMENT/ADVANCE SALARY

The Employee‟s expenses towards transportation, overnight stays, entertainment,


attendance at courses, in-service training etc. will be covered by the Company
according to vouchers submitted. The Employee is however entitled to advance
payments if the Employee so requests.
The Employee will be entitled to Three (3) Months‟ advance salary before Candidates
embark on journey to assume duty. This is to enable candidates settle all domestic
needs before travel. As such no excuses will be entertained on assumption of duty
relating to default.
Employees (Expatriates) are to note that Three (3) Months‟ salary are paid as soon as
Employee have furnish us with the Kuwait Work Permit Visa which will be
processe
17. DISABILITY
Subject to the provisions of monthly salary, if the Employee's employment is
terminated during the Employment Period by reason of his Disability (as defined
below), the Employee shall continue to receive an annual salary and benefits in
accordance with employment contract through the end of the full calendar month of
such disability but not in any event beyond the end of the Employment Period. For
purposes of this Agreement the term "Disability" means a physical or mental
disability which renders the Employee incapable of performing his duties under this
Agreement and which disability has existed as determined by an independent
physician selected by the Company and agreed to by the Employee. Any salary
payments to the Employee shall be reduced by the amount of any benefits paid for the
same period of time under the Company's disability insurance programs.

18. REPATRIATION UPON DEATH

In the event of death, the Company shall:a) Arrange the corpse properly embalmed
and sent to the Employee‟s home of record at company‟s expenses.
b) Arrange to send the personal belongings and entitlements of the deceased to the
legal heirs in accordance of the Labor Law of Kuwait.

19. END OF SERVICES GRADUITY (ESG)

Employees who have provided more than one year‟s service may be entitled to an
ESG payment. An ESG payment is calculated as the sum of the following:
(i) 21 days‟ salary for each year of the first five years of service
(ii) 30 days‟ salary for each additional year of service
(iii)

The maximum ESG entitlement is two years of salary. If an employee resigns that
Individual is entitled to 1/3 of their ESG payment if his or her length of service is
between one and three years; 2/3 of their ESG payment if his or her length of service
is between three and five years; and a full ESG payment if his or her length of service
is more than five years.
The employee is not entitled to an ESG payment if the employee is terminated for one
of the reasons set out in Article 120 of the Labour Law.

20. PASSES, PERMITS AND LICENCES

Employee shall obtain and maintain at its own expenses all authorisations, passes,
permits and licences as may be necessary for the performance of the Works and which
are required to be or can be obtained in the name of Company. Employee is required
to comply with all Government and Company regulations relating to security and
immigration matters as are applicable through the travel agent.
21. CONTRACT UNDERSTANDING

In witness whereof, the parties declare that they have read and fully aware of all the
terms and conditions of this contract and that they signed below in full bona-fide,
hereby entered into contractual commitment and provision of this contract agreement
based on the conduct of the parties herein through the period of the agreement, both
parties may decide to extend the agreement in the future, where term of
