- Mandatory UAE Standard (Technical Regulation): Approved UAE standard which shall be
mandatorily applied as per the resolution issued by the Cabinet.
- Conformity Certificate: A certificate issued by ESMA to the given product ensuring that
the product complies the requirements of this scheme.
- Mark: Any illustration or symbol or stamp or engraving or picture appearing on the product
that indicates that the given product complies with requirements of the standard issued by
ESMA or international standards body in terms of quality.
Article (2)
Scope
This scheme covers all spare parts, as mentioned in Annex (1), and covers products manufactured in the
country or imported from outside the country to ensure compliance with the requirements of this
scheme
Article (3)
1.3 ‐ The supplier, with his various roles in the supply chain, shall comply with all the requirements of
this scheme including the compliance to the UAE standards (Annex 1).
3.3- The supplier shall retain the declaration of conformity and all the related technical
documents, and make them available to the competent authorities in the case of need or if they
are requested.
4.3- In case if it is found that spare parts released in to the market are defective and/or pose
risk to the end user then the supplier shall inform ESMA and the competent authorities, and
shall withdraw and /or recall the product.
Article (4)
Verification of Conformity
The supplier shall comply with the following requirements to be granted a conformity certificate:
2.4 - The conformity Assessment process shall be conducted by ESMA or by ESMA recognized
conformity assessment bodies.
3.4 ‐ Product shall comply with the relevant standards mentioned in Annex 1.
4.4 - The product shall be tested according to this scheme requirement at any laboratory
recognized by ESMA, the test report date shall be less than 3 years.
5.4 In the case of genuine spare parts, the test report and declaration of conformity shall be
submitted from parts / vehicle manufacturer.
6.4 - Effective implementation of a quality management system according to the latest edition of
ISO / TS 16949.
7.4 The Conformity Assessment Scheme- Type (B) shall be applied for spare parts defined in
Annex (1)
4.8 - Product(s) with the Emirates Quality Mark or any other Conformity mark approved by
ESMA shall be considered to fulfill the requirements of this scheme.
4.9 - ESMA is responsible for receiving and reviewing the applications, and issuing the
products conformity certificates or Emirates Quality Mark, and has the right to authorize any
recognized conformity assessment bodies approved by ESMA to register and check the
compliance of the product to the requirement of this scheme.
Article (5)
5.1- ESMA and / or concerned authorities have the right to take the samples from the market
for testing to check the compliance of the product(s).
5.2 ‐ Prohibits to import or display or sell any products not registered in Emirates Conformity
Assessment Scheme (ECAS).
5.3 ‐ In case of non‐conformities, if the source of non‐conformity cannot be traced then the
owner of the shop, from which the sample(s) is collected, will be held responsible for the non‐
conformity unless it is proved otherwise within the stipulated time.
5.4 ‐ ESMA has the right to take appropriate measures against the non‐complying product(s).
Such measures include withdrawal or recall of the product or cancellation of conformity
certificate.
Article (6)
6.1 - In case of any violation(s) to any of the requirements of this scheme, ESMA or the competent
authority shall take appropriate action(s), to resolve the issue and remove its traces from market,
which include:
6.1.1 - Instructing the responsible party to withdraw the product from market with the aim of
rectification or sending it back to the country of origin or destroying it with in the defined period
of time.
6.1.2 - Implement all the required actions to withdraw and /or recall the product(s) or
any other necessary corrective actions. The violated party shall bear all the related fees.

6.3 - The person involved or held accountable for the violation shall be subjected to all the
procedures, measures and penalties stated in the Federal Law No. (28) of 2001 for Establishing
the Emirates Authority for Standardization & Metrology (ESMA) and its amendments, without
prejudice to the right to impose any severer penalty under other laws.
Article (7)
7.1 - The supplier shall register the products with ECAS within 180 days from the date publication
of this scheme in The Official Gazette.
7.2 ‐ Non‐registered products already in the market are allowed to be traded in UAE for a period
of not more than one year after the publication of this scheme in the Official UAE Gazette.
Article (8)
Final Provisions
8.1 The standards mentioned in Annex 1 shall be considered as mandatory standards for the
purpose of implementation of this scheme. The Board of Directors has the right to adopt any other
standard(s) which are required to implement this scheme.
8.2 The annex that attached to this document shall be considered as a part of this scheme, and the
Board of Directors has the right to amend any Annex, when required.
8.3 ESMA is responsible for receiving, registering and studying the application from the suppliers.
ESMA has also right to grant authorization to competent authorities for receiving, registering and
studying the application from the suppliers.
The provisions of this resolution does not prevent the supplier's commitment to the safety and
environment legislation, and all other applicable legislation, relating to trading, transport and
storage of vehicle parts.
8.5 Any issue that cannot be resolved by this scheme, shall be referred to the Director General for
the appropriate decision in the best interest of the public,
Article (9)
Cancellation
The requirements stated in any other regulation or law will be cancelled if such requirement(s)
contradict with the requirements of this scheme.
Article (10)
This scheme is published in the Official Gazette and come in to force from the date of
publication and all the concerned authorities shall implement it.
